Bally's fitness is probably one of the most unethical businesses that I have ever done business with. I have moved away from my initial gym (which I rarely visited because all of the male trainers were uncomfortably close and pushy), and further than the necessary 25 mile radius from another. The contract states that if you are not within 25 driving miles, that you may, for 50 dollars, cancel the account. I do, so I submitted the info requested in the contract to the specified address and now they are claiming that my address is "invalid", and according to "mapquest" there is a gym within 18 miles of my "zip" code, not physical address.
First of all, mapquest is merely a tool to help estimate time and travel, but serves more as a source for directions (a poor one at that) and is far from an accurate instrument used for determining distances. Secondly, I do not live at the center of my Zip code. They kept saying my address was "invalid" and that my zip... invalid, my zip... etc... A.K.A. the run-around. This was a much more intense conversation with both of us in a low yelling fit.
When I requested the supervisor, all I got was more of the same, except for the "fact" that she had the power to use a door to door checker, but she was unable to verify because the computers were "acting very slow today" (all of a sudden). Ultimately, it seems to me that their contract is open to interpretation by their employees and that their employees either willfully give misinformation, or choose to directly contradict each other creating a chaotic mind state for the customer [myself].
I don't know what to do. They keep charging me, i keep sendning in the info the request when we speak, they won't cancel my account, and I'm at wits end.

If you are outside of the 25 driving miles they require you can legally get out of the contract. However, you have to be sure you are outside of this. Sites like Mapquest are door to door if you put in the full address. If you just use the zip code the starting point is not the center of the zip code but the location of the post office.
The first thing you need to do is enter your address and get dirving directions to where they say the closest Bally's is. Mapquest is fairily accurate if it knows the address, when I have compared it the difference has always been less than a mile. If mapquest says your address is invalid, then use other mapping sites such as yahoo or google maps. If when you do that it is over 25 miles then here is what to do. Send them a certified letter stating that you are cancelling the contract because you are outside of the 25 mile driving radius, include in that letter the copy of the mapquest(or whatever) driving directions. Basically in the letter you have to send them proof that you are outside of this 25 miles. State that they have 14 days to send you written confirmation they have cancelled the contract or you will take them to small claims court for a refund of the monies paid.
