My husband and I were members of Golds Gym located 8552 Baymeadows Rd, Jacksonville, Florida, 32256 (now operating under the name Just Fitness). Per our contract termination terms we submitted a copy of our new rental lease which evidenced our move from Jacksonville, Florida to Columbia, South Carolina. Per our contract lease terms and cancellation requirements with Golds Gym’s billing company ABC Financial Services we were allowed contract termination with 30 days notice and copies of our new rental agreement due to our moving over 50 miles from our gym location. We submitted our cancellation notice as well as copies of our rental agreement by certified mail to ABC Financial July 2009. It is September 2009 and Gold’s Gym (now operating under the name Just Fitness) continues to withdraw monies from our account.
We contacted Golds Gym and got the run around. Every time we called we were told that the manager (Dan) was unavailable and we continually left messages that were NEVER returned. We contacted ABC Financial and they confirmed that our accounts were due to be cancelled and no further account withdrawals should have taken place. BUT they claimed that since they no longer did billing for Gold’s Gym and that they were unable to contact the new billing company National Fitness to notify them of the cancellation. They claimed that they couldn’t contact them “by law”…and when I asked them “by which law” they had no answer. The rep said that he would email me confirmation of our cancellation and 48 hours later I have received NOTHING. ABC Financial Services advised me to contact National Fitness and tell them to contact them. Okay, did that.
National Fitness claims that ABC Financial Services failed to give them all of the required paperwork and therefore our account looks active to them. They refused to contact ABC Financial Services to get confirmation of our account status. They then told me to contact ABC Financial and ask them to send confirmation of cancellation. I informed them that ABC Financial already refused to do so. The National Fitness representative then told me to fax them over copies of any cancellation information that I had regarding my account. Well, since ABC Financial Services never sent us anything I wound up sending a copy of my cancellation notice sent to ABC Financial Services as well as a cancellation confirmation that we initially printed from their online billing site months prior (the other cancellation notice was never posted on the online billing site). We sent copies of our documents to ABC Financial, National Fitness and Golds Gym (Just Fitness) and we have heard nothing.
We have been ignored by Golds Gym and given the run around by ABC Financial Services and National Fitness. We are demanding that the account withdrawals cease immediately and all monies credited back to our account. We will pursue legal action, warn others and continue our fight against this unscrupulous theft of our hard earned money.
