Ladies Workout Express fraudulently took $156.00 of my money after the contract was legally canceled and during which time I was not allowed in the gym because I was no longer a member!!!!!!!!
I purchased a 17 week trial membership including personal training sessions and sessions with the dietitian. I could cancel within 17 weeks. If not, the contract would run 2 years and $39.00/month would be charged. Within the 17 weeks I canceled. I sent a letter to the company explaining why (they did not follow through with advertised services - false advertising) and hand delivered a second copy of the letter to the gym manager. I was told, no problem, it is within the contract cancellation time & I lived up to my obligations, just stop coming in and there would be no more charges.
I did not go back to the gym, but they continued to bill me for another 5 months. At first the corporate office said there was no 17 week trial, but I still had the newspaper add and the trial certificate from the gym. The gym manager said to call again. This time I was told it was an error and as soon as they get the letter, they will stop charging me & issue refunds for erroneous charges. I faxed them copies of the letter multiple times. Each time I was told they received the letter, copy of bills, copy of contract, etc. The next time I'd call, they had no letter and no record of me talking to them. Again, I'd be told to send it in, give them a few months, and it would be taken care of. This went on for a few years , then I starting being told, I did not contact them soon enough and so they cannot do anything for me - I was just out the money.
They had no problem disregarding the contract, taking money from me, and not allowing me in the gym. Finally, I stopped getting charged because the gym closed. At that point I was refunded one $39.00 charge because it was charged after the gym closed (I still had to call and argue to get that refunded) but they refused to refund the rest of the fraudulent charges (4X $39.00). I also spoke with my credit card dispute center during this time. They told me as long as the company was working with me, they would not put it in dispute (last time I will listen to that advice!). Ladies Workout Express must have been counting on that as the they kept telling me things would be taken care of & refunds would be issued, but that never happened.
They strung it out long enough that the credit card company said the complaint was too old to offer any assistance. I have been fighting with and being led on by Ladies Workout Express for 3 years!! It's obvious they just wanted to fraudulently take my money & not honor their own contract! The last person I spoke to at Ladies Workout Express was Barbara . She told me something could have been done had I called sooner. I told her I called as soon as the charge appeared on my credit card. Barbara did not give me he last name when I spoke with her, I asked her if her last name was ____. She seemed surprised I knew her last name. I then told her I had her name & number written on the notes I had taken when dealing with Ladies Workout Express in the past. She again said this should have been refunded, does not remember talking to me in the past, but they cannot do anything now. Barbara said, to do what I feel I have to do (file this complaint and warn others), but Ladies Workout Express will not refund the money they took from me without my permission (after the contract canceled).!
To make a long story short, Ladies Workout Express fraudulently took $156.00 of my money after the contract was legally canceled and during which time I was not allowed in the gym because I was no longer a member!!!!!!!! Since I cannot get my money back, I want others to be aware of how deceptive and dishonest Ladies Workout Express is and how Ladies Workout Express steals money from former members!!!!!
