I got duped by ASF and the state of Colorado is putting the onus on the consumer to seek out just which laws they are breaking. I got a very fast mailed response from the CO attorney general's office about 10 days after I complained that ASF could be breaking the law by charging me processing costs in their collection practices. But ASF is not stupid, because they are legally classified as a "billing agency" and not a collection agency. That is what the state told me. Can a billing agency still purchase all the member contracts of a health club chain for cents on the dollar and then collect against the signed contracts?
Now of course I am not accusing ASF of doing this, but I'd be interested to know if it's a business practice that perhaps they could institute.... if they wanted to.
But the Atty General also referred me to another code in the law that let's just say, hypothetically, another hypothetical billing agency named A-F-S International OR Maybe F-S-A International could be culpable of.
You need to start to wonder when a company assigns an employee to address consumer complaints on the Ripoff Report -- same person for the last two years from what I can tell. Chris - the lucky ASF customer service rep, answering Rip-Off entries for the last 2 years, offers rebuttal defending every possible offense by ASF. They have an answer for everything. Remember, just because a practice may not be "illegal" yet does not necessarily indicate that this practice is at the same time "lawful." Good lawyers do this dance rather gracefully and ASF has a few of them.
ASF is very savvy. They are very tough to bring down. If you know anyone in Chicago who might be tempted to join World Gym, please advise them otherwise.
