CONTRACTOR RUN-OFF WITH MONEY

Two months ago, I entered into a contract with a non-licensed contractor to fix my house. We signed a written contract and we specified what we want in the contract. I made a $2,000.00 deposit when the contract was signed.

Hector Garcia, the contractor, took the check and asked his wife to cash it at the bank. One week after the check was cashed he was arrested and put in jail for 3 weeks. He never called but he called my neighbor who he is also doing some type of remodeling for their house.

After he got out of jail he came and see me and asked me if I still want to remodel my house. I said no, and he said he will return my money in two week. Two weeks has gone by and I have not received anything from him. I called him many times, and I was told he is not available. I left a message and asked him to call back but he never respond.

I have a written contract on hand with his address, phone number, and socail security.
I have a copy of the check that he cashed with an account number I believe is his wife account number.
