I have been fighting with Moody Gardens hotel to release MY MONEY back into my bank account. We had reservations at their location in DECEMBER 2007, which I cancelled...IN DECEMBER! On January 14th they apparently decided that I wanted to rent 3???? rooms and charged my debit card...

$413.- $453.- and $281.-

YES, over $1000.00 frozen in my account...that has caused, THUS far, 4 $30.00 fees on my account and 5 $3.00 fees...and I'm sure we are not done yet!

I have talked to them on the phone 5 times now. I have left messages for the General Manager, Garvin O'Neal...no returned phone call.

The employee who I have talked to at length is only known as Trey so far. He said he had to RESEARCH my reservation or some such non-sense. I didn't HAVE a reservation in January. I had one in December, which I CANCELLED!

He said their were "very detailed" notes on my account...about my sister being snowed in... my sister LIVES WITH ME in Austin, she is TWENTY-TWO, not so little!

I told them that they may have gotten their signals crossed and written someone elses stuff on my reservation...they said that wasn't possible. I then said, "So, are you saying I'm lying? Are you calling me a liar?" The girl actually said, "Well, no...I can't say that." Like she WOULD, but she is not allowed!!!! What?????????????? Why would I make reservations for THREE rooms in JANUARY, during the WEEK of all things?...when I only needed THREE rooms during Christmas because my WHOLE family was meeting in Galveston!!!! My grandparents were only in town for the holidays, as were my husbands!!!!

I don't know what else I can do...They have my debit card account number, so they have all the power! That's SCARY!!!!!!!

I am in contact with our family attorney, she said she would step in if they chose not to refund all monies and fees associated with the conflict.

I can't really wait, I have checks bouncing, and that makes ME look bad, not MOODY GARDENS!!!!!

You Might Try

You might try two things:

First: Contact your credit card company/bank and file a dispute with them. This will force the hotel to answer the claim and show what proof they have (signed reg cards etc). If the hotel fails to answer the bank or fails to give good enough documented proof then the bank will reverse the charges for you and you get your $1000 back.

Second: Write a letter to the General Manager of the property documenting everything that happened(much as you did above). Send the letter by regestered mail and make sure that he signs for it. After you get confirmation that he signed for it, give it a day or two, then contact the GM if you haven't heard from him/her. While unlikley, it is possible that the GM doesn't know about the problem. This is also your fastest way of getting your money back.
