My 16 year old daughter asked me for a membership with Title Boxing of Lee's Summit. They explained they had a multi-year membership requirement. I explained it was for my daughter who would not reliably use her membership or be living in Lee's Summit for the latter part of the agreement and therefore I would not agree to anything other than a month-to-month agreement.

They agreed and mentioned there was a slightly higher start-up cost to cover the cost of a month-to-month agreement and the non-conforming payment method. (They said they usually required a credit-card on file.)

I paid $177 at the time of the agreement (the monthly cost was $39) or an equivalent of 4 and one-half months of payments. The amount was in a field listed as a "down-payment". There were no values written in the fields marked "total sales price" or "remaining balance to be paid to ASF".

As predicted my daughter lost interest in her membership. I received a call from ASF International for "past due" payment (which was less than 30 days past due) and informed them during the call that we would pay for the past month and the current month and that we were cancelling the membership. They said that I could not do so, and I told them I had just done so, and that their contract was with a minor and therefore not valid and hung up.

Within roughly two weeks I received a letter with a copy of the original agreement form and a letter stating that it was a "final notice" of past due debt (which wasn't true, since we were already paid in full and had cancelled), and that my "note" was in default (which I don't have a "note" with them, this wasn't a loan for cripes sake). The letter went on to say the entire balance of $1,160.75 (another false claim) is due and payable immediately and that if it wasn't paid within 9 days of receipt of the letter a collection agency may start proceedings against me.

The copy of the agreement they mailed had clearly been modified after I had filled it out. Someone scratched through "09" in the year field of the terminating date of the agreement and written in "11" instead. They also scratched through the "number of monthly payments" value of 10 and instead wrote in 34.

In the box on the form which says, "I ELECT TO PAY MY MONTHLY DUES VIA:", someone marked the box nex to "Electronic Funds Transfer (EFT) from my Bank Account or Credit Card", which as mentioned before I did not agree to, and had been receiving monthly statements instead.

Finally, and to me somewhat bizzarre, they scratched through the value in the field marked "Salesperson's Initials" and wrote in another set of initials, which were also scratched through, and then a third set of initials "KZ" were marked down.

I'll be speaking with a lawyer later today and be contacting our state's attorney general and the postmaster general (who assists with inter-state fraud). Unless the lawyer indicated otherwise, I plan to send a formal letter of cancellation and offer a payment of $50 (which is the cancellation fee for moving away from the business). I'll post on this report again later to let folks know how this goes.
