The saying of "Buyer beware" is more than factual for this bank, there fee's and how they run there system, you will be so scared to write a check let alone use your own account.

Customer service all I have to say is OMG, once again it does not exist and you are doing them a favor banking there.

When I would go to this branch it looked like a morgue no customers or even teh once there was and guess what they were not happy and I could not understand why it was always empty hmmm wonder why, well I found out today "Buyer beware"

BBVA I am not that desperate to have an account and I can sure as hell see the Feds getting involved on this as well as I smell a huge class action law suit yip HUGE,.

The Moral of the story is rip a customer off and you will eventually pay for it.

Amazing how people always seem to leave the details out that don't make them looks so good until they are called on it.

Anyways to the OP.   Anyways your issue is probably a timing issue, and nothing "illegal".  Every bank has a "Funds Availability" Policy and how they handle debits/credits.   You receive a copy of this policy and can at any time go into the bank and request one as well.

Some banks will deduct your debits(Checks/Debit Card/etc.) BEFORE they add in your credits(Deposits).   Personally I do agree that this is more unfair to the account holder, and would avoid a bank that does this.  Since there are no BBVA's around here I do not know if they have this policy or not.  But is the account holder's(YOU) responsibility to be aware of this.   

Banks also have a deposit cut off time, and this time can often be much earlier than the cut-off time for debits.  So if for example you made the deposit at 2:30PM and the deposit cut-off time was 2PM your deposit would not be counted until the next business day(yes even if it is cash).  Then if the cut-off time was 5PM for the check, the check would be deducted with the funds not being available.

But the real question in your case.  Why if YOU had the check(that is presumably written on this same account), did you not just keep the cash and not deposit the check? 

As to them moving the date of the posting of the check to when it was written, that is 100% incorrect.  If you really want to test this.  Write yourself a Check dated 45 days before the date you attempt to deposit it and see what date they use for the posting date.  You may be in for a bit of a shock with your theory.

I meant to say yes it was my account and yes there was a NSF fee that was iinvolved, what was illigal to me was the check had not been deposited, so I had the actual check in my hand, made a cash deposit and then gave the check to be deposited, BUT they went according to the check date and not the date the check when it cleared the system , so my account was in credit and should have had sufficient funds to cover this check, as well as I have proof to prove it, I do intend to hand this first over to the Feds as in Office of the Comptroller and then to a legal house as they are refusing to credit me the NSF fee, as well as I am not giving them a great review, they will have to falk out money to pay all the time invested in the NSF, bottom line they loose

You really don't say what they are doing wrong, illegally or immorally.
