I bought a male maltese from Beach Bum Kennels on January 29th. I had contacted

"Robert" (the seller) a week earlier and set up a time to view the dog Friday,

January 27th. He cancelled because he had to go to a party and rescheduled for

the next morning. Then cancelled again and said he would meet us in Tabor City

in front of the old Dodge place. It was about 6:30p.m. and there were no lights.

Robert said he didn't want to put the dog down because he didn't want him to run

off so my 8 year old daughter held him in the car. He went over the paperwork

with me since I couldn't read it in the dark and said there was a 72 hour

guarantee as long as I took the dog to a vet within 72 hours written on the

contract. However, he said I know it's impossible to get in to a vet within 72

hours so as long as you see the vet within 2 weeks I'll still honor the

guarantee. There was also a genetic defect guarantee for 2 years in the

contract. He also said the price was $350.



When I got home with the dog,

it had a limp and wouldn't bear weight on the rear leg. It's breath was

horrible. It trembled and ran from us when we put him down. I sent Robert a text

and e-mail letting him know these things. He stated the dog never had a limp

before, that it would be all right, but to let him know if the problem didn't

correct the next day.  I e-mailed Robert that the limp persisted and that I

could get the dog in to see a vet Friday 2-3-12 at 4:20pm at Elizabethtown Vet

Clinic if he wanted to meet us there so he could here what the vet had to say

and make payment arrangements for the repair of the leg.



He did not show.

He did not reply. The vet took x rays and said the dog had a genetic defect

called Calves Leggs Perthes Disease which needed surgical repair and would cost

around $650. If the surgery didn't occur, the dog would suffer gradually to the

point he would have to be put down. Also, the vet said by the condition of the

mouth (severe scaling), the dog was much older than the contract stated age of

being born April, 2011 -- which is , of course falsification of records. Lastly,

the vet agreed with me that she felt the dog had been abused.



I e-mailed

Robert to inform him of the findings and told him I would be picking up the dog

from surgery on Friday, February 10th at 3:00p.m. if he wanted to meet me there

to make the payment. I told him my daughter had already bonded with the dog and

it would be psychologically detrimental for him to take the dog back (plus I

think he would just kill the dog). He e-mailed me back reminding me of the 72

hour guarantee and that the dog didn't have a genetic defect so the 2 year

genetic guarantee was not applicable.



The contract said I paid $300, but

I paid $350. I have a receipt from the credit union where I took $360 out of the

bank 45 minutes prior to the purchase.



I think this puppy mill needs to

be investigated -- especially because Robert would not allow me to come to the

actual site but insisted that we meet somewhere. I am very worried about the

condition of the other dogs. Please advise.

I believe the seller's report is not accurate in some way

The seller is inaccurate in the following ways:

Yes, he did use his flashlight to show me and read to me the health guarantee, the dog's date of birth (which the vet said is not correct. She says the dog is much older), the parents of the dog, the vaccinations and wormings the dog has had (which the vet said the dog did not get the correct worming that kills all intestinal worms so I had to have it rechecked for worms), and the signature area. He did not shine the light onto the price of terms area which he had written in $300.00. He has since taken off the puppy for sale off the internet, but it was indeed $350, and that is how much the seller received. I have the bank receipt where I just withdrew $360 from my account 45 minutes prior to the sale. (withdrawal of funds has to be divisible by 20, so could not withdraw exactly $350)

Also on the contract, the health guarantee has a 2 year health genetic defect warranty. This dog was diagnosed by the vet with a genetic defect called Calves Leggs Perthes Disease which requires removal of the hip bone to stop the progression of the disease. The vet said it was so bad when she went in that the bone shattered. I believe this clearly defines animal neglect as well.

Robert, at the time of the sale, stated that he knew I would be unable to get the dog to a vet within 72 hours, but as long as I got the dog in within 2 weeks he would still honor the health guarantee. The night I brought the dog home and noticed the limp, I immediately called Robert. He said the dog had never had a limp which is a lie as the dog had no muscle tone in his leg and has had this problem since birth. Robert said if the problem didn't straighten out the next day to call him. Instead, I e-mailed him the next day when I discovered he was lying about the dog never having had a limp. I let him know that I had a vet appt the following Friday at 4:20 p.m. and I let him know the location and invited him to come so he could hear the vet firsthand. Robert did not show. When I got home I e-mailed him about the diagnosis, told him when the surgery was scheduled and when I would be picking up the dog so he could meet me there to make payment arrangements for the genetic defect. He did not show.

At any point any new buyer that contacts me about a puppy can read over the Testimonials that are posted on our web site at www.beachbumkennel.com ask for a list of references (from past buyers) and ask for a vet reference at any time. We have nothing to hide, nor, will we ever. Anyone that would like to see any emails that I have mention are more than welcome to contact me for them. Anyone that would like references, vet reference or any other information concerning our operation at the Kennel also may contact me as well at beachbumkennel@aol.com. Both Health Agreements are in writing to protect the Buyer as well as us the Seller, are listed in all of our ads, listed on our web site and listed in our emails so there is no misunderstandings or second guessing what you receive with a puppy. But, since this occurrence, we at Beach Bum Kennel will make sure all new buyers initial off on the Health Agreements, be more selective, ask more questions and might even start to ask for references of our buyers.

Amy emailed on Jan 26th. 2012 at 1:09 am (still have email) about wanting to know if the puppy was still available, this was the first time I had ever spoken, emailed or heard from Amy about this puppy. Not sure where a week prior is coming from.
I emailed her back on Friday after trying to contact her by phone with out luck about the puppy. She called me back, I was to get current pictures of the puppy back to her, she would let me know if she would like to come visit the puppy after seeing pictures. I emailed her to let her know I would send pictures to her on Saturday (1/28/12) due to other plans that night would not have time to get them or meet on Friday night. I emailed her on Saturday (1/28/12) due to being under the weather that I didnt think her or her daughter wanted to be around me and would get those pictures to her on Sunday. Sunday (1/29/12) 3:18pm I emailed pictures of the puppy to Amy. Also, emailed her pictures of a younger puppy too, she wasnt interested wanted the older puppy. Amy had plans on Sunday and would be later that afternoon before she could come to see the puppy, I was heading out for the afternoon but, told her I could bring the puppy to meet her once she called or was available to see the puppy.
She was coming from Whiteville and we (both parties, not just me) decided to meet in Loris, since I would be close by. She never once asked me to come to my place, it was convent for us to meet due to her schedule, not mine. She had plans that afternoon with her daughter (is why we couldnt meet until late Sunday afternoon), needed to be back home before late, etc. But, for further reference I will only meet people at my place, where the puppy is in its normal surrounding, not after normal business hours. This way I will never be questioned again about not letting them come see where the puppy lives or came from. I try to be convent for people but, as in this case it didnt pay off. We did meet in Loris at the Dodge place, where normally lights are on (its a car lot, yes now its closed, didnt know that) but, I did offer to move to another location since it was starting to get dark (6-6:15pm), I didnt feel good about the location since it wasnt lite up (not just for my safety but, hers). Amy couldnt find her flashlight in her car, so she used the flashlight on my cell phone to read over the contract and sign on it on the trunk of her car. Why would you sign a contract you as a buyer couldnt read? Didnt know what you where signing? Refused to move to another location? But, then you forgot to say, I did let you use my flashlight, so you could read and see where to sign on the Health Agreement. Question?? How did you know where to sign if you couldnt read it and I covered it with you?? At no point was Amy forced to complete the sale of the mention puppy.
The price of the puppy was listed on the internet on the ad where Amy found the puppy, was listed on the Health Agreement and was covered on the phone Friday afternoon. Why would someone pay more for a puppy and later question this? The puppy was $300.00 the younger puppy was $400, I dont have a puppy for $350.00. At no point was Amy forced to complete this sale of the mention puppy. This is why buyers will now have to initial beside the price listed on the Health Agreement for a puppy, this will be for there protection as well as ours also, to ensure this was covered.
On Sunday (1/29/12) evening about 8pm, Amy did call about the limp of the leg, we discussed the 72 hr. vet check, she was to call on Monday, set her vet check up and then contact me back to let me know how the puppy was doing. Amy never contacted me again (by phone or email,) until on Friday (2/3/12, around 7pm, I still have my email) demanding I pay for vet bills. I did email her back at 8:28 about not receiving nothing from a Licensed Veterinary and about she voided her Health Agreement. As stated on the Health Agreement dated 1/29/12 and signed by Amy (I have my copy, that I can supply, Amy has the original that she can reference back too)
The buyer has seventy-two (72) hours after the date of the purchase to have the puppy examined buy a licensed veterinarian. If the veterinarian finds anything that is life threatening wrong, this puppy will be exchanged for another puppy of the same breed, when available provided, the puppy is returned within the seventy-two (72) hour guarantee period. We will not accept the return of this puppy under any condition. Under no circumstances will we give a cash refund or accept responsibility for medical expense after this puppy leaves our possession. It is further understood and agreed that no warranty or representation has been made, with respect to this puppy, except as set forth in this agreement.
We have this in writing for the protection of the buyer as well as us. Moving forward All buyers will have to initial also beside both Health Guarantees, acknowledging they fully understand and then sign at the bottom as we always do. This will be for the protection of both parties, so everyone fully understands the set forth Health Guarantees.
At birth, of a litter of puppies, paper trails are started, health agreements are wrote (for each puppy), puppies are registered (accordingly) and records are kept. Dates of birth are very important to us and important to record keeping. All puppies are closely monitored to insure proper Inoculations and Dewormings are up to date by these records, to be able to ensure that each buyer has health records at the time of purchase.
