After teaching at Celebration Academy for three years, my contract was not renewed for 2006-2007. When I left at the end to the school year 31 May 2006, I was owed about $5600 in back pay for work already done. I received about $2200.

On 23 June 2006 I received an email saying I would not receive more pay because I had violated the "contract's non-compete clause." I will be happy to post the entire contract, which does not contain a non-compete clause. I did start a small school in order to carry on my livelihood.

Kent Nielson, Tamara Nielson, and ALtha Nielson (owners of Celebration Academy) made intimidating phone calls to families who supported me.

The Nielsons have also refused to refund money collected by them under false pretences. Several families enrolled children at the school in the belief that I, the special education teacher, would be on staff for 2006-2007.

Even assuming, for the sake of argument, that you DID violate a no-compete clause, withholding back pay is probably not a legally allowable remedy.

You could see if your state's Department of Labor offers any services to help you get your back pay. If not, you should hire an attorney to at least write a demand letter for you.
