In August of 2003 I had the polybutlyne plumbing replaced in my home as per the Cox vs Shell Oil Settlement Agreement. Nothing has been done to the damage caused to my home by the leaks from the polybutlyne plumbing. There has been extensive damage to my home in that the leaks caused the floors to warp, the foundation to crack which in turn has caused the house to settle and shift which has caused the walls to crack and the the roof to buckle.

I followed the proceedure given to me by the Consumer Plumbing Recovery Center from a Mr Bruce Tomlinson. Mr. Tomlinson kept requesting receipts for prior repairs that were completed. I sent him what I had but told him that I wasn't interested in being reimbursed for past repairs but wanted the current damage to be repaired. Reports of this damage was sent to him by contractors working for the Consumer Plumbing Recovery Center.

I was then told to file an appeal with the Office of the Ombudsman working at Consumer Plumbing Recovery Center. I do not understand how the Ombudsman and the committee working for or at Consumer Plumbing Recovery Center could represent my appeal/approve my appeal telling me that complaint without prejudice.

I was right on March 25, 2004 The Office of the Ombudsman did not approve my appeal as they felt the damage to my home did not meet the criteria of the Cox vs Shell Oil Company Settlement Agreement.

The damage to my home was caused by the leaks from the polybutlyne plumbing, I don't understand how it would not fit the criteria of the Settlement Agreement.

I am now forced to seek my own counsel or just live with my home the way it is or be forced to remortgage my home to repair damages caused by the polybutlyne plumbing.

Therefore, I would like to warn others who may be seeking relief from the Consumer Plumbing Recovery Center that full damages could not be recovered for damages done to their homes.
