Purchased On Ebay Motors 5/13/2012 A 2001 Chevrolet S10 4x4 Light Duty Truck.

(Ebay Item 320903059016  /   VIN #1GCDT19W01820)

Purchased Truck Named Herein On 5/13/2012 And Fiance Flew To Stockton, CA. Airport
To Meet Seller On 5/16/2012 To Show Proof Of Insurance And Take Possesion Of Truck
To Drive Home In Las Vegas, NV. Truck Was Driven Home To Nevada Rather Uneventfully

However Soon Thereafter Had Severe Heating Problems Which Were Never Disclosed To
Us. Before Nor During Any Part Of Transaction. (Vehicle Was Paid Via Paypal)
Went To Nevada DMV On 5/18/2012 To Transfer Title On 5/18/2012 In Which Vehicle
Had Overheated While Driving Home In Modest Nevada Temperatues Of Mid 80's.

Once We Arrived Home, My Fiance Had Contacted Seller To Possibly Gain Some Insight
To Why Vehicle Was Having Overheating Problems. Seller Offered No Reasoning Of Why
Vehicle Was Having Overheating Problems. Recently Vehicle Had Transmission Shifting
Noises And/Or Loud "Clunk" Type Noises. Since I Had Spent My Last Dollars Upon The
Purchase Of The Truck Via Ebay Motors, Vehicle Sat In Garage Until 6/2/2012 And Had
Been Carefully Driven To Auto Parts Store Then Eventually The Repair Shop Nearby.

Recommended Repairs Had Been Made, However While Driving Home, Truck Had Over-
Heated Once Again. Attempted To Contact Seller Via Cell Phone As Well As E-Mail On
The 4th When Truck Was Completed. Seller Never Acknowledged My Calls Nor E-Mails.

I Had Waited Until 6/8/2012 Until I Had Attempted To Contact Hime By Cell Phone And
Left Message As Well As E-Mailed Him Again, As By This Point I Had Retained A Product-
Liability Attorney And Informed Himself Of Such In Letter I Had Sent Him Via E-Mail.
Truck Went Right Back In The Auto Repair Shop On 6/8/2012 In Which To Repair It
Needed Several Costly Repairs, Including Parts & Labor As Well As Antifreeze/Coolant.
In Letter I Had Sent Seller On 6/8/2012 I Had Informed Him Of Repairs And Scanned
All Invoices For Parts And Labor, As Again No Response Or Acknowledgement Of
Receiving Anything From Myself Via E-Mail. Its Obvious Seller Was Merely Ignoring My
Attempts To Contact Him. I Had Offered To Resolve Matter For A Sum Of $578.99.
I Had Never Heard Back From The Seller At All.

I Had Contacted Ebay As I HadDisclosed Information Of Such To Seller. I Was Merely Attempting To Contact Seller
Only To Resolve Matter & Inform Of Myself Retaining Legal Counsul, As Any Consumer
Or "Lemon Law Rights" Had Been Clearly Violated. I Had Then Went Through The
Very Cumbersome And Aggrivating Task Of Contacting Ebay, Which Was A Complete
Waste Of Time, As The Only Thing That Was Done Upon There Part Was To Send Me
Useless Double Talk About How The Vehicle Was Not Covered Under There Own
Scrutiny. I Have Went Back And Forth With Them Upon This Matter Solving Nothing
Despite Purchasing 3 Other Vehicles Via Ebay Previously.

I Am Also A Seller On Ebay As The Individual Who I Purchased The Truck Named Herein From Was Also. The
Warrenty Or Coverage Expressed Upon Ebay Regarding Any Vehicles, Is And Should
Be Gone Over And Highly Scrutinized By Buyer, As In My Experience, I Have Had Nothing
But Problems Dealing With Ebay Motors And Forget About Getting Any Assistance From
Them, As Its Clearly A Waste Of Time.

That is true. Ebay has a gigantic wall of protection. If one of their users gets scammed ebay is protected. But coast is right about that particular policy. That pretty much clears ebay but I still think feedback shouldn't be removed. And to outlaw.. or gunslinger.. or what ever name you want to call yourself.. thats funny.

Not eBay's liability

"Lemon Law Rights Had Been Clearly Violated."

To qualify under the California Lemon Law or the federal Lemon Law, the vehicle must have suffered multiple unsuccessful repair attempts under the manufacturers factory warranty. You never claimed the vehicle is under the manufacturer's warranty so please state what Lemon Law rights have been "clearly violated."

"The Warrenty Or Coverage Expressed Upon Ebay Regarding Any Vehicles, Is And Should
Be Gone Over And Highly Scrutinized By Buyer"

You should have scrutinized the vehicle not eBay's clearly stated policy. eBay Vehicle Purchase Protection states:

Please understand that the VPP program is not an insurance policy, a solution for buyer's remorse, or a substitute for buyer diligence (i.e. pre-purchase research and inspection). Therefore, we encourage you to perform appropriate research and exercise proper care and judgment in the purchase of any vehicle.
