Ok...so after going over my cell phone bill tonight...I realized my 12 year old son had "premium text message" charges on there. I phoned Verizon and the lady told me that he subscribed to flycell.com which was a ringtone/wallpaper/RIPOFf company, and she gave me the number. I phone flycell and a man there named "Mark Nelson, or Denny Wilson" said the charges will stick as the "terms of use" say they will. The "double opt in process" is a freaking joke that a 5 year old can do!!

1. By making a purchase from Flycell that is billed to a cell phone account, you confirm you are the owner of the phone or have permission of the owner to incur these charges.
**Well I am the owner and my 12 year old did NOt have permission to incur these charges on something he does not even understand**

2. If you are not the owner of the wireless phone you intend to use for your participation in our Services, you should always obtain the permission from the owner before participating. If you are under 18 you should get parental permission and consent.
**Well if this is true then they need to be verifying some sort of credit card for someone who is 18 years or older to do this. Disney makes them verify, and all companies should be held accountable for this!!**

3. INDEMNITy

You agree to indemnify and hold harmless Flycell and its agents, employees, representatives, licensors, licensees, affiliates, parents and subsidiaries from and against any and all claims, actions, demands, causes of action and other proceedings arising from or concerning your use of the Service, including the Messaging Systems and the Downloads (collectively Claims), and to reimburse them on demand for any losses, costs, judgments, fees, fines and other expenses they incur (including reasonable attorneys fees and court costs) as a result of any Claims.
**WTF does a child know about INDEMNITy!!!! You have GOt to be kidding me?!?!?!**

I am NOt letting this rest. I saw about 25 other complaints on here from others. I want to get a lawsuit against this company and either shut them down, or make them pay for using and abusing the system to get to little kids. I don't know about you, but I am tired of getting $250 phone bills. And someone needs to be held responsible!!!!!!!

So you admit your kid did it?

AUTHOR: Rukidding - (U.S.A.)

POSTED: Friday, July 25, 2008

So you freely admit your child did it? So according to you, that also means that you dispute every phone call your child makes correct? Or are the phone calls fine but anything else they do is not? Sorry, but you gave the child the phone and an internet connection and are responsible for their actions. If they walk into a store and break something, are you also not responsible since they are 12 and you didnt tell them to break it?

I agree that the policies of many online companies need to be monitored and we need regulations regarding the internet but a class action suit is not the answer. First you will waste years until anything is taken care of. The "lawyer" will take 33-66% of any settlement so you sued for $10 and got $4 back and during the years it took the case to be settled the company made millions?

Begin with contacting the FCC or FTC and not posting on the internet to complain. If we as citizens took as much time trying to get our elected and appointed officials to do their jobs as opposed to surfing the web and complaining about everything from the anonymity of our keyboard, maybe our children wouldnt be on the internet running up our phone bills.

PS: google ripoff report and you will see where people have filed complaints about them as well so it seems anyone can get bashed on the net
