I was a victim of identity theft by a close relative. I was sued by a credit card company for $9,000. I went to court several times in regard to the matter and decided to settle with Forster and Garbus for $4,000 making payments of $100 a month.

I couldn't afford a lawyer, so  I signed the settlement.  Forster and Garbus provided me with no proof of the debt so I could pursue my relative for this money. I paid the 100 every month for 12 months paying a total of $1200. I sent in a payment after the holidays that they said they received after their ten-day grace period. They accepted the payment and sent me a letter saying they filed for a full judgment of $9,000.

I was only late that once because of the holidays. I tried for 2 hours to get in touch with someone at the office. I eventually got someone that said I would have to talk to the supervisor who never called me back. I would have never agreed to a settlement if I knew that they could get a judgment for the full amount plus more. This company has no morals. Under the settlement agreement, I only owe them $2800. Now, they are getting a judgment $9,200. The $1,200 I already paid is not included.  I have very little money, I was displaced and out of work for two weeks because of hurricane Sandy. I could barely afford the hundred a month, so now they want to garnish my paycheck for more. I could understand this if the debt belonged to me, but it didn't. I don't know what steps to take from here.

In that paperwork you signed, you agreed that you owed the money and that if you were late, the judgment would be automatically filed. There are various names for these types of judgments: Consent Judgment or Agreed Judgment are two of the most common names.  I think these types of judgments are very, very bad for the consumer because if you do pay late, ever, during the course of the repayment plan, then the entire judgment is filed against you for the full amount of the original suit without regard to any other prior agreement/settlement you made. These types of judgments are 100% for the creditor and essentially nail the consumer with not only the debt, but whatever fees, penalties and interest that was filed in the judgment suit. You found this out already, the hard way.

Do you have a police report from when the relative took your ID and ran up the charges? Maybe you can get the judgment vacated if you go back and fight it now. It might be too late because you already agreed to the judgment when you signed the settlement. At least check with a consumer attorney to see if there is some solution for you.

For others in your situation, don't sign a "consent judgment" or "Agreed Judgment" or anything similar when you are negotiating with the judgment creditor. It is not in your best interest. There is a way to settle without signing such an agreement. Call a consumer attorney to help you.
