Having trouble getting Hart Aero to refund monies owed to me. Ordered a sweetpea ultralight in March 2008. Check cashed March 30th 2008. Deliver was in 90 days according to his website posted at the time of my order. After several delays in delivery I gave up and asked Mr. Hart for a refund in full on August 8th 2008. And I have email documentation to back this up. Almost 8 weeks later, I still have no engine and no money. 4 weeks ago I emailed Mr. Hart asking where my funds were at? He replied stating he thought we had agreed on him keeping all my money until my airplane was sold, and added that if I had changed my mind he would ship my engine to me and refund the airframe balance.

After giving him the go ahead and asking for updates I have heard nothing back from him. I can assure you as soon as Mr. Hart refunds monies I will gladly update this report to refect that. Until that happens we will say Mr. Hart has in his possession $2800 advance payment for one sweetpea ultralight airframe kit. And one 24HP Honda engine purchased from Valley Engineering in Rolla, MO in the amount of $2250 and was put into his possession in July 2008.

Aircraft not complete

  Aircraft was picked up on Oct 15 2008 in a partially completed status.  What I ordered was a complete rigged airplane.   What was given to me was a welded fuselage on gear with my engine mounted, and the rudder bar installed and wing attach points tack welded on.  Complete attached tailfeathers, Wings panels that had ladder structures riveted and the ribs attached to the top of the rear spar,  ailerons incomplete, no hardware furnished, no wing struts, no plans or drawings.  And worst of all no factory support of any kind.  I have emailed Mr. Hart alot of times this year yet have only received 2 responses.   Last reply from Doug was back in April I think it was.  Said he was converting .dwg formatted plans to .jpg so he could get them emailed right away!   Still nothing.  I have been patient and tried to be reasonable with Doug but my patience is at it's end now.   Mr. Hart if you're listening.  You're word is no longer good here.  Don't bother to fill my ears with anymore of your empty promises.  I haven't the time to listen.   You have had over a year now to make good on about $300 worth of parts to me and haven't managed to fulfull your obligation.  I'll accept a full refund of $2500.00 and you can keep your aircraft.  Nothing less.

  I am writing a follow up on Mr. Hart to let others know that he hasn't fulfilled his obligation to me.  I paid him $2500 up front for a "complete airframe"  and did not receive one.  Oct 15th 2008 I drove down to Hart Aero and picked up a welded fuselage on gear, a partially completed and unrigged wing panels, and covered tailfeathers with the engine bolted down.  Some of the parts that were missing include: Wing struts, hardware, teleflex control cables, fuel tank, safety harness, and all associated plans and drawings were not provided at the time of pickup.   He agreed to have the parts to me by January 2009 which has passed.  Almost 12 months ago in fact.  He was keeping in touch with me by email until March or so then just stopped answering my calls, and ignoring all email attempts.  I have tried everything I know possible to get cooperation out of him.  I have showed him patience much leniency.  But My patience is at it's end.  Our agreement was for a covered, rigged, complete airplane.  This is not what I received.  I want a full refund for my incomplete airframe, and will settle for nothing less.

Important update!!! Airplane has arrived. Hart Aero and I reached an agreement to continue with delivery on or around Oct. 15th. Aircraft was delivered on Oct. 31 This is my final update. Mr. Hart did come through on this transaction. Everything is just fine, and I just wanted to make good on my promise to clear his company's name once things have been finalized.
