I sent debt validation request to this company one year ago and received a few copies of monthly statements from them. I asked them to provide an accounting of the supposed $3100+ debt that they say I owe. They sent an affidavit that basically says, under oath, that I owe the money. Nice intimidation tactic there guys, but these so-called affidavits are often filled with hearsay and lies. Has anyone else had a similar experience with LHR Inc.? I don't believe they have validated my debt, but they are still trying to collect on it by sending me letters in the mail. I am just getting irritated by their harrassment and would like to know what I can do. If they have not validated, this is an FDCPA violation that can be used in a court of law against them. These losers should be put in their place by people who know their rights! Don't let bottom feeders take advantage of you!

You say they sent you statments after your validation request. So is the dispute the amount of the debt or the entire debt? If it is only part of the debt what do you think you owe? Collection Agencies are allowed to continue to charge interest on the balance, but this interest has to be within the allowed amount for your state.

You say that these affidavits are often filled with lies and hearsay. So is this the case in the one you received? If you can prove that it is false(and they should have reasonably known it) you would have an instant FDCPA violation suit.

As for your Validation. A debt is generally considered validated in the following conditions.

1. Proof that the collection agency owns or has been assigned the debt. It is a very good chance that the affidavits satisfied this requirement.

2. Account statements from the original creditor. They are generally not required to provide every single statement. So it would be validated unless your dispute the amount from the statements are wrong, or you did not receive the statement for the amount you are disputing.

3. The original signed loan agrement. However, the statements and the affidavit could qualify as validation for this.

You are correct in your angry response. I worked there for 5 1/2 months. I was an excellent employee, but guess what, employees receive benefits after 6 months. I can not tell you how many people get fired for no reason, but only because they are getting close to getting benefits.This company is a scam. They literally pay pennies on the dollar for your old debt. The whole system is failed.We used to tell people if they pay off the lhr account , we would remove the original creditors trademark also. What a lie. This company is in a bit of trouble. We had to start talking from a script because of lawsuits. If the Village of Hamburg knew what they had there. They keep only the most ruthless people,people that can demand money by lying.Always go for a settlement too. Since they pay only pennies on the dollar, if the company settled for $100.00 on a $3,000 account , they would make money. Every couple of months they will send letters out, if you don't pay , just wait another couple months, the settlement always goes down. I laugh at the practices at this place. I look back and ask myself why I even wanted to work here.One last thing , one of the owners is a drug addict. He has not been around in a while. This should tell you something.
