I was lured into the San Francisco Real Estate Wealth Expo on the names of Trump, Robert Kiyosaki, and others. I listened to Marshall Sylver speak of his "Turning Point" seminar. The cost was $1495, and came with several CD packages related to the subjects to be presented at the seminar of improving one's life and finances. The verbal guarantee that Mr. Sylver confidently and convincingly presented was that if the person making the reservation was not happy after even the first day of the seminar, they could not only keep the CD's as a gift but they would receive a full refund of $1495. I thought that was a great money back guarantee, so I naively signed up.

Due to some major changes in my life, I tried to contact Sylver's company, Mind Power, three times by telephone in order to cancel the seminar reservation well ahead of time. I got a voice mail every time. Finally, after contacting my bank for a refund, the Learning Annex responded to my bank that I had signed the contract which indicated I had three days to cancel "which was in full compliance with FTC's Rule concerning Cooling-off period for Sales made at homes or at Certain other Locations."

The letter went on to state that I had already signed the contract, so it was too late to cancel any reservation or to receive any money back. They sent copies of the contract to my bank, citing Trade Regulation Rule Subchampter D, part 429. They informed my bank that any cancellation period had passed, and that it was too late for any refund. They claimed this was in full compliance with FTC law. Of course, they seemed to have forgotten to mention the money back guarantee that Marshall Sylver made: that you could cancel even after the first day of the seminar and receive a full refund and keep the CD's. I sent the CD's back, USPS confirmed, and canceled, but I have received not a penny.

It is amazing to me that the Learning Annex would use FTC law to make their argument. They effectively replaced a verbal money back guarantee made at the seminar with a written "3 day cooling off period" contract designed to protect consumers in the absence of other guarantees. I am sure this is not what legislators had in mind when this law was written!!

Your issue was with Learning Annex - not Marshall Sylver, you stated it yourself
"after attending the first day" you get your money back was HIS guarantee.

you did not attend the first day - but decided to cancel it and demand a refund

You also seem to think that is for that one particular session, You can attend any session that fits your needs, so if you could not attend the date you originally requested- you could have taken any other date.

AND you can attend Turning Point over and over again, as have I and many others.

As far as your contract is concerned, it sounds like you signed a contract and paid for Marshall's Turning Point seminar through the San Francisco Real Estate Wealth Expo...which if their policy is three days for your money back and you passed that time period, that would explain why the bank wouldn't pay you back. That is on the San Francisco Real Estate Wealth Expo, not Marshall Sylver.

I have been through Marshall's programs, and I know he stands behind his guarantee. He does state that if after the first day of attending The Turning Point you are not fully satisfied you are entitled to receive your money back and are able to keep the materials.

It sounds as though you never attended. Is that true? That would explain why you did not receive any money back. He never states that you can change your mind and he'll give you your money back. How would he run a business that way? He states that you must attend the first day, and I'm pretty confident he does this because the information that you learn is so valuable that only a moron would want their money back after the first day.

Now, I am unaware of what changes occured in your life, and quite frankly, that's your business anyway. I can tell you that Marshall holds multiple Turning Points every year, and he does that to enable every one of his students the opportunity to attend a Turning Point when it is convenient for them and their life. So you still have the opportunity to go and get the education that you were so excited for while at the Real Estate Expo. Go to his website. I'm not sure where you live, and yet since you attended the RE Expo in Cali, it's very possible you live there. I do know there is a TP coming up in Los Angeles in January.

So you definitely have the opportunity to go and get your money's worth! And you should check out SylverAlliance.com b/c now Marshall is giving his students the opportunity to earn up to 70% of his revenue of his new programs he is launching! I am already in the alliance and am very successful in it. I'd love to have someone with your ability to use the internet and you knowing what a powerful resource it is to join my team!

I wondered why people on this board were happy with customer service provided by the learning annex after filing such a legitimate complaint when they should not have had to hassle with the issue in the first place. If I would have contacted Dominick earlier I may not be having to wrangle with this issue several months after. I had contacted the producer of the materials and seminar when I wanted a refund, not LA directly. Finally I filed a claim with the bank, which apparently lost the fax pages. They reactivated the issue after I refaxed them.

After posting here, I was happy to hear that Dominick could resolve the issue. I called Dominick and he cleared the issue in under five minutes. Considering I am in the middle of a move and did not want to squabble back and forth with paperwork and faxes and explanations when I thought the issue was pretty simple, Dominick seemed like a godsend. Dominick settled everything and with a great attitude. Top tier customer service, great understading of the customer's perspective, and cleared the issue faster than it took to refax the complaint to the bank. You made my day today Dominick, thank you for the great customer service.

We wish to resolve this customer's concerns...

Regretfully, the customer did not contact our offices directly to express his concerns. We would have liked the opportunity to discuss the issue with the customer, and we are sorry that he missed a great seminar.

Under Steven's First-Day cancellation guarantee, only those customers who attend the first day of the seminar can cancel the program through a representative at the event. Unfortunately, the customer did not attend the seminar and did not comply with the three business day, NO QUESTIONS ASKED guarantee provided by The Learning Annex. Because of this, we presume the customer's bank chose to resolve the customer's chargeback dispute in our favor.

Regardless of that decision, The Learning Annex wishes to have only satisfied students. We urge this customer, who we could not identify through the limited information provided in his post, to contact us at our offices through the information provided on this website. We would be happy to facilitate the return of the materials and provide the customer with a refund of the purchase price. I will be away from my office until 8/4/06, but should the customer desire a more expedited resolution, my voice message will direct the customer to an intermediate supervisor who will assist him upon contact.
