My area where I live had a power outage that surged and had our lights, and electronics not running and lights were low and some were abnormally high. Come to find out after 3-months of waiting for my claim to be paid. Pacific Power-Field Claims Rep. Dianna Pereira wrote me a letter denying our claim for damage done to our house hold things she says due to an animal going into the substation. I called Pacific power outage department and got written proof that in fact it was not in anyway a animal. it was faulty equipment on their part. I asked the outage department to send me the letter, I have it and now all this reports with my letter, and their denial letters and outage reports are going to Better Business Bureau, Federal Trade Commission, Pacific Power-Dianna Pereira claims rep(that misrepresented claim), Pacific Power-Pat Reiten (president of Pacific Power), Oregon Public Utility Commission, and Oregon Attorney General (Oregon Department of Justice. Below is the exact happenings and the letter I wrote all of them with mailed documentation that isnt enough room on this.

Dear Dianna Pereira,

 

I have received your letter dated September 30, 2010 regarding our claim of July 6th & July 10th, 2010 both days on claim letter. At the bottom of the letter dated July 12, 2010 it states Once your claim form as been received, it will be resolved in a timely manner (usually 30 days) after the pertinent information has been gathered I also received your letter dated July 12, 2010 regarding that you received notice that we are in need of submitting a claim.

 

In regards to your letter dated September 30, 2010 beginning To investigate customer claims fairly and accurately This investigation is not accurate as you will see below, as you state further in your letter. Also stated Pacific Power has investigated your claim to determine if there was any negligence on the part of our personnel, or any faulty equipment, which may have caused your damage further more Our investigation found that an animal got into our substation equipment causing our substation fuse to blow further down: In the absence of equipment malfunction or negligence on the part of our personnel, we must respectfully decline responsibility for your damage

In your letter these findings and/or investigation are inaccurate and in fact it was due to faulty equipment.

 

My investigations with the claim I filed, after the letter dated July 12, 2010 and you received documentation of our claim. Since, I havent heard from anyone, I called and we spoke on the phone because it has taken 2-months. I called you and I was wondering why we havent heard from you or pacific power. You stated in our conversation after I gave you my name, that the paperwork is sitting on your desk and you will get to it this next week, and that there are a lot of claims for this time and I will get to it. I gave more time spanned again with no calls or information so; I called on again speaking to you. You stated Are you sure you have the right day on the claim? I said yes, dont you show the 6th and the 10th of July?  I have two dates of my claim which is July 6th & July 10th, 2010 isnt that correct? You said yes but Are you sure there arent any other dates near those dates because I dont show any outages? I said no, and I reaffirmed the dates on my calendar with my documentation that I placed and this is accurate. I said in addition, that I called on July 10th, 2010 which was a Saturday and reported the problem and reported to them that the same problem was on July 6th the same experience of electrical wattage was very dim, and some very bright, and not working at all. You said that you have an outage report for others claimed on around that date but, not the dates I claimed on the 6th & 10th of July and you continued saying even if I type in the specified date nothing comes up Plus, I need to do more research and in continuance of our conversation you mentioned That you are waiting until a employee is coming back to work because he was on vacation and this is why there is a delay You said I have to wait until he gets off his vacation.

I said ok. You said why dont you claim it on your home owners insurance I said no, I will not do this because my rates will go up and its not their fault or ours.

 

Yesterday which was 10/9/2010 at approximate our power went dim again but, not like surging on and off low and high as in July both days. I called Pacific Power and made an outage report at that time. I spoke with Noreen Employee #14098 at ,

 

I asked her if she is aware of electrical items and electronics can be damaged when not sufficient-low or high power can cause damage to them. She stated: she said yes! I asked her twice she said yes, and for further concerns or question that she will have the outage department call me with my concerns and they can give me answers to my questions. I asked her another question about outages in July that was similar and she was reading to me from her notes and she says that after my call regarding outage on 7/10/2010 that someone called me on 7/12/2010 my cell phone of xxx-xxx-xxxx about this matter of what happen. I didnt receive this call or any call from Pacific Power.

On 7/10/2010 because I keep record of all calls I have coming in. On July 30, 2010 I have a new cell number as xxx-xxx-xxxx. She said I will have outage call you about your concerns and we hung up.

 

 I received a phone call at approximately on my cell phone on 10/9/2010 From the Outage Department for Pacific Power.

 

We, discussed the investigation they did of 10/9/2010 outage and she stated it was a Bird, blew side fuse in substation. I said ok, I also asked her if she can investigate the outage that happen on 7/6 & 7/10, 2010 she said yes, this isnt a problem. She found documentation that on 7/6/2010 their was as stated in her documentation: emergency damage repair of a bad order lightning arrestor needed to be repaired due to bad equipment Then, I asked is there any other(s) dates that you show that affected my address? She says no, then, she said wait I can find that specific date of 7/10/2010 and put it in that way and she said Oh wait I have an outage on 7/10/2010 because of Deterioration or Rotting, found loose primary wire on cross arm, and repaired caused burnt off pole top. She continued to say this was a very bad problem and caused a lot of problems I said so both dates of 7/6 & 7/10, 2010 dont show any other causes? Or like today? or cause because of an animal getting into your substation equipment causing your substation fuse to blow? She said no the cause is what I told you. I said can you send me this documentation and information you just told me? She said yes, and would you classify this as a claim or a problem with your equipment? She said yes because it was in need of repair faulty, and worn. Which the documentation she sent me is clear, accurate and corresponds with my claim. In the continuing statement of sending me this information, she stated that she can send me this information via email or a letter. I have the email she sent and the letter is on its way.

 

 

On 10/10/2010 the following day, I called the number to the outage department, number provided by the letter I was sent and had them verify all again the information that was sent to me including, dates, outage numbers, and causes and all true and correct and if you also look at this letter and dates with the outage department you will find this information to be equal. I do have copies of documentation on Pacific Power letter head of this investigation that is different than Dianna Pereiras

 

In conclusion, we have a denied claim that has been misrepresented/and or inaccurate by Dianna Pereira representing Pacific Power. This claim was sent to you and received by Dianna Pereira and her investigations/facts are invalid. I am asking for our claim to be paid in a timely manner.
