Returndealz04 on Ebay - Consumer Depot ripoff Nashville Tennessee

I purchased a Nintendo DS portable game from returndealz04 on Ebay. The item description said "Brand New" and also they advertise that the sell new "Factory Sealed" for less.

This particular auction says nothing about "as-is". I paid by credit card as that is allthey accept and recieved the item. It was obviously used, scratched and missing the stylus pencil that goes with it.

They give no phone numbers and do not respond to emails. I was able to get a return authorization number from them but they give you only 7 days to get it back to them. I was not able to get it back in that time frame and I still unsure that it will be accepted as a return.
They are a power seller, selling A LOT of stuff on Ebay. By looking at their feedback, it is obvious that they do this frequently. I believe I saw at least 50 negative feedbacks all saying the same thing in the past month alone and about 400 in the last year.

When I left negative feedback they did the same to me and said I should read the description. That was dumb because the item description says, "Brand New". Ebay will not retract the negative feedback this seller left me even though it is obviously wrong. Ebay appears to be greedy, the same as the seller. They have not done a thing about them even though it is obvious they are selling used goods as new. That is illegal in Ohio.
I wrote the Tenn. Att. Gen. and got no response. It is ridiculous that these people can continue ridding off people and them leave them high and dry.
