My credit has been adversely affected by STUART ALLEN & ASSOCIATES of Tucson, AZ when they FRAUDULENTLY reported to credit bureaus that I owed their client money. There was never any judgment or valid claim to money owed.

They just said you owe us money, never offered up any proof, but this collection agency managed to get it on my credit as a negative mark, even though my attorney fought it all the way and demanded they show cause or some justification for the demand for money.

I have filed a FTC complaint against the collection agency thus far. I believe this is a violation of FDCRA, we'll see.

FDCPA and third party collectors

 Typically most collectors are uneducated, not only substanatively in schooling, but when concerning the referenced, perpetually mouthing unsupported comments they think are attributed to it as well as its substance.  Sen Bob Dole papered this law (PL 95-109) for the sole purpose and protection of DEBTORS from unscrupulous collectors and their tactics of collection; whether the debt is valid or not has NOTHING to do with it just as it has NOTHING to do with the protection of collectors.  If any protection is afforded collectors here it is the line it draws for them not to cross, which comically enough, the bulk of them do unabated.  This is where the debtor drops his own ball.

My hat's off to Mr-No-Debt Joe Collector (former Stuart Allen, or is it Allan, employee), but your former employer is but none the better than the multitude of bottom feeders I have been exposed in stead for clients, and should be held in the same contempt they bask.

Do NOT be fooled folks--READ the LAW that is there for YOUR protection, and FILE, FILE, FILE!

FDCPA

Hey there, and concerning the FDCPA--it is real and it is there.  More specifically, it is titled Public Law 95-109 (PL 95-109) and it identifies what can and can NOT be done by a bonafide collector, such as calling times, number of times allowable in a day as well as phone edicate and demeanor.  It is short, concise and to the point and should be mandantory reading for all who owe an entity.

Infractions made against this code are very inforcible and should be reported to the Debtor's states Attorney's General (AG), the AG of the state to which the collector resides and the FTC (Federal Trade Commision), all whose addresses are on-line and with most allowing on-line filable complaints.

You drop a dime on these line-crossers and YOU become their worst nightmare, by not only the paperwork your complaint initiates but for the list they become part of.  For serious infractions, acquire a hand-held dictaphone ($15-$20) with an attachable device to your phone headset for recording, then find an attorney.  Though recordings are inadmissable as evidence unless those being recording are informed prior to, it will be enough to prime a willing attorney's pump.  Funny thing here, even though I am not recording, and I inform the collector they are being recorded, they hang up never to be heard from again.  The most repeated offense is call times, i.e. collectors calling from a differing time zone outside the debtors parameter.  Get their address and their Co name as well as their's (usually bogus, but necessary for your complaint).

READ the LAW that was written to PROTECT you!

Sorry to have to correct this, but there's no such thing as the "FDCRA". It's the FDCPA. The FDCPA is a law.

First of all, there is no such thing as the "Fair Debt Collections Reporting Agency"
It simply does not exist.

The FTC governs both the FCRA and the FDCPA.
1. Fair Credit Reporting Act.
2. Fair Debt Collections Practices Act.

The FTC does NOT do enforcement on an individual basis.

Individuals MUST sue in court for damages under either of these acts.

I have to comment on this report. Stuart Allen ex employee states that the FDCRA is something she never heard of - it is the Fair Debt Collections Reporting Agency. It is an agency that people can contact to help them if they feel they are the victim of unfair debt collection practices. While this ex-employee may have been acting under the proper FDCRA guidelines I know personally this company does act out of compliance with the FDCPA - you can see what they have done to me on my own ripoffreport, which i will be writing as soon as i post this.

Very vague without much proof

Im sorry to bring this up but I found a few issues in your complaint. I am a former employee of Stuart Allan & Associates as well as a former debtor. I found no issues when dealing with my own debts, however I am more concerned about what I saw working there. First off, Brian, I think you were referring to the FDCPA aka. Fair Debt Collection Practices Act. I have never heard of a FDCRA.
Second, it sounds like you may be blaming the wrong source. When a client reports a debt to a collection agency, it is up to that agency to collect it. Now Im not sure if this was a commercial debt or a personal one, but I do know that they send out automated statements to debtors so as long as you gave them your address, you would have had your proof.
I cant help much with the shady information you've provided, but I can say that maybe you should read up on the FDCPA and also simply request documentation from Stuart Allan & Associates. It sounds like you're just angry and not really researching this thoroughly, which I encourage you to do, as anyone who ever owes a debt should do.
The FDCPA does protect debtors but it also protects third party collection agencies from people walking away from valid debts.
In my time at Stuart Allan & Associates, I saw a lot of disgruntled people walk through the doors, but generally when they were calm and professional, they walked out with what they needed as proof, if not satisified since they handled the debt. Out of any collection agency I have ever been around or had to deal with, this one keeps their paperwork in order and stays within guidelines very well.
