HERES WHAT HAPPENED.

I HAD NEXTEL FOR 10 YEARS, PAID ALWAYS, THEN THE CELL DIDNT WORK. THERE WAS A HURRICANE. CUSTOMER SERVICE WOUDLNT RESPOND. IT WENT ON AND ON. I GOT VERIZON, ANOTHER CELL PHONE, I CANCELLED NEXTEL. THEY SAID I HAD TO PAY A 199 FEE FOR CANCELLATION, ONE MONTH. I SAID THATS RIDICULOUS. THEY SUGGESTED IF I HAD OLD PHONES SEND THEM IN THEY WOULD PAY ME LIKE ALMOST 100 EACH. I HAD 3 OF THEM, SO I SEND THEM AND I NEVER HEARD FROM THEM AGAIN. ASSUMING IT WAS ALL SETTLED, EITHER WAY I SHOULD HAVE BEEN ENTITLED TO THE DEBT GO AWAY.

FAST FORWARD 3 YEARS LATER, OR SO, "SPRINT" AND AFNI PUT ON MY CREDIT REPORT THAT I OWE 290. THEY START CALING ME, I HAD A MORTGAGE I WAS CLOSING ON AND THIS LOWERED MY SCORE TO 728 FROM 780. NOW THE MORTGAGE COMPANY WANTED 3000 MORE IN CLOSING COSTS. SO I SAID FORGET IT. AND IN MEAN TIME NOBODY IS GIVING ME INFORMATION ON MY DEBT. I DONT KNOW WHAT ITS FOR. IT SAYS I JUST GOT AN ACCOUNT WITH AFNI JAN 07 AND IM IN DEBT AS OF FEB 2007 AND BEHIND, AND ITS WITH SPRINT. IT ISNT TRUE I KNOW NOTHING ABOUT SPRINT, SOMEONE TOLD ME SPRINT IS NOW NEXTEL OR SOMETHING. I DONT KNOW, NOBODY KNOWS.

ALL I KNOW IS THIS COMPANY SUX BIG TIME. I HAVE PERFECT CREDIT, ONLY EQUIFAX IS REPORTING FROM THIS COMPANY. THE OTHER 2 WON'T APPARENTLY ACCEPT THEIR REPORTS. THANK GOD SO I HAVE ONE CREDIT COMPANY LISTING ME AT 802.

BOTTOM LINE, I NEED TO SUE THEM FOR HARRASSMENT, FOR SOMETHING. THERE NEEDS TO BE A CLASS ACTION SUIT AGAINST THEM.

FDCPA( Fair Debt collection Practices Act) you can find this by going to the FTC.gov web site

just google both and you'll get information on both.

Before thinking about suing you need to know what your up against, First you need to send a Debt validation request to Afni (RRR), also in that letter you need to tell them that no more phone calls, all communication will be by US. Mail only.

Most of the time what it appears people are getting from Afni, is there own print out for validation, Until you see what they have for this debt, don't speak to them on the phone, don't admit anything, and assume that your calls are being recorded and will be used against.

Something you might want to look up is contract laws, breach or default, if nextel didn't fullful there end of the contract, then charging you a early cancellation fee, is something that shouldn't of happen.

Charges are they may have a valid contract, seeing you had it for 10 years and they may be able to produce a strong payment history, so its the contract you want to go after and there breach.

Now Afni, must place the correct date of default on your credit report, most of the time they leave this blank or use the date they got the account.

THANKS STEVE FOR THE INFO, I NEED TO KNOW WHAT THIS FCCRA THING IS AND THE OTHER FDRC OR WHATEVER YOU HAD SAID, WHAT ARE THE LAWS, WHAT ARE THE RULES? I WILLL SUE I JUST NEED YOU TO SEND THIS TO ME SO I CAN SEE IT FOR MYSELF AND SEE WHAT ITS ABOUT,
SO I CAN FILE APPROPRIATELY, I NEVER HEARD OF THIS LAW BUT IT MAKES SENSE IS IT A FEDERAL OR STATE LAW, AND IF FEDERAL DONT I NEED TO GO TO FEDERAL COURT? AND WHAT IF I SUE, AND NEXTEL COMES IN WITH A CONTRACT, DOESNT IT SAY THEY ARE ENTITLED TO ATTORNESY FEES IN COLLECTIONS? OR SHOULD I JUST SUE AFNI? DOES AFNI NOW OWN THE DEBT

Jerry,

First, the reason they [AFNI] only reported to Equifax, is that may be the only credit bureau they "subscribe" to. It has nothing to do with the other 2 refusing their reports.

AFNI are JUNK DEBT BUYERS. They buy very old accounts of this type usually for far less than a penny on the dollar.

Sprint/Nextel sold off these very old uncollectable accounts to clear the books. That's it. It is just how they do the write off of the loss, and get the tax deduction. Shareholders closely scrutinize bad debt.

Sprint/Nextel are in no way involved here, and should not be contacted.

AFNI broke the law, by "re-aging" the account as reported to Equifax. The original delinquency date with the original creditor is the date required to be reported to the credit bureaus, NOT the date they bought the account.

You have the right to sue for this violation for up to $1000 in punitive damages, PLUS actual damages and costs. This is spelled out in the FDCPA and the FCRA.

Forget CLASS ACTION lawsuits, they are very costly and time consuming, and YOU usually get NOTHING. The lawyers are the only ones to win on a class action. AND, these type of operations just fold up and pop up under another name when they lose a large lawsuit.

SUE AFNI NOW!! Don't get mad, GET PAID!!
