I started working for John Bagwell as a salesman. I was the first and had to put together a program to sellhis software. I was promised that I would be the Sales Mgr. and get an over-ride on all of the sales.

The first 8 months I made just under 100 sales( the map software sold for $650). The 3 day Seminars went for $2,000.00. We promised the Insurance Agents, and Bankers that bought the software that they could renew it the next year for half the original purchase price.

Sorry guys I argued with John when he cancelled the MAP and made you buy PAM for $950.00. I did get you MAP guys discounts with a lot of arguing. Seminar/Software Pkgs. went up to $3,000.00. I sold over 300 Units in 2004.

G-4 came out in April 2004, G-5 came out in July 2005 both with the half price promise. By the end of the year I had about 500 of you guys as customers. All of the promises that I made you I believed were true, but John had lied to me.

He cancelled G-4 and G-5 in Jan. 2005. He brought out G-5a in Dec. 2004, G-6( A-Logic) in Feb 2005 for $6300.00, and it had a lot of problems. The Securities Version came out at $8,000.00 with even more problems.

Then John started selling my job, to my customers, piece by piece, State by State. I didn't want to refuse to sell you guys the new sotware when you wanted to buy it, but my hands were tied. For 10 months I asked him to teach Jim and I how the Software worked. All we got was a half hour class one night after work.

In Jan. 2006 He had the Secretary tell me I was layed off over the phone. That's when I realized all of the promises my Friend had made me were lies! A lot of you guys were my friends, I fought for you, laughed with you, and was concerned about your success with the software that I sold you.

I've spent a lot of time researching Mr. John Wellington Bagwell in the last 8 months and I've learned a lot. Go to this address and see what the S.E.C. has to say about him www.sec.gov/litigation/admin/33-7969.htm

What he has been doing the last 3 years is a Violation of the S.E.C. Orders and he should be in Jail. Just know if you do Business with him, in my opinion, you do so at your own risk. Heed my warning friends, I felt I had to warn you.

John Bagwell has always done the right thing.

I  have used John's system for many years. I have purchased several updates. John is the greatest mind on earth concerning fixed annuities and case preparation. John is a little "out there" as far as most geniuses go - he is uncomfortable with the real world.

John has personally helped me with the software and the clients were basically astounded by the results as I was.

I am sorry to hear about the salesman's trials with John, but I have always found John to be a person I could speak with and reason with.

I have purchased items from John and asked for refunds which he gave me promptly.

As for the vindictiveness of the final comments made by the complainant, most people know that John has had his troubles and has paid the price. Has the complainant ever had problems which he has overcome?

I believe the owners of this website should talk with John and find out about him before allowing this process to continue unabated and unchecked.

I'm the daughter of Helen's (oh yea, she's a gold digger, real name is Chom Sun Yu) and step daughter of John the greedy man in the world.

1) I'm willing to kill Helen & john
2) I'm willing to go jail for the rest of my life, if you both planning to come back to Hawaii, never step your foot here or I will murder you for real.
3) Praying for them to go hell, I curse them in every single day.
4) I was homeless at once when they knew and left me out like a s**t.
5) They're bunch of sick people who don't give about the shits. They bloodsuckers, child abusive, money lovers, violence marriage, etc...you name it.

Oh yea, I shoulda I coulda I woulda have listen to my gut, I rejected your letter (john wrote the letter-not helen, cuz her english sux) You shouldn't look for me in the first place.

To Hawaii,

Fact 1. I was a customer of John Bagwell. The first time that I talked to him he told me about his issue with the SEC. Not exactly what you would expect from someone out to do wrong.

Fact 2. Bagwells issue with the SEC which is in public record was an administrative issue (which usually is not criminal or affecting his customers.) relating to reimbursing his partner, nothing to do with viaticals.

Fact 3. If John Bagwell had actually done something wrong related to viaticals he probably would have been crosswise of the insurance commision, not the SEC with the exception being if he was setting up or selling a product that was not a security while in the capacity of a securities rep. In this case he probably would have seen a much larger fine and at least minimal if not major jail time. The SEC while ignoring our financial institutions misdeeds love to go after individuals like Joh and throw the book at them.

Fact 4. Viaticals are a legitimate investment, BUT like what you are seeing in the stock market now are very risky. This means that they can just as easily go bad as to show a return. That also means that in this day and age the very people who demand a return greater than a fixed guarantee (like a fixed annuity) which in turn increases the risk, will turn around and sue anyone that they can when the investment goes south, which will happen sometime and they know that.

Fact 5. Viaticals were the going thing at one time in investment circles until everyone figured out that they too easily went south. Many a good advisor initially thought that they were a good way to increase returns. The problem was that we are living longer and medicines that keep people alive seem to be working better which in turn makes a viatical more and more risky. A lot of the people who get involved in these things basically want you to take there money and magically come up with a way to give them 10%+ return annually and don't want to be bothered with the details. They even get annoyed when you try to explain it to them, put it in writing, and have them sign it while giving them a copy. However, they turn on you real quickly when it doesn't live up to their expectations based on self imposed ignorance and an unwillingness to take the bad with the good.

Fact 6. Viaticals, like many unique investment can easily be a ripoff. However, there are about 8 easy steps to make sure that you are in a legitimate investment. Back when you say this might have happened you could find this out with minimal investigation. Now, you can find it if you type "Viatical investment" on Google.

Fact 7. If indeed the Viatical had been a ponzi scheme it would also have involved federal agencies, most likely the FBI. Again, John would have been easy pickings for them if this had been the case.

FACT 8. Let me be clear. I described John as a grump at times. He could also be personable at times. Most of all, he always tried to help me when he didn't have to. AND, he always answered my questions about him, his business and his product openly and honestly. He allowed his people the leeway to help out. He gave me much more sound, honest advice than I ever received from any other organization that I ever dealt with. On top of that the issue of honesty and caring for the customers well-being came up, initiated by him, in almost every conversation we had. It was that important to him.

We have enough issues in this country with everything being mixed together to paint a wrong picture. I don't know what went on in Kalispell, Hawaii, or anywhere else. I do know what my dealings with John were like. I also know what the dealings that some other agents had with John were like. I know enough about the legal side of Insurance sales and securities to know that what is being implied by the mis matching of facts to paint a very distorted picture that doesn't match the legal environment that John worked in. I also know that when we start to put the facts together in proper context it paints a hugely different picture of John than what is being said here.

If this is THE John W. Bagwell that used to live in Hawaii, He fled Hawaii after being investigated by the SEC for a ponzi scheme-like Viatical investment. A lot of people lost a LOT of money. I believe he was fined, and many people today are still waiting to get their money back.

I am a former insurance agent/producer who purchased the product spoken of here. I have dealt with Steve, John, and a secretary whose name I can't remember. There is a little truth to what the complainant says and a lot of untruth. For the record, my insurance business failed and I still owe a lot of people money that I borrowed to get this business going. The failure of my business had nothing to do with John Bagwell or his product but had everything to do with my inability to strongarm people into using this sensible approach over what was popular at the time of obtaining larger gains in the stock market. The stock market/greed approach ultimately failed most of my prospective customers but that is another issue.

Mr Bagwell was selling software that helped an agent calculate a conservative way to enable a retiree to have a dependable income and lower tax liability with the use of annuity products that were stacked out to create the maximum amount of income of a longer period of time. It also provided real time-real case illustrations that was a wonderful selling tool to the retirement sect. It laid out in one picture the whole plan in a way that anyone could understand. Along with his software there were accompanying forms, marketing tools, marketing advice, targeting advice, business recommendations, along with a myriad of other advice that would help a new agent avoid the pitfalls of spending money on things that you don't need. All of this was for 1 low price. Others in the same industry were marketing each of these individual items for more than the total cost of this PLUS to get them you had to attend a useless 2 day seminar that would cost even more.

Steve was a typical salesman, he was nicer than some, but a little vague at times. I am not sure that he understood the product well but only he knows for sure. I dealt with him twice and then he tended to be unavailable.

John was a little blunt bordering on rude and a little moody. However, I spoke to him numerous times before and after I bought the product and he was always straightforward about the kind of people he was orienting his product for and his desire for the agents using the product to be very concerned about the welfare of their customers. As I have found after being in this business, this is not the case many times. My only complaints were not the issue of licensing (which he and his secretary made abundantly clear)but the issues of price/newer products and time to resolve some minor issues.

My best friend and I bought this product and both of us were under the impression that it would continue with minor updates with renewals being half price. John came out with newer versions the same year we bought his original version. The newer versions were twice the price of the old version which is 4 times what our renewal would have been. When we complained about this John heavily discounted our purchasing price and we were content with this resolution. The truth is that both versions were probably underpriced, especially compared to what little else there was on the market and the value added products that John threw into the package were worth even more. Did we get mislead some? Maybe by ommision BUT John who is not a person who gives in lightly, immediately tried to make it right. The only other complaint we had was when we did purchase the second software it took almost 2 months from the time we paid for it to recieve it, then it took another couple of weeks to get the password to work. I think that was mostly an issue related to John making sure the product was ready for market and the fact that he runs a very small operation which helps keep the price down. During this time we dealt weekly with his secretary who was very nice, honest, and upfront about the progress on the product. I know she dealt with a lot of impatient people but she never lost her cool, good cheer etc. As a matter of fact when we went to install the product it revealed two problems with my OS software, one of which was common, one that wasn't. She spent a lot of time helping us resolve those issues that weren't not her problem or responsibility. I probably recieved two grand worth of computer service that cost me nothing.

I can't speak to the personal issues that were brought up about John or Steve. Steve was nice but unavailable. John was cranky, doesn't take a lot of BS, and would just as soon not sell you anything if he doesn't like you. But this was one customers experience.

I fired Steve Melby in 2006. I wish I knew of this report sooner. I create "recovery planning software" so people will not run out of money, solve peoples monthly income problems, and make certain investments used in the solutions I create are conservative. But unfortunately, my philosophy of trying to get insurance agents, stock brokers, and marketing organizations falls on deaf ears. Agents just want to sell for the sake of high commissions and not best interest of the public.

I keep making better, and more advanced software each year. I LEASE the software annually...which must be disclosed by the salesman, since this in "EULA" (a document that each agent must sign, and click on before loading the software). Yet, Mr. Steve Melby, who I fired, did not tell the agents the truth concerning this issue. Agents do not own my software...it is leased to them. Since I cannot sell million dollar copyrights & patents to agents...I lease it to them. I have worked for decades trying to make sure that the public does not end-up like so many people do when they hire an agent, stock broker, or planner....which is they lose money. And the most important point to investing; is the return of the original investment principal...which I design into all my software.

By creating new and more advanced forms of software each year, it costs more money for these software programs. Each agent has a lease of 12 months...and I do not have to force them into renewing these licenses for these software programs (nor do I have sell a product to anyone, I no longer wish to sell that product to). So Mr. Steve Melby's statements are false.

In addition, in around 1987 I created a mutual fund (a total disaster for me), I had a partner who I borrowed money from (who was a share owner of the fund) to use that money to buy a wedding ring...and when it came time to stop the fund (since I could not make a profit)...each public shareholder received their money back plus 54% (approx.) Mutual funds have a procedure, which two third parties (called shareholder services & custodial services...a bank) that take care of all shareholders money for shareholders. No one has access to anyones money. And this was the case with my mutual fund everyone got their money back (except for my partner who also invested the initial starting capital to start the fund to the SEC). And since, this was the case I was fined $10,000 by the SEC and I WAS NOT CHARGED WITH ACTUALLY COMMITTING ANY VIOLATION at all...but was fined $10,000 as an administrative order for borrowing money from my partner, and not paying off business liabilities first. I actually, came in third place in performance for all mutual funds traded in the U.S. over several months. So Mr. Melby does not know what he is talking about...plus this is leagally...slander!

Mr. Melby is not an educated man and I suspect he could not get another job anywhere else...thus he placed this comment on this webpage (which is a violation of his Non-Disclosure Agreement with me).

Put this aside for a moment. Why did I fire him? He did not sell any software for 3 months straight, while a distributor I hired sold 30 software systems in one month. So, why should I keep Mr. Steve Melby? I gave him every chance I could...but I had to lay him off for non-performance...and I gave him vacation pay.

When I cleaned his office out (which was filthy), I checked his computer (which he used since 2003)...and I found numerous pictures of the worst kind imaginable. I had my IT support copy these disturbing photgraphs and put this CD it into his termination file...which is truly sad.

I am sorry, that such a person bothered to write about me. I am a nice person, and my goal is to make certain all investors do not get "stung" by the market, bad advice, or get sold the stardard products (for high commission) by "knucklehaed" agents...by implementing software I designed to make certain that regardless, the public will recover their original investment principal, plus interest!
