Privacy Guard is an associated company of Bank of America. They have been charging my account USD 11.99 per month for the last year. I was not diligent enough to follow up on these charges until now.

I called Privacy Gaurd 877-488-0086 and spoke to a lady who claimed that I had signed up for this by returing a BOA offer for a free credit report. I recall doing this, but the form did not indicate that I would be signed up to charge my account USD 11.99 per month . They then tried to sell me all the benefits they provided. I insisted on cancelling and requested a full refund. They refused the full refund. I then spoke to Chris the supervisor who was aggressive and claim they would under no circumstances give me a refund.

Mailed Bank of America with the above and this was their response.

Called the number 1.800.432.1000 to file a dispute. They again gave me all the benefits and explain that I had signed up for the service when I activated by new debit card. In the maze of telephone activation system there apparently was an option which I had chosen which then enrolled me in the scheme.

This story is different that what Privacy Guard gave me. They almost refused to file a dispute and offered to call Privacy Guard to cancel my membership.

I refused and insisted it was my right to file the dispute. I can unfortunately only dispute the last 60 days transactions in terms of Federal regulation E. I went ahead with the dispute as I figured I would get a dispute number.

I was then told I would receive documentation of the dispute in the mail and I need to complete and return to then. They then notified me that they would reverse the last two months charges and if I did not return the correct documents they would reverse the credit.

We see how this pans out.

reading the fine print

AUTHOR: Melody - (U.S.A.)

Just a reminder that on the back of most bank statements and credit card statements they tell you you must dispute errors within a certain time frame 45-60 days. And the dispute must be in writing usually at a different address.

Most of these companies that charge for credit monitoring, additional services, will refund one months payments if you call right away. If you wait to call they will say it was on your statement and by not disputing it right away you are agreeing to their terms.

Always read your statements and balance accounts in a timely manner. In addition to calling dispute in writing and send it certified return reciept

That being said you still need to file a complaint with the FTC. If enough people file a complaint and say it is deceptive the FTC usually investagates. It may take a year or two but it is worth it.

All credit companies have this

People never want to read the fine print, alot of credit companies offer this offer. I activated a card recently on the phone with another company I always wait for the recording to say goodbye before I hang up if you don't then you don't get the chance to opt out of any programs like credit card insurance, credit monitoring. One card I activated had five different programs attached to it. When you receive a credit card or check card read all the pieces of paper that come with it and you will see that if you don't call to cancel you are in usally a 60 day free trial and then they will chrge that is why I always activate cards over the phone because after activation you are giving the option to opt out of the offers and when the recording says goodbye then I know it is safe to hang up.

Also, keep in mind....

even if you do return the correct paperwork, they could reverse the credit if they deny the disbute. I think they have up to 30 days after receiving the paperwork to complete the investigation.

I suspect though, that BOA will probably deny the disbuted charges since it seems you had in fact authorized them (by mailing or activating whatever the requirement was). Another example of why someone should read everything presented to them.

Good luck.
