I am disappointed with the way Wachoiva handles errors. I can make a small error, or have a situation with a merchant, and Wachovia manipulates the 
incoming transactions to benefit the bank financially by obtaining NSF Fee's. My example is as such:

Currently my account is overdrawn $569.00. Out of this amount my error is appx $108.00. I am currently on medical leave for having major surgery on December 4,
2009, my income is reduced right now because of my disability. The reason my account is overdrawn is because I have one creditor that I usually walk in their
payment each month Advance America $170.00. Because of my surgery status and inability to leave my home for six weeks, I contacted my creditor and asked them
if they could EFT the payment on the due date December 23, 2009. Unfortunately, the creditor misunderstood my request and immediately EFT the payment. The
payment presented for posting on the 21st of December. At the time it was presented, I had many small debit holds pending on previous purchases. If not
for this EFT error, I had sufficient funds to cover all these small items. When the EFT for $170.00 presented early, the bank deducted the amount first, and
disregarded those already on hold and submitted prior to the presentation of this EFT. By doing this, it appears that the bank manipulated the account by
disregarding the date of this transaction and those that were authorized prior to its presentation. The manipulation of this situation created massive amounts
of NSF Fee's.
I contacted the bank and after wrestling through numerous emails, they agreed to only refunding half of the fee's on the 21st of December. Unfortunately, due to 
my limited income and the severe amount of NSF fee's refunding half did not afford me the ability to rectify the account. On the 21st of December it was
apparent the one EFT created the problem and taking it into consideration prior to all my hold items that were already approved prior to this EFT presenting
itself was the majority of the issue and not my EFT. I did not think it was fair or justified to charge me for the banks manipulation of my funds. I
immediately contacted the District Manager. He did not respond to me immediately and overnight on December 22nd, I woke up to seeing half the
fee's refunded as originally promised however they were taken right back out because the items on hold that already had nsf charges accounted for, cleared
and they charged me NSF's again. How can you promise to return 1/2 nsf fees, and then turn right back around and charge nsf fee's for items on hold again?
I sent a second email to my Houge urging his response as this situation worsened. Finally, he waits until the close of the business day Christmas eve
and sends me an email stating that he will not help me because of a history of nsf refunds!
This is an isolate incident sir, and any previous negotiations between me and the bank were justified, and I don't feel that answer is relevant to this
situation. I tried to respond to the district manager and he had an automatic message that
he's out of the office until January 2nd. So basically, he waited my complaint out prior to his leaving the office on Vacation and now I'm without assistance.
My Bank representatives "Do Not Have The Authority" to refund NSF Fee's. I am out of medical pay and depend on my Child Support of $700.00 expected to
post direct deposit on January 1st. The bank is going to take basically this entire amount if this is not rectified.
I request a refund of all nsf fee's in this case do to the manipulation of my account, and the ignorance to my problem at hand. In return, I will deposit my
original error amount of appx $108.00, and close my account once my Child support post and I can remove these funds and close the account permanently.

In Closure, I feel that I have been extremely patient through the years with these mergers and policy changes without being notified that my original bank
agreement and policies changed, I feel the bank should return the patience and understand that manipulation of funds is not fair to its customers.

I would really appreciate your attention in this matter preferably prior the first of January when my Child Support will post. Thank you
in advance for your attention and courteously in this matter.

Wells Fargo ordered to payout more than 200 million in damages.

You should be aware that this bank lost a massive law suit in California regarding this activity.  The judiciary in California ordered Wells Fargo Thief Bank to pay out 200+ million dollars for doing EXACTLY what you described in your report.

I suggest you look into that class action lawsuit to see if you qualify to receive a part of the proceeds.

DEAR MR. IRVINE,
Its obvious you work for Wachovia because you only read between the lines to benefit the perfect explanation for Consumer Fraud.
FACT IS~It is not acceptable for Wachovia to manipulate any account. When Advance America presented its debit, the funds were already committed to debit card purchases that were already authorized and on hold as well as deducted from my register. Instead of paying the transactions presented prior to this transaction, they deducted this transaction first because it was the highest debit and so that all little transactions nsf creating the most fees. When Advance America presented itself for payment, it was last to come in and should have been the only to nsf. I have contacted Advance America and they have apologized for their error and will refund one nsf fee, the only one they should be responsible for. But they too can not justify paying for numerous nsf fee's when their debit is dated after all the rest that presented for payment prior to theirs. You can not tell me that its appropriate to manipulate transactions from high to low to obtain the most nsf charges, and out of date presentation order. If it is appropriate, then why is there a Federal Government Class Action Law Suite in Motion against Wachovia for the same thing? Perhaps you should pay more attention to detail or mind your own business?

I didn't see this report until I responded to your other report and I think I see the problem.  It is interesting how your "mistake" between the time you wrote the two reports increased from $80 to $108. 

Unfortunately, the creditor misunderstood my request and immediately EFT the payment.

- This is NOT the fault of the bank, it is an error from Advance America.  Why are you holding the bank responsible?   Yes in the past banks may have realized it was an error and refunded any fees.  Unfortunately they had so many people taking advantage of the system, that they had to stop it.  Why are you not going after Advance America for the fees that they caused you.  If you should write any reports at all it should be on Advance America, just look at what they are charging you.   For future references, places like this will never delay a payment.  Which is why I don't really think it was an "error" on Advance America's part, but probably intentional.

Basically it does not matter how a bank processes transactions if you have enough money available to handle all of your debits.  In the way you wrote this report it appears that you would have overdrawn anyways.  In the two day period between the 21st and 23rd you did not state you made(or would have made) any deposits that would have been able to cover the EFT you requested.  If this is the case, it also appears that you may have known how the bank post transactions and tried to delay the EFT long enough to hope that the other debits would post. 

You bank account is not a loan.  So if you are ever in a situation where you need to make a payment, if that would put you into an overdraft you have to make a decision. That is to make the payment, let the bank cover the overdraft and pay ALL the associated fees.  Or not make the payment and deal with the effects of that from the company you are not paying.  Of course I think you know what you would have had to deal with if you didn't make the payment to the Cash Advance company.

The other confusing thing is what in the world does Best Buy have to do with this report?  Or do I need to find a 3rd report that gives even more detail.
