On 3/23/12 I bought a 2002 Buick Rendezvous with approx 75,000 miles from Bradley Chevrolet (Hubler Group).  Test drove the car, received an inspection report from the dealership, and also have a voicemail from the salesperson that the vehicle just has some minor asthetic issues, rather than any mechanical issues.  The car was bought for my pregnant fiancee for her and our future baby to ride in.  The dealership knew this when I was buying the car.

The next day when driving in the car it starts jerking & when hitting the gas pedal, then it got stronger, then we began hearing a rattling noise that started getting stronger and stronger.  I took the car to a repair shop who diagnosed the vehicle with a transmission issue.  I also took it into another repair shop for a 2nd opinion, who did a thorough written estimate and concluded the same.  I contacted the dealership on 3/24/12 within 24 hours & again on 3/26/12, but they refused to take the car back & refund the money or fix the defective transmission.  I talked to the manager & gm, corporate didn't return my call.  I understand that I purchased the vehicle "As is" understanding that there's no warranty & I'm not disputing that fact.

My complaint is due to the fact that - the inspection report that Bradley Chevrolet provided me was a misrepresentation of the condition of the vehicle.  I relied on that report in order to make the
buying decision + the voicemail saved on my phone from the salesperson stating that the car just has minor asthetic issues, rather than any mechanical issues.  After speaking with several mechanics & having an estimate done, I was advised that there's no way that the car
dealership could have not known that the vehicle had a defective transmission, prior to selling it to us.  The mechanic that did the last inspection / estimate stated that he would be willing to testify as well.

I really feel that me & my family were taken advantage of.  This suv was bought for my pregnant fiancee - for her and my newborn baby girl to ride in safely.  Instead of this, it has since caused us very much stress, time off work, and financial strain.  I ended up spending close to $3,000 to fix the transmission.  Also, just because the car was sold as is, does not mean that the dealership would be allowed to misrepresent the inspection / condition of the vehicle,this may also fall under possible fraud / deceptive practices.

Please help us, as this car dealership really put us in a bad position and we don't want them to do this to many other customers for years to come.  I welcome contact from media, law firms, state / government agencies, & anybody else that may be able to help.

Thank you very much for the advice Adam & also Robert.  I had 2 certified mechanics / repair shops look at the car when they diagnosed it with a bad transmission.  Car was bought 3/23/12 & I had repair shops look at it on 3/24/12 & 3/26/12. 
I ended up having the transmission replaced about a month ago, which had a bad transfer case as well, mass air flow meter, along with other small things.  Spent close to $3,000.  The other day, radio stopped working and also have noise coming from the rear differential.  Interesting to have this many problems with a car that only has approx 75,000 miles.
I already filed a BBB complaint & secretary of state complaint.  Recently received letter from secretary of state advising that I need to refile this complaint with the IN Attorney General.  Talked to an attorney, who did feel that there is definitely a case against Bradley Chevrolet on misrepresentation, deceptive practices, etc. but wouldn't take the case on strictly a contingency basis.  I plan on looking for an attorney that will work on contingency.  I also plan on researching the Lemon law to see if it also qualifies under that. 
Another interesting twist to this story.  As I get the car back from having the transmission fixed, I receive a QCertified Limited Powertrain Warranty for 2 years or 100,000 miles.  Warranty stated that its active for the vehicle and has been active since the purchase date.  So, it seems that the dealership  went ahead & gave a warranty to avoid having legal problems.  I went ahead & filed a claim with the QCertified Warranty division, then about 10 days later the dealership cancels it.  I still have proof of the warranty that was sent to me.  This is yet another shady action taken by Bradley Chevrolet, that appears fraudulent.  Something else that I will need to bring up when I talk to the next attorney.

1) You bought the car in desperation that you needed a car because your girlfriend was having a baby and you needed transportation, meaning that you needed a vehicle under duress
2) the Dealership ensured you that was in good condition and was checked by their mechanic it is not very difficult to notice a major transmission issue. Clearly you notified them within 24 hours of buying the vehicle.
3) You can take them to small claims court and claim that they targeted you because your a young adult and that they have committed fraud they told you their mechanic looked at the car. If there was a minor issue then they can claim that their mechanic cant be perfect but this is a major repair which you noticed as soon as you drove the car off the lot.
4) File a BBB complaint against them. Your not a mechanic and you took their word in good faith that the car was sound because they had it checked by a mechanic and told you the car was sound. The dealership acted in bad faith and committed fraud and collision and this has caused you emotional distress. That they would sell a kid a car that doesn't work claiming it does then you tell them within 24 hours that it has major issues and they were not willing to give you another car. What slime balls
Bob Marley once said stand up for your rights, depending on what state you live in you might also make a complaint through the attorney general's office.

Good luck and when you file your BBB complaint other customers look at that before they buy a vehicle even if they are not a company listed with BBB they will still respond to your complaint. If 2 mechanics looked at your car for 5 minutes and said there was severe issues with the trany then you know that they had no mechanic look at it. Was your mechanic certified?

Here is your problem

You bought the car As-Is.  This means that anything that goes wrong is YOUR responsibility.

To have any claims of "misrepresentation" you would have to prove that they knew it was bad.  So even if the mechanic knew the transmission was bad, you would then have to prove that they told the salesman this fact and the salesman then specifically hid this from you when you asked about any issues.  You would then of course have to prove that the mechanic knew it was bad in the first place.  As you see that is going to be a tough hill to climb. 

As for the inspection report, most of the time the "inspection reports" are items they can get to easily.  So what was inspected is going to be the biggest question.  For example, if you have a brake problem, if the inspection report says that the brake lights worked, that isn't going to do you much good.  The same goes for the Transmission, if the issue would only be found if they tear it down and they did nothing more than a "fluid check" that came out okay, you are going to have a tough time to prove that they knew there were problems.    Of course if the inspection report covers the specific item that was bad and it says it was good you may have a case.

No I am not a lawyer, but this is most likely the same thing that they will tell you.  It is all going to come down to what you can prove.

This is why you ALWAYS must get an independent mechanic to look over the car before you buy it.  If your dealer refuses to allow this..that is all you should need to know about the condition of the car.

Thank you for the words of wisdom Brian.  This is the first time in our life that when buying a used vehicle, something like this happened.  I made a mistake by putting too much trust in a big dealership (Hubler) & shouldn't have done that.  Just like other mistakes in life, I'll chalk it up as a learning experience. 

As far as the car being bought for my fiancee who was pregnant at the time & has since given birth to our beautiful baby girl, that is the whole truth & nothing but the truth.  I wasn't trying to play any sympathy cards, I completely understand that it doesn't help my case.  The reason why I mentioned it & even went thru with filing numerous complaints is because this matter is very personal to me & dear to my heart. 

We are good, positive people and are not used to being taken advantage of.  We don't want to see car dealerships doing the same thing to other people for years to come and want to bring this issue to light.  I would like to hear from some attorneys on this matter, as I know that there are possible violations such as: misrepresentation of the car's condition / undisclosed major mechanical problems, deceptive practices, amongst others.

You made one of the classic blunders of purchasing a used vehicle, you failed to get it checked out by a mechanic before you purchased it.  Why on earth did you trust the dealership's inspection report?  Those things aren't worth the paper they are printed on.  If the dealership won't let you take it to a mechanic to be checked out, then that's a dealership you don't want to do business with.  As for what the last mechanic will testify to, totally irrelevant.  That's just his opinion, it still proves nothing.  You purchased the vehicle "as is" and now you are stuck with it.

As an aside, please stop trotting out the pregnant fiancee sympathy card.  It has nothing to do with the problem at hand and makes your report a little less credible.
