In May 2006, I purchased a 2000 Nissan Maxima. At the time of the purchase, I also included the "extended warranty" with my purchase to the tune of $1664.00.

On October 2, 2006, I noticed the oil light come on as I was going to work. When I went out to go to the parts store to get oil, my vehicle completely broke down and would not start. After a good samaratan stopped by and poured oil into the engine of my car, all of the oil immediately spilled onto the ground. He looked under my vehicle to find that I did not have an "oil plug" in the oil pan, that my plug had come out of the oil pan completely which made all of the oil drain out of the engine.

I called Carmax to report the problem, and they made an appointment for Wednesday, October 4. It has taken since that time until this past Friday, October 20, for whoever they sent the vehicle to for repair to tear the engine completely down. I was told for three weeks that "AON" (the name of the extended warranty company) would send an investigator to the repair shop to assess the damages and make the determination about repairs to my vehicle. They asked when I had changed the oil last, and I explained to them that I hadn't since I purchased the vehicle. The investigator made the determination that they were not going to cover the repairs because the oil had not been changed in 8100 miles.

The last oil change would have been made by Carmax and either the oil plug was not tightened properly or it was defective to have come out of the oil pan. The warranty company refuses to pay for repairs because it will involve rebuilding the engine and cost in the neighborhood of $3000-$4000.

I was told on October 20, that they would definately not cover the repairs. I asked to speak to the investigator, they did not know who that person was, I asked to speak to a supervisor, they said my only recourse was that I would receive their decision in the mail and that the letter would explain how I could appeal their decision.

I have left a message for an attorney, I plan to have AON put out of business-my ultimate goal is to anialate Carmax Maxcare. They will take the money and run, and never intend to carry out their obligation. I am re-contacting the Better Business Bureau and the Office of Consumer Affairs. If needed, I shall go to my congressman, this type of treatment is outrageous!

With the previous poster that most 3rd party warranties are junk. Particularly at the outrageous prices they charge. If you can afford $1664 for a junk warranty, it would be better spent buying a better car.

On the other hand, even factory warranties require that you perform the required maintenance on the vehicle. 8100 miles without an oil change is neglect, plain and simple. If the original poster had the oil changed at the proper intervals, chances are that this problem would never have occurred, since the person changing the oil would have removed and retorqued the oil plug as part of the procedure. Much as I despise the way these 3rd party warranty companies squirm out of valid claims, that does not appear to be the case here.

Hillary, good luck putting AON out of business. I doubt you will get satisfaction from the BBB or even your congressman. You are clearly in the wrong on this one.

Well sortof...AON is not owned by carmax they are an underwriter for the warranty I fail to believe that carmax would reimburse them for any repairs done to the car under the warranty. That seems ludicrous. So then what the point of the premium you pay?

I had same car but a year newer. They pulled the same BS on me and told me I had to pay for teardown etc etc. I cant stress this enought....AFTERMARKET WARRANTYS ARE GARBAGE! UNLESS the warranty is issued by the manufacturer of the vehicle they are useless. They will pay smaller claims BUT when the claims come close to or exceed your premium FORGET IT!

I hoped you cancelled the warranty and got the premium back and then dumpeed the car!

Keeping your extended warranty valid

If you look at the page that shows that MaxCare covers (http://www.carmax.com/enUS/maxcare-esp-pop/default.html) it states "Remember to bring your care in for maintenance on a regular basis to keep your extended service plan valid."

This means, if you wait 8,100 miles for an oil change that should be one ever 3,000 miles with convention oil or 6,000 miles with synthetic oil, your $1,664 extended service plan is no long valid. Whether it was their fault or not, if you don't follow your terms of the contract you can't expect them to follow theirs. Protect yourself before you put the blame on someone else. If you had taken your vehicle in at 3,000 miles and again at 6,000 miles, they probably would have noticed the loose oil plug (since they would have to remove it to do the oil change), and it would have been properly tightened afterwards. If it did fall out later on and cause your engine to need to be rebuilt, they would be responsible and have covered your repairs.

Trying to put a company out of business that the work is contract out to is a bit absurd. They go by what CarMax tells them to do. Generally what happens is a company like AON will fix your vehicle and CarMax will re-imburse them for the repairs. If AON fixes is when your extended service plan is no longer valid, they most likely will not be re-imbursed for the time and money spent fixing your vehicle.
