On January 27, 2012. I purchases a 24 month, unlimited mileage warranty for $1,099 with Cars Protection Plus for a 2002 Chevrolet Impala. The 2002 Chevrolet Impala was repossessed by Bernie Caps auto sales, of Old Forge, PA in May of 2012. In January of 2013, I contacted Cars Protection Plus, inquiring about a refund on the said warranty. I was told 'since there was a paid claim, I could not get a refund'. I never made a claim on the 2002 Chevrolet Impala! On September 28th, 2012 there was paid claim to Bernie Caps auto sales of Old Forge, Pennsylvania (which happens to be the lienholder) in the amount of $761.76 for a fuel pump, and a rtf wheel bridge. I did not place the claim on the Chevrolet impala on September 28th 2012. The car was repossessed in May of 2012, and I have at not been in possession of the impala since May of 2012. I verified I was the only person on the contract with Cars Protection Plus, therefore my name was forged on the claim on 9/28/12 for the fuel pump, and rtf wheel bridge. I requested a copy of the invoice from September 28th, of 2012 so I can report the forgery to the Attorney General's office. Attorney David Regoli of Cars Protection Plus has refused multiple times to release a copy of the invoice from September 28th, 2012. I am no longer requesting a refund from Cars Protection Plus. I now have a copy of the forged invoice. Why was cars protection plus trying to cover up a crime? Called the district attorney and as soon as I mentioned the name Cars protection plus, I was forwarded to the auto theft task force.

And they forged my signature on a Car's Protection Plus invoice.
My question is do you still sell policies through Bernie Caps Auto Sales?

Just by David Regoli Rebuttals and the cars protection plus claims procedure (which can be found online). It is clear, a felony has been committed against me. I am asking for a full refund. I understand that a portion is usually refunded to the dealer, but since there is obviously of shady dealings between C.A.R.S and the used car dealership. I feel I have enough information to contact the Attorney Generals office and the DAs office in the respective county's. And I still have time to file a lawsuit

I am requesting a full refund. The car was repossessed. I understand a portion is usually refunded to the lienholder. But since it it clearly obvious that cars protection plus and Bernie caps auto sales are equal conspirators in fraud, and refuse to release a forged document. I am requesting a full refund.

Someone placed a claim and forged my signature on my warranty. I requested a copy of the forged document from Cars Protection Plus to forward it to the Attorney General's Office.
Cars Protection Plus has refused to give me a copy of the forged document. I told them I would sign a release relinquishing them from any future civil or criminal proceedings. For a company that has so many complaints against them, you would think they would do the right thing, and release the forged document. David Regoli says "unjust action" . Mr. Regoli what would you do if someone forged your signature?
Cars Protection Plus has acknowledged there was fraudulent activities. They cancelled the policy due to "fraudulent activity". And in David Regoli's rebuttal he acknowledges that there is fraudulent activity on my warranty, "Cars has handled this matter internally directly with the car dealership"
Why won't you turn over a forged document?
It is unjust, unethical, and criminal.

What part of my complaint is false and inaccurate?
In David Regoli's rebuttal marked #4 He acknowledged that my report has merit.
"When CARS paid the September claim, the vehicle was still covered under the service contract; however, we were unaware that Mr. McCann no longer owned the vehicle. The vehicle was now in the possession of the lienholder/car dealer who called in the claim. Therefore, CARS has handled this matter internally directly with the car dealership."
Cars protection plus has the discretion to handle this matter internally and directly with Bernie caps auto sales or contact the authorities. Cars protection plus is a victim of a crime, and unfortently so am I. And all I've been asking from cars protection plus is a copy of the document with my forged signature so I can pursue criminal and civil proceedings against the dealership.

I did contact the better business bureau. They told me since forgery is a crime iit was out of their scope because they are a non profit and not a goverment agency and referre me to the attorney generals office. Why won't cars protection plus release a forged document?

I was the only one listed on the contract with cars protection plus.
After I was informed there was a claim paid on the warranty in September 28, 2012. It was a surprise to me because i have not been in possession of the car since April of 2012. The claim was not submitted by me, therefore
a crime has been committed. I no longer wanted a refund. All I wanted was a copy of the forged document to turn over to the attorney generals office.
Isn't that a felony for someone to forges anothers name? Why won't cars protection plus turn over the forged document? I will sign a release and will not hold cars protection plus responsible, all I want is the forged document? Cars protection plus has omitted there was fraudulent activity, in their reasoning for terminating the contract. So why won't they turn over the document? Was there even a claim on the vehicle? If you can't prove to me their was a claim placed on the vehicle. Then I am eligible for a refund.
The definition of threat in that part of Pennsylvania means when you tell them something they don't want to hear. I have all the emails and recored all the calls

The facts contained in Mr. Brian McCann report are inaccurate, false and untrue. I am writing our rebuttal to clarify the inaccuracies and falsehoods contained in his report as follows: When Mr. McCann contacted CARS in January of 2013, he advised CARS that he was “incarcerated” from April 2013 until May 2012. During that same telephone conversation, Mr. McCann advised us that his vehicle was repossessed for “non-payment.” Mr. McCann was requesting a refund of his service contract. We explained to Mr. McCann that this was the first time that we learned that his vehicle was repossessed and that a prior claim was paid on the vehicle. Pursuant to the terms and conditions of Mr. McCann’s service contract, he was not entitled to any refund. In addition, pursuant to the laws of Pennsylvania, there is no state statute that provides that we refund any portion of the customer’s service contract, regardless if a claim is called in or not.
When CARS paid the September claim, the vehicle was still covered under the service contract; however, we were unaware that Mr. McCann no longer owned the vehicle. The vehicle was now in the possession of the lienholder/car dealer who called in the claim. Therefore, CARS has handled this matter internally directly with the car dealership. Mr. McCann is not entitled to information regarding any of our business decisions and we firmly believe that since Mr. McCann’s vehicle was repossessed because he was “ incarcerated”, he is not entitled to any documents regarding the vehicle. He gave up all rights to the vehicle when the vehicle was repossessed in April of 2012. Mr. McCann has repeatedly contacted the BBB, which CARS promptly responded. The BBB closed their file as resolved.
Mr. McCann has also repeatedly contacted our company and harassed several employees by repeatedly demanding and threatening for information that he is not entitled to. He has also threatened me with unjust action. Mr. McCann refers to this situation as being unjust. Regardless, even if Mr. McCann still owned the vehicle and no claims would have been called in on the vehicle, he would not be entitled to a refund. Any refund available, would have been sent to the lienholder, since they paid for the service contract. It appears that even though Mr. McCann has been explained our policies on many occasions by CARS and through the BBB, he still does not understand the terms and conditions of the service contract. We will not provide him with documents that do not belong to him.
Mr. McCann did contact my office on July 30, 2013, demanding and threatening me to provide him with documents. Mr. McCann did lie and state that he did not post this rip-off report. He has been harassing our company and our employees for several months.
