I received my credit report with an outstanding $330 owed to BellSouth from 2003. I didn't even have a telephone in 2003 because I have a cell phone and most people call me on that anyway. So I called CBCS to see what this was for. When they told me the address and phone number on the account, I told them I never lived there. However I know who did. You see, my wayward Uncle stayed at my house for a few months until he got his own place. He must have gotten a hold of my social security number and used it to open his phone account. I am grateful this is the only account he used my social for.

When I explained this to CBCS, the guy I spoke with was very nice and told me to call the original creditor, BellSouth.

I then called BellSouth. They have no record of my name or social security number owing any money. Nor do they have the address or my uncle's old phone number as owing any money. BellSouth told me to call CBCS and request a fraud report form be sent to me.

I called CBCS back and spoke with someone else. I asked for a fraud report and he asked me my mailing info, which I gave him. I then asked about how long it would take to get it and he said he was not going to send me one. He said he didn't believe me and thinks I set up the account for my uncle. He told me that since I know who lived there that this was a civil matter and I had to take it up with my Uncle. I told them I never lived at the address and I never gave any authorization for uncle to do that and it had to come off my report. They refused and repeated it was a civil matter and told me there's nothing they can do. I even told him I don't care about $330, I would pay it, but it needed to come off my credit report. He said that by paying the money, I would be admitting guilt and therefore it would stay on my report.

I then called my uncle who owned up to doing it, but said he paid the bill a long time ago. He sent them a money order (no checking account) and no longer has the receipt. This is probably why BellSouth has no evidence of me owing any money.

I called CBCS back and they said without a receipt they would not list it as paid. I told them I want it removed since it was not mine and they refused. I told them I want it removed because BellSouth has no evidence I owe the money. They refused and said I owe the money.

I then disputed item twice in my credit report and both times it was verified. In fact, Equifax states "Equifax verified that this item belongs to you". When I called Equifax to find out how they verfied the item belongs to me, Equifax said collection agencies usually just send a note that the item is mine. CBCS does not have to submit the actual verification.

I should have disputed this item years ago when I first saw it when BellSouth still had the info, but unfortunately I never got around to it and did not have to until now.

I am not receiving harassing phone calls because I gave them my home number which is really my fax line and I don't answer it.

Anyone have any ideas what I should do at this point?

After calling them to find out the info I explained in the original post, they are now calling me all the time.

When they call me, my cell phone has this weird ring, not my normal one. The caller ID lists "Data Call" and the phone number. Does anyone know what this "Data Call" is? And why the weird ring? They can't be extracting data from my cell phone company, can they?

I do not answer, but I did call the number back the first time and the person who answered informed me it is CBCS. I said "Thank You" and hung up.

Nikki,

This is all very easy to fix when done properly.

NEVER speak to ANY debt collector on the phone. It will never do anything positive for you, and will always make things worse. Stay off the phone!

All you had to do was to send a debt validation request. Send by certified mail, return reciept requested. Put the certified# on the letter itself, and keep a copy for your records. This is very important as it proves WHAT you sent.

Now, send a letter of dispute to the credit bureaus by the same means above. In this letter clearly dispute the debt as NOT YOURS. And, here is the important step. Invoke your rights under the FCRA to see whatever communications are used in the "verification" process. This is your right.

Now, if they do not comply, you have the documentation needed to sue them as per your rights under the FDCPA and the FCRA.

NEVER contact an original creditor when a collection agency has an account. They cannot legally speak with you about it anyway, or fix a problem.

And, NEVER fill out one of those "fraud" forms with a debt collector. This is just a back door way of getting your personal info that they may not have already.
