Dear Mr. Hughes, as a note I learned this company is affiliated with Earthlink.com, 3 years ago I had the same problem with them when trying to cancel my 2 accounts. They were billing me almost $60 a month for 2 accounts, when I signed up for the service I paid 3 months in advance with an e-check for a deal with getting a free dig camera for 3 months service and had to give them my cc for verification. After 3 months and never getting the cameras and not authorizing them to any more e-checks and while calling to complain about never getting the cameras I cancelled the account. They began automatically charging my credit card without my authorization, I had to dispute every month for 10 months the charges and had to provide proof of cancellation. Their website stated the only way to cancel was by calling them, well 2 months later I was still being charged and tried to locate a fax number and address for them neither were on their website and their customer service people refused to release it. Eventually I got smart and called them stating I needed to send them a money order to pay off my account since my credit card had been cancelled, and they were more than happy to give it to me then. I sent them all the documentation certified mail and after a year I got my $600 back but none of the charges I suffered because of their system. I found this interesting that the same type of practices are being done by ConsumerInfo. Here is a copy of my letter to them and my bank.

This is a written notification that I am disputing the following charge to my VISA Debit card. When I logged in to my online banking lat this morning I was stunned to see my account balance, which was and should have been $114 actually be overdrawn. I had no idea what it was and flipped out when I saw it, since I have been trying to be very careful to watch my balance and spending. I decided before calling the number for the account to check it out on the internet and a yahoo search brought up dozens of links reporting fraud, see some of the screen prints below. I did get an offer for a free credit report and they stated they needed a credit card to validate my identity and verify I was the same person requesting my own credit report. They did offer when viewing the report, which was BLANK! To get a consolidated report from all 3 bureaus for something like another $30 and they also offered to get my credit rating for $15or $20 and I assumed that was the hook behind offering a free credit report. I already know I can get copies free via snail mail and a travel club I am in already has me on a credit protraction program. This site just kept popping up FREE CREDIT REPORT over and over and not mentioning much else. I have a J.D. and B.S. and was the MS Internet Info Server version 1 Test and Environment Lead have been in the internet software field as a QA director on web based sites, which utilizes knowledge in both law and computer science, I helped 14 start-ups all go through IPO once my team, and I had thoroughly tested it. All of those companies are still in business except one utility.com and I failed their system because as I worded in my resignation letter, they would be facing a huge class action lawsuit for the errors in the billing system, and I was right and have to appear in court against the company. Just so you get an understanding that I AM VERY SAVVY ON WHAT IS LEGAL ON INTERNET BASED CONTRACTS AND CHARGES.

Well I spent an hour reading through one complaint after another and sat here stunned that the attorney general of CA hasn't shut you down and fined you yet. It is very easy to be deceptive and change agreements to suit your needs when you have not established a written contract, and reading the complaints and noticing your site looks completely different or I was taken to one of your mirror sites, but you have no basis PERIOD to withdraw funds from my account. I refused the sales pitch for ENHANCED credit report and credit rating, at no such time did you site or WebPages mention a service you were selling for $80 a month, neither did the 1 and only email I ever got to you. I will take this to court as you have basically perpetrated a criminal act of credit fraud and unless you have a certified records that can provide undisputable proof that your WebPages on all your sites carefully force the consumer to read what service and for what amount they are agreeing to and sign the agreement (like all contract law) before charging them, then you cannot do so. Please see the cases I have listed below. And I will file with the FTC and Attorney General and notify all the complaints on badbusinessbureau.com, ripoffreport.com, and consumeraffairs.com, perhaps they will consider a class action suit against your companies when armed with prior rulings in similar cases that set precedence for this type of questionable business practice.

I want my check card credited back the $79.95 and an additional $20.00 to cover my overdraft fee, DONE TODAY; otherwise I will follow all avenues in which to shut your scam down.

I HAVE FILED A COMPLAINT WITH THE FTC, AND WA AND CA ATTORNEY GENERALS OFFICES.

Just to let you know, your letters, complaints, and threats will do nothing to shut this company down. They have been in business since 1995 and are going strong!! The one thing that you will notice is that the lawyer that was on here a couple of months ago talking tough with threats of a class action lawsuit is no longer posting or responding to other people on ripoffreport.com. The reason you ask???? Because his lawsuit got thrown out of court back in May and he is too embarassed to talk about it. In fact ALL lawsuits have been thrown out because the price and conditions are clearly mentioned in the agreement that YOU have to AGREE to in order to continue on with the service. So all you can do is watch the laugh to the bank...... sorry but it's true!
Oh and if you're so savy with your juris doctorate, why dont you sue them and then you can post here from time to time and let us know how the lawsuit is going. I bet we never hear from you again. Take your empty threats elsewhere... we have no need for them here!
