We purchased a $400 camera only to find it was broken inside the box. CC said they would replace it but it would take 4-5 weeks. Too long to wait, so we asked for a refund and they withheld 15% of the purchase price because the box was opened! This is a ripoff because they probably do restock damaged merchandise and sell it to some one else, just like me.

How are you supposed to know its broken until you open the package. ((competitor's name redacted))) has no such policy. Since then I have purchased over $3000.00 on new TV's and a sound system from (((redacted))). I wouldn't think of buying anything fron Circuit City again. Now you can see why the are going under.

sorry, allowing you to give a competitors name would instigate others to just file against their competition, to only come back later to suggest their company, ..plus, if you post a competitors name more than likely they will show up on search engines as a Rip-off! - - your comments on this policy are welcome. In every US jurisdiction that I know, the charging of a FEE for returning DEFECTIVE merchandise is ILLEGAL. Restocking fees are legal for returning merchandise that has NO DEFECT.

Every State has adopted portions of the Uniform Commercial Code's "warranty of merchantability." What varies from state to state is the time period inwhich a consumer may return DEFECTIVE merchandise for a full refund with NO PENALTY whatsoever.

There is a 15% restocking fee for all cameras that were sold at CC. We did not restock damaged items and sell it to other people. Once you take the item to customer service, a black and white sticker get put on the item and the item either gets sent out to get fixed or you'd get new one. (depending on weather you had a protection plant and a few other reasons)

Keep in mind, people on the sales floor usually let you open the box to check out the camera before you buy it. and if they wouldn't let you, im sure that customer service would of.
