I hear what you have to say, but having dealt with a similar situation in 2004 (clients being kicked out on the street after paying their fees) I would like to say one thing - Dianne was the ause of many problems with promises and lies in order to get a client to come to Clearhaven. She was also the sister-in-law of the owner; in other words, she may have been nice on the intake, but she was as involved in the takedown of clients in 2004 and later in 2009 (when clients were thrown to to the street) Just a point. Yes, she was "nice" but she was as much a liar, if not more so, than the owners were presenting the Centre as the perfect place. the promises of swimming pools, karate classes, single rooms, excellent food, etc. was all a premise to get clients money. And the contracts signed by clients arriving in Chertsey QU were only in favor of one (Clearhaven) Of course the place is closed now, so what can we do?

The Real Story

I'm not an employee, former client, or anything like that - but I have intimate knowledge of this company and have something to say.
First, I'm sorry about what happened to you. I can tell you that the intake counselors (like Dianna) were terminated right before the owner of the Rehab center decided to close the facility. They were not aware of the impending closure and they have been cut off from access to emails, phone lines, etc... So, don't expect them to respond to your inquiries - they won't (can't) answer.
Second, you should know that the owner is a guy by the name of Terry Orsten. He is a dentist out of Alberta and he originally got involved in this "business" by first buying the building and then setting up a marketing scheme. You have to know, this man, has no true personal interest in drug rehabilitation. It was about money and the potential for high returns. He is a "Doctor", but he is doctor for teeth - nothing more. I know a lot of information about this guy - and it's somebody that I would never want to ever deal with; either professionally or personally; unless I wanted harm done to me or my family.
It is my sincere opinion that this individual, who was the sole person with authority to shut down the facility, knew of your family member's impending admission with full payment, and accepted the payment knowing shortly thereafter he would shut down the facility. It appears to me he needed the money, at your family's expense. If this is the case, which I believe it is, you can't get much lower than that.
I urge you, very strongly urge you to seek a legal remedy - and probably a class action lawsuit is appropriate. Also, I know that many, many clients have been 'kicked out' over the last few years without any refund, however, despite any waivers signed, these individuals are, in fact, entitled to a refund commensurate with how long they were there - they just didn't know it. This owner, I believe in my opinion, firmly created the impression that they could not get refunds. All this did was probably increase his bottom-line (profit).
You should really also consider going to the media (both Canadian and American) and tell them the story. This situation should be in the media spotlight. Do not give up; seek legal recourse (even if he says he will file bankruptsy). Use the media - contact the news rooms, media outlets, etc... You will be doing your family and many others a big favor in the interest of justice.
Good luck.
