Just like the rest of you I am also looking for a class action against those scam artists. It all started off in November of 2008. My husband lost his job and was out of work for 2 months. I called the Home Retention and applied. They noted all my paperwork on their website as received December 15,2008. Great! things are looking better since we saw the guy taking pictures of our house for "Real Estate Purposes". Average time for modification 45 days and if you have not heard anything after your 45 days call back to check the status. So I did and spoke to a very informative man from India. "it's still pending, keep calling". So time went on and on and on. I finally get a statement in March that states I need to call to stop the forclosing. I was only one payment behind because I still sent payments even if they were not in the full amounts. I called March 09,2009 and spoke to a young girl. Oh it's "still under review". Disregard those statements because they are computer generated and even though it says you owe us over $3,000.00 I see the payments you made. The funds are being put somewhere (I can't remember where) until the modification is complete. That's fine I suppose even though I don't like not seeing the funds I have sent them. So, Bank of America is more in the picture now. I figure I need to call again just to make sure that nothing is getting mixed up due to the transfer from Countrywide to Bank of America. I call in April. GUESS WHAT?!!!! My request for a modification was canceled on March 19,2009. So I asked this woman from India her name is Lucy why it was canceled. She tells me she doesn't know all it says is it was non compliance. She asked me if I got a certified letter. Why yes I did and I was told to disregard it since all it was, was a statement. "That must be the reason" she tells me. Only Lucy doesn't know I still have that letter and it's print date was March 24,2009. How can they cancel my modification for on the 19th because of a letter that was printed on the 24th? So then I ask her where my payments are. She tells me to look online. I told her I already did and it doesn't show anything from 12/2008 till 03/2009. Her answer " it should be there". I have all of my payment statements printed and ready to go showing all payments I have made even if Countrywide doesn't. She then proceeds to have me reapply and low and behold I Don't qualify. Can't say that I'm surprised at that fact since it was probably mostly a scam anyway. Why should they take the loss when they can just push it off on Bank of America and let them take the fall for it? I'm not defending Bank of America what so ever because to be honest I would be more than happy to take them down right along side Countrywide.

So to make a long story long I am with everyone else who is ready to take these Corporate monkeys down a few notches because it just doesn't sound very legal to me. Do you think Bank of America might be too stressed and are using these unaccounted funds to cover their assests?
