CountryWide failed to pay Homeowners insurance from 09/2003 to 08/2004. We had water damage and now they have sent us to Balboa Insurance. Amazingly, CountryWide owns them. I am without floors since 08/22/2004. I am walking on subfloor with staples and nails. They won't return calls. Have filed a grievance with NCDOI and they are suppose to investigate. I will keep you updated.

It was a long time coming but I won the case against them. They actually ended up paying more than 3 x's the amount that we asked for. It did not go before a judge. We setteled behind closed doors with a non disclosure stipulation. But I did want to let folks know it is possble. My floors are almost done. Geez, 2004-2009 what a wait but well worth it. It wasn't the money....It was the principle. They screwed up and they needed to fix it and finally .... They have ! I love nothing more than to see the jerks in CA lose their jobs now. It was obvious they didn't know how to do it in the first place.

First off Daniel, I do know where Eric is because I personally worked under him. I just forgot to put it in the comment and didnt want to give someone else the run around again. If you recall, I am trying to help, not harm. Also I do know why and for what reason you are putting money is escrow for. As far as the reason computers were made, there is a specific call center that does nothing but make outbound calls to insurance companies and agents to get the correct information on how much the bill is so that we can pay it on time, but anyways. I have a direct mailing address to Balboa. Honestly the address is Van Nuys, Ca isn't that good anymore since now the call center there is mostly dealing with data entry. yes all their employess seem to have their heads up their butts and thank god you found an attorney with some balls iam senting your last responce to my attorny so he can see that others are working on this problem my court date is on tuesday sept 6 iam hopping that the judge grands me a trial this time if you could please have your att call mine before tuesday so he can have poss more proof of their incompidence his name is manuel garcia 305 -292-1437 please tell him to talk about how they paid your insurance LATE

You are exactly correct. Balboa nor CountryWide have any idea who does what, when, where. They seem to be oblivious to how a reputable company runs business. Thanks for the update because I MAY have good news. We had a mtg w/the attorney on 08/30/05. He actually got a person on the phone and we conferenced the call. When the other person identified herself, my husband and I both laughed. She was the one handeling the claim and would never return phone calls. And when she did, she appeared to be clueless. I have documentation of every call - dated, conversation that took place, and when she returned calls. (Which typically was 2 WEEKS later when she said 24 hrs.) My attorney offered a settlement but she was under the impression the claim was settled. It has now been 375 days. She said she had a signed agreement from me that they would provide the same coverage that my original insurance company would provide. That was bs. My policy had a higher deductable with better coverage such as $50.00 per day displacement, and replacment value at today's price. They were bucking that. I even had to get a policy jacket fax'd to them as proof. After quite some conversation my attorney really put her in her place. He finally said "You are one of the reason's this has not been finalized". I and my clients are giving you till Friday 09/09/05 to give us an answer or we go to court. They know I am fully prepared to go b4 a jury. I have proof they "Balboa" and "CountryWide" have created this whole mess. THEY OWE ME...........I'll update this on 09/08/05.

barbra it seems that amber has good advice for you how ever she made a mistake about where eric was
this is just typical this company is soooooo big no one knows where the hell they are and whos in charge
amber said that a letter was sent out about the change of address well barbra i heard this too and iam still waitng for the jerk JIMMY WINTERS who works for balboa to send me that same letter and its been two years still no letter
lets face facts people balboa has screwed up peoples accounts all over america this seems to have happened in 2003 when they took on the servicing of way to many other companys (check out gmac) and as far as them not knowing when to pay a policy out of someones escrow account thats just plain bs this is what the invented computers for to keep track of records ta da after all what does amber think we pay monies into an escrow account for .

I messed up on the calling Eric one. Ask if you are calling California or Pittsburgh...if you reached the PITTSBURGH call center, than ask for Eric. If you reach California, I don't know anyone there that I can tell you to callbut if you get Pittsburgh, ask to speak to only Eric. Not a supervisor, just say I want to speak to Eric or a woman named Mary Java, other than those two people, don't speak to anyone else, but ask for Eric first. Sorry about the first rebuttal.

I use to do this with customers kinda in your situation, but it depends on the rep that you get, but...What Balboa can do is first off credit your account with Balboa's own account and than fight to get the money back from wherever they sent it to, but also try to get your policy reinstated if it has cancelled. If it has cancelled and the rep gets your policy reinstated for a higher prem since there would be a lapse in coverage, Balboa will pay the difference for a year.

So let's just say without a lapse in coverage your h*o policy would be $100, but now that you have a lapse in coverage your h*o policy will be $300. Balboa will pay the $200 difference out of their own pocket for their own mistake, but that is only for one year. If there is anything else I can do to help you out, just let me know.

Than Barbara, it is a unusual case and I will give you some help. Chances are, they probably sent it to the wrong company depending on who your insurance company is, like either in Oregon instead of North Carolina which is where I think your from. This is what I would do, call the office and ask if you are calling in Pittsburgh or California.

if you are calling from California, don't ask for a supervisor. Ask straight for a gentleman named Eric. I'm not sure if he still works there, I am sure he does, but I would ask for him. He is higher up than a supervisor and he does not mess around. He will get things straightened out for you and if a rep tells you he is unavailable or busy, tell them you will wait and do wait. No matter how long it takes. Usually he is in the office or they will tell you that just to put you off. So, I'd call back and ask to speak to him. As long as he is still there, he will help you. Hope that may help you out.

Regarding Balboa not paying insurance

I am a former employee of Balboa, and the reason homeowner insurance does not get paid is as simple as Balboa didn't recieve a bill. It is the insurance company or the insurance agent responsiblity to send them an invoice. If no invoice is recieved, than simply Balboa won't pay. There are way too many accounts for Balboa to keep track of what should be paid every single day, so that's why the insurance company is responsible for requesting payment from them.

Usually agents will call if payment isn't recieved by a certain day, in that case, Balboa will overnight the payment. So basically, Balboa must get a call from an agent or get an invoice to release payment from your escrow account, and if they are mailing us an invoice, they must have the correct address in Van Nuys, California, not Irvin California.

A letter stating this address change was sent out.

Barbara: Be careful when dealing w/ your lawyer. $125.00 an hour can get very expensive after a few months and a few hundred billable hours. Periodically, request to see his carpe diem charges a/k/a itemized list of exactly what he is billing you for.

Somethings are billable, some are not. Will he charge you for copying fees, phone conversations with you, or work his secretary/paralegal performs? These are questions you need to ask him. I know, as I am an attorney. Contingency would have been a better and safer plan. Good luck and keep us folks updated.

Grill your Attorney really caused me concern. First, I do not want involved in a class approach. I have already retained him for my case. Not contingent.

The agreement is I pd $2000.00 up front and he charges $125.00 per hr. Plan is to settle for repairs and reimburse me for the $$$ I have paid out and for the punitive damages they caused. Attorney fee would be 10% of settlement after reversed Lawyers retainer fee. Not looking to get rich, just fair. I did file a complaint with NCDOI. They found them at no fault. Not sure how to file with Banking Dept.

Now......Water damage coverage. We originally had insurance with Farm Bureau (which I highly recommend). They must comply with what my insurance would have been (had they paid it).

We had ammended our policy with a slightly higher deductable but much better coverage. Water is definitly covered in this policy. Thanks to all of you. This has all been very helpful to me.

Water Damage? many times water damage is not covered under homeowners insurance.

Just curious here, but in general, and I don't know about North Carolina or the area of NC that Barbara is in, however, many times water damage is not covered under homeowners insurance.

"As I understand it" (Standard disclaimer meaning that I am no expert) homeowners insurance generally does not cover flood, earthquake, war, nuclear accident, landslide, mudslide, sinkhole. No matter what, no matter what type of homeowners policy you have those things are not covered.

In a "basic" homeowners policy, water damage caused by burst pipes, AC units, etc, etc are also not covered. However, more expensive homeowners policies will cover damage from burst pipes, etc.

So... My question would be what caused the water damage in the first place? Nowhere does this excuse Countrywide for not paying the insurance in the first place, but I imagine that their insurance is the cheapest available, which wouldn't cover any water damage anyway.

Your attorney seems to imply he may try a class approach to resolving your case. Beware. Don't get carried away by the grand posturing of a hungry attorney. You should only be interested in resolving your specific issue. Do you have a legit legal action and is this attorney prepared to take the case a contingent basis? Cases like this rarely make it to trial. Also be real sure you understand that costs are extra and come out of your pocket.

Filing a complaint with the State Insurance and/or Banking Department is critical. Supply them with copies of all supporting documents. See what you can get done with them. If they take up your cause they can get quite nasty with wrongdoers in the insurance and banking sector.

I have located an Attorney that seems to think I have a good case. Said he would like to be able to settle thru litigation. Said if we could come to an agreement it would be up to me to pursue punitive damages. I told him about this web sight and he said he would be willing to take a class action suit if enough victims were out there. Keep this in mind if you are in the same situation or know of someone who is. I'll keep you informed.

Don't borrow money from these bottom feeders. Stick with established lenders who have a track record of following reputable practices.

People who shop around can always find a half a percent difference in price if they look long enough. The problem is that the lender is countrywide.

You know, all fraud can be distilled down into a handful of key concepts.

The fact that you always get what you pay for is one key concept that people consistently overlook.

Yes, you may save a buck on a discount item. But, you need to watch out for what you're not getting.

Typically, discount lenders have to cut costs somewhere. In this case, they steal the insurance premiums in order to keep the total price down and still make an acceptable profit.

Here's the link to the state insurance commissioner. The squeaky wheel always gets enough grease thrown at it to shut it the hell up.

No insurance company needs grief from the insurance commission. I suspect a complaint here will expedite your claim, at a more acceptable amount.

In the meantime, pull the staples and nails up. Don't put new carpet down over that.

Well, they finally came to a settlement price. Where did they get it....From their Independent Adjustor. Who do you think pays him????? His estimate and an estimate I got are over $9000.00 difference and you can rest assured it is not in my favor. They haven't even taken into consideration I have been displaced from my home for over 6 months. My insurance company would have allowed me $50.00 per day displacement. They don't even want to discuss it. I rec'd papers they want me to sign releasing them of any additional damages found. No where in the papers does it say all of this is because they did not pay my homeowners insurance out of my escrow account. Do you think I'm going to sign. Heck no, I haven't had to cook in 6 months but it sure get's expensive. I can hold out as long as they can. I only want what is fair and they aren't even close. Don't know where to turn but will find something. If anyone has a suggestion I would love to hear it. I am going to try to attach a picture of my COLD uninsulated, subflooring house.

WHAT TOM STATES IS TRUE AS FAR AS IF THEY THE MORTGAGE COMP DOESNT PAY FOR YOUR INSURANCES THEY ARE BREAKING THE LAW HOW EVER NOT IN THEIR EYES I HAVE BEEN DEALING WITH GMAC ON THIS MATTER SINCE MAY 2003 THEY DIDNT PAY MY HOMEOWNERS INSURANCE ON TIME AND IT WAS CANCELLED



IT WENT FROM $482.00 A YR TO A HIGH NOW OF 1448.00 AND WHO DO YOU ASK IS PAYING THE DIFFERANCE ME NOT THEM THEY TO THIS DAY HAVE REFUSED TO EVEN TALK ABOUT IT SO NOW WE WILL BE IN COURT AGAIN FOR THE 7 TIME TO DISCUSS THIS WITH A JUDGE BUT OF COURSE AS IN THE PAST THEY DONT SHOW UP OR FILE A MOTION FOR A CONTINUANCE SO HERES THE WARNING MAKE SURE YOU KEEP TRACK OF THE INSURANCE PAYMENTS FROM THE ESCROW ACCOUNT

Homeowner's insurance

When I got a mortgage the payment was PITI (payment, interest, taxes, and insurance). The payment and interest are what I would repay for the loan. The taxes and insurance are put into escrow and the mortgage company is supposed to pay these to the county (taxes) and insurance company (insurance) when due, either semiannually or annually.



The mortgage company wants to control the insurance payment because if the house burns down and there is no insurance they may be out a lot of money. So rather than relying on me to make the insurance payment, they do it from the escrow account. Also, they want to make sure the house has the taxes paid on it so there will not be a 'tax sale'.



Now, if the mortgage company does NOT pay the taxes and insurance they have broken the law because they are my agent and have my authority and must pay the taxes and insurance.



Shady companies may not pay the taxes or insurance and use the escrow money as their own and/or collect much more from you to put into escrow than the taxes and insurance are for.



In Barbara's case it sounds like she might be able to sue CountryWide Mortgage for the cost of repairing the damage to her house. Of course, CountryWide will probably find some document, somewhere with her signature saying she is responsible for making sure the insurance is paid even though CountryWide collects the money.

I am not sure how homeowners insurance work.....

Having read this, I am very confused as to how homeowners insurance work. We pay a monthly homeowners insurance with our insurance company. When we bought / refinanced we paid up front $1800.00 and we add taxes and insurance to our mortgage every month. Please help me here???
