in october 2013, i financed a 99 mercedes benz ml430 from keorner ford. therefore, i was introduced to credit acceptance who financed my the car. in january 2014, the car broke down and i had called my AAA to come and bring the car to the dealership for repairs. since the car didnt have a warranty on it the repairs were 1200. i couldnt afford it. but credit acceptance still wants me to pay for the car that i havent had. they keep calling me telling me that it got reposessed from the dealership. i knew it was all a scam. so i mad serveral calls and credit acceptance told me that by law, they cant give me the car if its not running. so i stopped my car from going into auction. i called the auction place and to my surprise, not only is the car not running but credita acceptance sign me on a whole new deal to keep paying on this car. this was a waste of my money and i would like my money back and to get out of this deal with credit acceptance. and the dealership at keorner ford for selling me a faulty car

Credit Acceptance did NOT sell you a car, they only financed it.  They don't care if you have the car or not.  They don't care if the car has $1200 or 12 Million dollars in repairs.  They don't care if it is running, you ran it into the lake, or it was abducted by aliens.  In exchange for letting you borrow several thousand dollars to buy a car, you signed a legally binding contract that states you will make a set payment at set intervals for a specific amount of time.   If you fail to make those payments they have the legal right to reposess the car.  However, even that does NOT absolve you of the debt.  After they sell the car at auction you are still legally responsible for the balance of the loan.  Oh and this is exactly how EVERY other fianance company and bank works.

So if you have a problem with the state of the vehicle that is between you and the dealer.  However, even there you don't really have a leg to stand on.  You bought a USED car, and a 14 year old car at that, AS-IS.  Meaning that the second you signed the Bill of Sale you agreed that you are now responsible for ANYTHING that happens with that car. 

As for getting "out of the deal"..yea that isn't going to happen.  Not only that but since this is a "sub prime" finance company who deals with people who basically have already screwed up your credit.  You now have an additional Reposession on your credit.  So if you think they were bad, just wait until you find out how strict the next companies are who you will be stuck with in financing a car.   You will get the pleasure of having a very high interest rate(yes even higher than the one you got with this car), and they will most likely put a GPS device in your car that the day you are late on a payment they disable it so you can not drive it until you make your payment.

To the complaintant:

 

First, Credit Acceptance is ONLY financing the vehicle you purchased so, this company had nothing to do with selling you the vehicle. They paid the dealership for the Mercedes that you purchased and you borrowed the funds from Credit Acceptance (your loan).

Secondly, your complaint is with the dealership that you purchased the vehicle, not the company that has loaned you the funds. If you bought the car without a warranty and all the documents displaying that it was purchased in "As Is, Where Is Condition with No Warranties, Expressed or Implied" then, I'm afraid you have an uphill battle with the dealership. Check with your state to see if there is a Lemon Law when purchasing a vehicle.

Third, as much as you would like to "get out of this" deal, you are responsible for paying your loan to Credit Acceptance. Again, they paid the dealership for the vehicle you bought so, they only loaned you the money to buy it and when you signed the loan papers, you guaranteed that you would pay back the loan.

Finally, a Mercedes ML430 is an expensive vehicle when purchased new. Along with that big price tag comes big repair bills for when they break down. Parts and labor for owning what is considered a luxury vehicle is costly and should have been considered before purchasing this type of vehicle. Too many people are all about the status of owning a high end vehicle such as a Mercedes, BMW, Audi, etc., but can't afford the insurance, repairs and everything else that comes with owning one.
