I was a company solo driver when on Dec. 19,'08 I was in the WVC yard. As I was walking from the parking area into the "hotel" bldg. I slipped on the snow covered sidewalk and fell injuring my shoulder. I reported this to the security officer and he got me a cab ride to a nearby E.R. I got an exam & x-ray & was told no bone damage , probably just a bad bruise. If not improved in 3-4 wks. seek additional consultation (orthopedic). The next day I got a ride with a driver going to my home town so I could have my 4 days "home time". My new team driver (assigned 12-19) picked me up 12-24 and we drove loads [chicago, miami, laredo, phoenix, san diego etc.] 'til 1-23-09 when we had a delivery near the WVC yard. I contacted my DM about going to see a Dr. He said fine and pulled me completely off my truck so my co-driver could continue on solo. I reported to the Ins. dept. to get a Dr. appointment. A week later I had to make my own appt. and a wk. after that I had to use my own ins. for an MRI. 2 more wks. of meeting w/ins. dept. co. attorney, and even Corey England I received catagorical denial of any responsibility. Feb. 23 after 30 days of not working, I went home. Hired an attorney who was able to file it as a worker comp. case. The ins. co. didn't settle 'til Nov. '09. I just got my surgery done 2-23-10. This morning I got a call from a collection agency about a hospital bill [12-08]. They were told by an attorney (probably England's) that payment was denied due to a ""pre-existing condition "". This is but one of the many financial nightmares I suffered at the hands of extremely greedy people. I had so many issues with pay while driving, I don't have space to list them all.

In Mar. '09 I spoke with several attorneys about filing a personal injury tort claim against C.R.E. I was told by all (attorneys) that slip & fall injury claims are hard to prove and take forever to litigate, as the defendant can ask for continuance (in court) ad infinitum. If you can survive finacially for 1-2.5 yrs, give it a shot. I was lucky enough to get referred to a lawyer who was able to initiate a worker comp. claim.
It still took a long time but I prevailed. I had some money saved and got a tax refund & even a few wks. of un-employment benefits, but still had to borrow money by Sept. '09. Finally in Nov. I got the call from the Ins. Adjuster telling me they will pay.
I hope R.R.R. will publish this for your benefit: Corey Hill Attny @ Driggs, Bills & Day S.L.C. Ut. Ph: 801-363-9982
Good luck with settling your case & getting back on the road as a Proffessional Truck Driver !!

I 2 had a accident on the property of CRE @ West Valley City, Utah yard while (ON-DUTY). And after 5-weeks the 'Worker Comp.underwriters' final paid for only the prelim. X-rays. But, are now denying any further coverage stating "it seems to be from a pre-existing accident". Now I must seek an attorney to file a lawsuit. How's them apples.
That's ok, sort of because, I have been in contact with the Feds. concerning there (CRE's) company trainers falsifying federal documents as well as the in-house workers doing the same and hiding (Redacting) evidence!
So much for CRE's the top three tier status soon.
Thus Rome will fall...again. <---->Only this time in Utah!
