I met David at church about three years ago.  He seemed like a nice guy.  I sought a bid from him for our outdoor living project.  He was the highest bid, but I went with him anyway.

David said he could complete our project in two weeks.  I knew that wouldn't happen, but I certainly didn't expect that the project would run two months.

David disagreed with his trades throughout the process regarding construction.  (And David was always in the wrong.)  I heard David curse out his trades and talk down to them on a regular basis.  David regularly fired his crews and refused to pay them.  He frequently went completely AWOL.

David was paid in full for the project.  In fact, we volunteered to pay over the contracted amount, because David said he was losing money.  In spite of this, David refused to show up for the final walk-through, and I had to find another contractor to finish out the punch-list.

Over the last six weeks we've been contact by six different trades, saying that they were never paid by David, and that they've been unable to contact/locate him.  No one can find David, and he's refused to return my calls or emails.

I had another trade show up at my house today and threaten to put a lien against my property.  (This has been happening for six weeks.)  When I posted a notice on Facebook today, David immediately called to curse me out.  And then he did the same in text.

I've had to contact the police.  I'm pursuing legal and criminal channels.  I've had to warn my children to run if they see him.

David is not to be trusted.  He's dishonest, and unethical.  Stay away from this man and warn your friends.

He was using his Nice Guy Who Goes To Church act. I took him to court and have not seen one penny. His only intention when he is nice is to get something. He does not care who he hurts. We are not the first. I counted 23 other Judgments before us!!!  He has even escaped the IRS!! Many times!!

Don't believe it?  Check it out..

Definitely plays on women for cash so beware!!!

he is in Austin so count the silver...

Rebuttal to the delusional David Bush

AUTHOR: Chris - ()

POSTED: Tuesday, April 02, 2013

David accurately explains that we put our project on hold three years ago (before any work had been done), and as is the case with 99% of construction he accurately points out that there was "scope-creep" with the project.  That said, the rest of his email is completely false.

David never provided a quote for any additional work; nor did he ever send an invoice.  However, recognizing that we asked to widen our porch foundation by approximately one foot (beyond the plans), I offered to pay an additional $1800 over the contracted price to cover materials, and to make sure he could pay his trades.

In the first week of framing, David did charge us $200 to move the forms for foundation.  We paid that within 24 hours (and this was in the first 48 hours of the project).  David has therefore been paid the full contract amount of the project, plus overage.

David was not onsite 6 days a week.  In fact, there were numerous times during the project when no one was on site, and David was completely unreachable.  On the days when work was being done, it was a regular occurrence for me to find 3-4 contractors standing around for hours on end with nothing to do, because David hadn't bothered to show up yet and/or he hadn't provided the necessary materials. Certainly this mis-management played a vital role to the project taking more than two months to complete, and also caused the budgetary overruns that David feels he's owed.  (Again, not one invoice or quote was ever provided, nor payment requested for any of this work.)

Look, at the end of the project David disappeared, and he never showed up to do a final walk through.  He also refused to return our calls for more than six weeks.  As a result, we've paid about $1600 additional to another contractor to finish David's work.  And, because David didn't pay his subs they continue to contact us looking for him, and they've threatened to put liens against our property.

David has tried to play the role of victim, and he's tried to draw my family's character into question.  From speaking with others that have been victimized by David (professionally and personally), this is status quo. For further proof of David's morals and ethics, you need only look at his rebuttal to the report.  David has attacked my family by trying to include my family's last name and our phone numbers in his report.  He references my wife's profession, and he's gone so far as to call her employer.  Fortunately, she's beyond reproach, and fortunately the local sheriff's department has warned David against harassing us further.

As for my family...We donate, give, and serve others generously.  Simply stated, you won't find another person on the face of the earth that will say that I/we owe them money, or that we've ever been dishonest/unethical with them.

A man is only as good as his word, and David's word is worthless.

#1 REBUTTAL Owner of company

I did my best to please the B****'s

AUTHOR: D Bush - ()

POSTED: Tuesday, April 02, 2013

I have had a relationship with Chris and Kim B**** for six years that started by knowing them and going to church. Kim is a licensed realtor. They wanted an outdoor kitchen project built at their home at 290 Abbott Drive and we had agreed to a signed contract between my company, Lionshead Poolsculpting LLC and Chris and Kim B****. In the Spring of 2010 we contracted at a price of $35,000 for a specific scope of work which was the outdoor kitchen project.

A couple of weeks later, I received an email from Chris stating he had been laid off from his job and to please return the deposit he had given me to start the job. I agreed with his request and returned the full deposit less my time for running a permit. Kim contacted me in October of 2012 and said they were now ready to start the work, so I quoted them an updated price of $52,000 to do the outdoor kitchen project. Chris and Kim both were put off by the price increase and begged me to honor the 2010 price we had originally contracted for. Since they were friends - I agreed to do the job for $35,000 which was the price I had agreed to 3 years ago.

The B****'s had a 3rd party design a drawing that I used to base my bid on. The design was a basic outline and lacked specifications. Chris ageed that the plans that he provided were not clear and adequate for detail. Per the drawing that the B****'s had the 3rd party designer produce, I had board forms set. Chris did not like how it looked and wanted them moved. I informed Chris that there would be an additional charge of $200.00 to move the perimeter for materials and labor (this is to cover my subcontractor's) to the area he wanted it moved to. Chris responded that his wife Kim was not happy about this and I did not receive cooperation for extra expenses that they incurred. The B****'s finally paid me, with which I paid my framer. It was per their drawing that the forms were set in the first place.

It has always been my goal to please my customers and to exheed their expectations. From the beginning of this job for the B****'s, they added numerous changes that were obvious extras and did not want to pay for them. I agreed to do the work for a lower price but I cannot afford to honor changes that cost money and to give them away for free. I think anyone would agree that this is not good business.

I have done my best to give the B****'s as much value as I could afford to give them within reason:
1) I added a beautiful custom ceiling to this job that was created from a rustic old floor. We sealed and stained it a gorgeous tannish brown. I did this all at no charge to the B****'s.
2) I added a 12" x 12" post with a complete 4" x 24" header completely around the structure at no charge.
3) We added extra lights and extra outlets at no charge to the B****'s.
4) We built the custom fireplace to be 32% larger than the plan called for with a custom TV cabinet and TV hide-away doors at no charge.
5) 30% of this project was given to the B****'s for free based on our past relationship at church and as friends.
6) I was there everyday (6 day work week) working to get this project completed in a timely manner. I worked both Christmas Eve Day and New Years Eve day.
7) I upgraded the kitchen applicances to top of the line. This was not at the specifications from the drawing or bid. The upgrade to the kitchen appliances were provided at my expense in good faith to please the B****'s.

On Sunday, March the 17th, Kim B****, posted on Facebook, Linkedin and Ripoff a number of accusations and personal attacks on my character that are not true. As I mentioned above, Kim B**** is a licensed realtor and should know from her experience in the real estate business that there are price increases over three years and that changes in building specifications - cost money. It is discouraging when you take money from your own profit in a job as a favor to a friend, and they deliberatly try to slander you and to take advantage of .

Kim posted on my facebook pages and then unfriended me so I was not able to read what she wrote. This action was vindictive, unproductive and unprofessional. The B****'s have been unreasonable customers and cannot be pleased. This project on the B****'s home turned out beautiful and I encourage you to drive by this gorgeous project. I also encourage you to call the B****'s and question them if anything I have said is not true.
