Five years ago I attempted to attend this driving school. After 5 days of classes, they gave physicals. When they found out that I had mitrovalve prolapse, they told me that they were no longer going to fund me, I was a risk to their company. I gave forwarding information and left. Five years later, now living in North Carolina, I receive a summons for small claims court. The amount being $1975, the original total being $827 (for 5 days) and then being charged 18% interest for five years with NO notifications.

I was just informed by the legal department of Driving Solutions that my choices are to go to court or be arrested and lose my job if I get stopped by an officer and my information is ran for any reason. The only way around that is to just accept the charge and allow them to take $100 a month out of my bank account until the fee is paid. How is this legal!?!?

Some comments to your situation, with one caviat.  This is just the most likely and most probable chain of events that would happen. But since no one knows the exact specifics of your situation, you can not take this as legal advise and need to consult an attorney.

You can not be arrested for a consumer debt.   The Small Claims case is also a Civil Issue, a Judge will NOT issue a Bench Warrant for your arrest if you fail to show up.  What would happen is that the Judge would enter a Default Judgement against you and you would then be subject to things such as Wage Garnishment and/or attaching of your bank accounts.  So even though you won't get arrested, it is definatly to your advantage to show up in court to defend your position as to why you think yu don't owe the money.

If you go to court and can not get them to prove that they ever attempted to contact you about the debt you may be able to get it down to the original amount.  If you can go even further and in trying to get them to prove that you actually signed a contract or agreement that says you agree to this tuition in the first place you may actually come  out owing nothing.
