I got a 02 ford foucus and was paying 17,000 granet brandnew they are 8,000 with 0 miles. This was back in 04. I was paying on the car even though there were problems they were told but the majority of the monies came out of my pockets. Until the big one came every time you put the car in reverse the spider gear would popout of the tranmission. They were told from day 1 about this problem the charge to fix this was 3,000 I refused to pay. But yet I keep the car until I had enough of them putting me on the run around.
By then my 30 days were up this is what they wanted. So come 12-22-04 I turned the car in invoulntary repo. At this time they owed me monies I told them to keep it just don't report me and a hand shake. They said ok.
In jan. 05 I recieved a auction letter. They sold my car for 3,000 and I was liable for the rest. So it did not mess up my credit report I said ok. at least its not 17,000.
So 2 weeks later I drove by the lot. What do I see? I see my focus being resold!! Hum I thought they told me they sold it at a auction something is not right here.
So in may of 05 I get a humilating phone call from their lawyer (chris). In 2 weeks if you do not settle I am taking you to court and suing you.
So I told chris everthing and I started to do some homework. I went to dmv and had the car title pulled who do you think it was regerstered to - DT - yes! This is 6 months after I turned the car in and 5- months after they said they auctioned it. (hello paper cover up) So I also played a dirity joke on DT and called and told them I was from a towing company and the car was stranded on 1-75 and regersted owner was coming back to drive time (they responed were is the customer) and I told them the customer name was not coming up but it was coming back to DT and what did they want me to do with the car (they told me to bring it to the lot). I presented this info to chris there lawyer and he backed down and put me right to the crediters.
Now I just had my credit report done and they have 5,798 on my credit report. I do not feel I am liable for this that this is their own doing for liars, cheaters and stealers know they want me to pay 100. This month and 2oo for the remaning to clean up my record. Or to settle with 3,000.
I do not know what to do but if any body has any insight about class action lawsuits against them let me know. You do not have to ask me twice to sign on the dotted line. And I also just sent a report to senator charlie crist of florida. I hope he can help put a stop to this abuse from DT

I too am a victim of drivetime. I got my car last year and was totally lied to. I was told by my salesman and the manager that I have a warranty as long as I have my car, that my interest rate will drop with on time payments and that if anything happens to my car, they will share in the cost of fixing it. ALL LIES!!! They are such a rip off. I am about to turn the car in to them and tell them where to stick it.

HI BRENDON, I HAVE RECIEVED ALL OF THOSE REPORTS, AS YOU ARE SAYING. BUT WHAT GETS ME IS THEY SAY THEY HAVE A CHECK FROM THE AUCTION, I KNOW THEY ARE LYING BECAUSE I SAW THE CAR 2 WEEKS LATER BEING RESOLD, THIS IS WERE I KNOW THEY ARE COVERING UP PAPPER WORK . I too had issues with this company. First of all, it is against the law for the company to make you pay this amount. If you had it volunatirly repossessed and they auctioned it off, they can only go after ytou for the remainder of the loan MINUS the interest MINUS the amount they "auctioned" it off for. You can request this information from DT through something called a debt validation letter and they must provide it to you by law. If they are any fees like the ones I listed above then DT is in violation of the Fair Credit Reporting Act and you could actually bring them to court and sue. I don't know if I can post a link, but creditinfocenter.com is a great place to find this information. Either that or try looking up the Act online. Drivetime does this to a lot of people...I for one knpw 8 people they have pulled this with...including myself.
