On Nov 4, 2012, I paid for and ordered a refurbished 2.0 GHz MacBookPro 17" laptop computer as advertised on Amazon dot com.

The cost was $913.74 + shipping and handling.

The order arrived at my home on November 6, 2012.

The model that was shipped is not the model that was advertised. 

There was a typed note taped to the keyboard of the model that was shipped: "We are Apple/Mac Specialists and here to help if you have any problems. Give us a call at 513-655-6227 or email EastCoastMacs@Gmail.com. There is no password set on the laptop. Simply press enter or click ok if asked for one. Please leave us Positive Feedback by going to: Amazon.com/feedback."

On that same note, handwritten in blue ink: "We upgraded you to a 2.6 GHz processor and to a 300GB hard drive. A $300 upgrade!"

However, the computer that was shipped is damaged. There are dents on three sides, including a corner that is completely concave and crimped, indicating that the computer has been dropped. Furthermore, when a computer has been dropped, and shows signs of having ben dropped, the price bracket is not the same as in the case of "refurbished" computers.

I called the number on the note. A man identifying himself as Zach agreed that the price for a dented computer would be less than the price for a refurbished computer without dents. And he volunteered that his company regularly substitutes products.

I have since emailed descriptions of the damage and four photos, and follow up e-mails to "Zachary Bender <eastcoastmacs@gmail.com>", but to date there is no reply.

Regardless of how this all unfolds, consumers need be aware that EastCoastMacs, or "Zachary Bender" and Fernando Sanchez", appears to be the subject of numerous similar complaints revolving around allegations of consumer fraud.

If law enforcement is aware of any such reports, including this one, it has some obligation to investigate if not prosecute perpetrators for fraud.

In that case, query whether the aforementioned note taped to the keyboard constitutes Prima Facie evidence that EastCoastMacs, and possibly Zachary Bender and Fernando Sanchez as well, are gainfully engaged in the art of consumer fraud.
