The remedy to an accidental scrape to a car while snow plowing in a large truck is as easy as notifying the owner of the damage, filing an insurance claim, and getting the car repaired – for businesses with integrity. That’s not the way Focal Point Landscaping handled one issue.

A witness to Focal Point Landscaping indicated two workers assessed the damage and looked around to ensure that no one was looking after striking a car with their snow plow truck. After learning from their client that there was a witness to the hit-and-run, the two owners, Chris and Neil cleverly went straight to the witness to try to get as much information as they could. A Prosecuting Attorney labels that behavior as “Felony Witness Tampering”. They then went to the victim’s home to attempt to gather more information. They refused to provide the victim the requested information to file an insurance claim, which is also against the law. The victim tells the two owners that he will need to take pictures of them and the vehicle they were driving so as to file a police report.  After taking several pictures of them and the car, Neil proceeds to attack the victim while verbalizing threats to harm him.  Fortunately, another witness happens to walk by at that very moment distracting Neil, and providing the victim an opportunity to escape.

The owners cooperated with the victim’s Insurance company, and most of the damage they caused was repaired.

Salt Lake City is prosecuting Neil for his criminal assault, and as of yet are not pursuing the Hit & Run and “Felony Witness Tampering”.  As a defense, Neil’s attorney is claiming that victim is harassing Neil by trying to get reimbursed for car repairs from the damages Neil caused, and that Neil’s assault to the victim was to “protect his children from the victim taking pictures of them in the car”. Neil’s attorney went so far as to try to get the court’s protection against the victim publishing pictures of the children on the internet.  Of course the Court disregarded that request as it a rediculous diversion. With as much guilt as Neil has, his only hope defenseless case is to attack the victim by perjuring himself with malicious lies.

These comments are not a personal attack, and no guilt should be assumed until the Court's reach their verdicts.  These comments are from personal experience, and are expressed as a genuine concern for anyone receiving services from Focal Point Landscaping. The economic and emotional problems the victim has sustained as a result of the acts by Focal Point Landscaping continues to be progressively more damaging.
