This was all paid in cash... $500.00 for floor plans, paid in full. $22,000.00 house deposit paid in full. $8,100.00 for site work paid in full. Glens Falls Modular Homes also owns Dig a Hole Excavation. We hired Dig a Hole to do our site work to "eliminate the hassle". They got all their cash at the end of May 06. They worked up all the bids, with the exception of the engineer.

They handed off our plans to the engineer we found before we even gave the go ahead or had a contract w/ him. They neglected to tell him about our bilco door and as it turns out they did the same thing to another home buyer down the street. That was the excuse they needed.

Although we resolved the issue w/ the zoning board in 2 days, they insisted that we had held them up (although they never dug the hole until July 4th). From that point on it was a nightmare. I spoke to the cement guys that THEY hired and they told me that they were doing other jobs for them and kept being sent off our site. The foundation finally got finished, but Dig a Hole left piles of dirt all over the property. They also backfilled the foundation w/out the house on it, which will damage it and cause the house not to fit.

Then came the frantic emails and calls that the house was coming and we delayed them. NOTE: the contract CLEARLY states that they are to notify us 7 days prior to delivery in WRITING via certified letter, courier or telefax (w/ a certified letter that we received the fax). They have yet to do that. The contract also states that they are to attempt to deliver from the factory to our property in order to be able to charge a redelivery fee. They claimed that our property was too small to leave the house and took it to their property (illegedly). Later they told the lawyer, that the property was big enough, there was a pile of dirt in the way HELLO! Who left the dirt there?

We still have no proof that they ever even ordered the house or that they have it. NOW they are saying that we breached the contract because we will NOT pay the redelivery and interest fees because THEY breached the contract, not us.

We signed a contract for a brand new house from the climate controlled factory to our property. NOT for a house that has been sitting in pieces at some unknown location! Two lawyers later, we still have a basement and everyone telling us to just cough up the extra cash. It's very simple... We paid our hard earned CASH in the amount of close to $50,000.00 to have the site ready (PER THE CONTRACT). How can they just invent a breach on our part and take our cash? They now are saying that due to our breach, they will sell the house and keep our cash.

I'm not paying their ransom for a house that we're not even sure they actually have. We have asked for a bill of lading, to prove they have or have had the house for as long as they say. Their lawyer has not complied, as she says she does not have it. HOW DOES THEIR LAWYER NOT HAVE THEIR PROOF IN HER FILE? This is madness and from what I hear from lawyers and contracters up there, this is how they do "business". Our lawyer says he has sued them 3 or 4 times and if the people do pay the ransome and get the house, it doesn't fit the foundation because Dig a Hole backfills when they shouldn't. This causes thousands of dollars in repairs which other people are also suing them for.

At this point, WHY would I give them one more sent of my money for a piece of garbage? If the $22,000.00 house deposit didn't bring the house, why would I believe that paying the ransom will guarantee the house comes and fits and is not water damaged or worse, from sitting heaven knows where.

These people are simply bad people that have gotten away w/ this for close to 15 years because people get scared and cave in.

I don't expect them to return our money on a silver platter. I want them stopped and revealed as the true thieves and liars that they are. How dare they prey on honest, hard working people? It's sickening. Don't let it happen to you. Run the other way.

 These people have a long legacy in the area for being rude and deceitful. Many contractors in the area will not work for them anymore which makes it hard for them to fulfill any promises.Not that they are concerned with that anyways.

Glens Falls Modular Homes is now Glens Falls Custom Modular Homes

I have been doing my research since my initial report in December. I found that Sam Wahnon's company has had many names. They were Glens Falls M & M Homes, Glens Falls Mobile & Modular Homes and now they have changed to Glens Falls Custom Modular Homes. I spoke to a local business person and he told me that Sam Wahnon's company had been on the local news before and that when the heat is turned up, he just changes the name slightly and moves on. Another modular home dealer tells me that the name of Sam's scam is called "dupe the stupe" and is common practice w/ many of the modular home dealers on that street. This is his standard way of doing business.

Along w/ changing the name, I have noticed that the address he lists is different everywhere I look. It's listed as 1304 Route 9 in Gansevoort, NY; 1304 Saratoga Rd in South Glens Falls, NY; Exit 17 N Rt 9 S in Glens Falls, NY; 1304 Route 9 in Moreau, NY. I even went back to one of the sites where his business info. is listed and the spelling of Sam Wahnon's last name had been changed and he removed his partner Jamie Lemnotis all together. They are listed w/ the BBB as president and vice president, so the company structure has not changed.

The Attorney General and the BBB forwarded my complaint to Sam Wahnon and all he had to do was say that he didn't do it and they closed my case. I guess since he keeps changing the name, they don't find much when/if they look for other complaints. Still, what kind of consumer protection is that? No investigation... NOTHING! When I called the Attorney General's office, nobody wanted to help me. They transfered me all over the state and eventually transferred me to a FAX machine! Maybe it was because he was too busy running for governor to make sure his office was actually doing it's job.

On the bright side, my website http://www.gfmhomessucks.com is doing well and I have met many others who have been ripped of by Sam Wahnon. Those poor people payed the ransome and ended up with garbage homes. One poor guy told me that he has been sinking thousands into it for 4 years and is not finished. Another I met actually punched Sam in the face and paying a lawyer thousands to get the thousands back that he has spent finishing/repairing his house.

I'm so glad we cut our losses and stuck him with the house. Despite what the papers he sent our lawyer said, that house is not even on his lot. It is sitting down the street, still on trailers. According to his bank and what I believe is called a "plot plan" it is supposed to be on his lot. There were 5 others houses piled up down the street, but he has moved them and there is now a for sale sign on that lot. I don't know if it's all somehow connected, but all these changes started happening after I put up my website and started filing complaints.

I'd appreciate any advice I can get. Is there any agency out there that actually cares? I wonder if he paid taxes on the money he stole from us.

Hi, Deb,

Like with most complaints these folks are vicious and as you stated, they have been doing this to others for a long time. Military, Elderly, Single parents, the ill, does not matter to them. You are very smart and do hang in there. Mortgage Freud Office in your area should be contacted. Seems to me it is a feleny and should be no statute of limitations on it, need to check up there.

Folks need to stick together on this. Read and decifer every word. Keep going to see what foot they are trying to stand on. VMF won't turn over their phone account. Need to record every call on a pad-time, date, and number. Get a pattern of calls. We are dealing with harassment calls, threats, and taking pictures of our double wide, etc.

If you read other Mortgage Finances, Manufacture Home Dealers, Builders and Contractors. You will get an idea of what has been going on and how many and for how long on this web site. So many are using this M. O. and destroying peoples' lives. Major Problem.
