Like many others, I lost my job over a year ago and recently due to unforeseen circumstances, my mortgage fell behind.
I tried to work with Homeq to make a payment arrangement but they refused. Everytime I spoke with a representative from this agency, they were extremely rude and arrogent. I decided to use the services of a loan modification agency/Negotiator to help me deal with the "agents" at Homeq (thinking perhaps, it was me).
We were able to obtain a verbal modification over the phone with Homeq for a 5.5% fixed 30 year loan from a 9% ARM which I had originally. I was pleased. When the loan modification paperwork was received, it was a 5.5% ARM for five years. We called Homeq regarding the discrepency and were told that they had NEVER agreed to any such terms. The Homeq "agent" became verbally abusive with the Negotiator I was working with. The Negotiator said he would have Homeq investigated for fraud and deceptive practices, the Homeq agent flatly cancelled the loan modification on us. We requested to speak with a Homeq Supervisor, but were denied. Finally, we were told that a Supervisor would call us back within 24 hours. No one ever called back.
A few days later, the Negotiator called Homeq and was advised that the loan modification was still valid and to send back the signed paperwork and $2,000 for the first mortgage payment. We did.
A month later, I received a call from Homeq stating that they are trying to "collect a debt". I told them I had a modification on the loan and that a payment had been sent via Moneygram. I was told that the modification had been cancelled by the original Homeq agent over a month before.
I learned that my home is in active foreclosure. The $2,000 modified payment I made had been totally ignored and they are now insisting I pay an additional $9,000 to get a new modification.
I am a single mother of three dependent children and we will be forced into the streets should we foreclose. I do not plan to go without a fight.
I would like to begin a CLASS ACTION LAWSUIT against this company should anyone wish to join me. Please contact me through this site if you are interested in seeing justice against this ruthless business.
