Please note that my son is home. This is a partial record of things that went on during the year he was gone.
No parent should have to go through this. I had to de program my son when he came home due to the fact that he thought the residental home was where he should be. the things that dcfs does to families needs to be stopped. I have read much worse stories about what they do to families. We are luckier than a lot of families.
I will never stop trying to help families fight for parental rights.

My son is a victim of Illinois Department of Children and Family Services. he was forced into a Residental Home by them. He is only 9 years old To many children are taken away from their parents for no reason.My son was forced to go here because of an over zealous and vindictive worker. she has lied and twisted everything she has presented to the court. This case was suppose to be about protecting a young 16 year old girl. Then the courts in Salem Illionis took a twisted turn and failed to protect her and not try the rapist. DCFS did not press the issue of the rape they let him go they are just as guilty as the court and the rapist. I want everyone to know how the system works and lets rapists walk free. Did not protect my daughter. instead he decided to file bogus charges on me and did not investigate. The Judge Kathleen Moran also failed to look at all the facts and turned a deaf ear when James Loyd jr admitted to the fact. Dcfs decided to go after my son because he was having problems in school and they forced him into this home with no testing.

PARENTS BEWARE! THE COURTS AND DCFS SAY WE HAVE NO RIGHTS AND WE ARE NOT ALLOWED NO DUE PROCESS BY THE COURTS! WE ARE FORCED TO DO WHAT THEY SAY OR THEY THREATEN US WITH REMOVAL OF OUR CHILDREN.

WHAT HAPPENED TO OUR LIVES
We decided to move to a different town because my son needed to be closer to his dad. Thats when the school decided to tell dcfs worker Linda Shawback they did not want Adam there because he was a problem. I told her he was getting help and I would home school him due to the fact he could not handle the homebound teacher coming to the house. I was told that there was going to be an Iep meeting at the school and during the meeting the school did not want to retest Adam. They told his father and I that they wanted to send him to a home. We told them that no that would be the last resort. Lynda Shawback then told me I had no other options. I fought this and the threats continued.

she got a court order and on June 30th of 2003 Adam was forced to live there in the Baby Fold inBloomington/ Normal Il. he is still there due to pending court date in January of 2004 In Ottawa Il. I will up date this later
New info: Our court date has been changed to Febuary 18,2004 They want Adam's theraphist to testify. But she had been on leave since November 6th,2003 and came back on January 10th 2004 Adam is doing good in school. But the last Iep on September 26th of 2003 the meeting did not go to well with Lynda Shawback. She got mad because I taped the meeting. Judy Hopkins and Dr Kirk of Streator School District were there and they did not like me taping either. I asked them "what do you have to hide?" They refused to answer finally Judy said nothing. Of course when Lynda Shawback wrote her reoprt she tried to make me look bad! I have found out that Streator school district has violated both state and federal laws by not offering the least restricted enviroment for learning. Instead they passed the buck onto Babyfold which is a residental treatment center. and it is not the least restrictive place for him to learn. They did not place him in a school within reasonable miles That could of given him what he needed. Rather than placing him at Babyfold . the school did not even try to find him another school to go to. With in another district in reasonable amount of miles. Streator Public Schools are in violation. And they have broken both state and federal laws. The school is suppose to be paying for Adam to stay there but the state is getting 5,000 a month from federal funds to keep him there from his family. a nine year old boy needs to be home not locked in a baby prison away from his family and friends.

Adam has been coming home on the weekends. But emotions run high. and my children are afraid that dcfs will try to force them to live in a foster home. They have seen friends fighting to get their kids back from a broken system.

DCFS needs to be held accountable for the lives they destroy.

the courts need to be reformed and the system revamped.
to many judges and dcfs/cps workers are getting away with breaking the laws. And the judges that are suppose to uphold the law break it.

On March 10th the Baby Fold decided it is time to transition Adam home. Lynda Shawback seems to forget who his parents are. and she again has over stepped her limits. I have found out that she has violated a lot of the state laws. She does not like parents that do not bow to her.

We are having a meeting on wednesday March 10th 2004 This is to decide when adam will be comming home. Karissa Lowell a Family Rights Advocate will be going to Bloomington with me for this meeting. I was told by Michelle Bledsoe Adam's theraphist that they want him to come home. I think that this is going to be very intresting.

Since Lynda Shawback has not contacted me.
We have a court date for April 14th for the guardianship hearing. I also have a different lawyer. since the first one would not work with me on this. Here is a link for info about Adam. I will be adding more to this this week.

On wednesday March 10th Karissa Lowel and I went to the meeting at Babyfold in Bloomington /Normal IL. At this meeting was the staff of Babyfold, the teacher, principle and social worker from Hammit School, Judy Hopkins lease coordinator and Amy Davis socail worker from Sherman School Streator Il. and of course the socail wrecker Lynda Shawback. We talked about how Adam was doing. And he will be coming home 3 days out of the week for the month of April. We meet again May 4th to see how he is doing.

Lynda Shawback again avoided questions. So did Judy Hopkins.

Karissa Lowell told them she was a para legal and also a Family Rights Advocate. Karissa asked them why they did not provide Adam with a education in the least restrictive enviorment. Judy Hopkins avoided the question all together. she said it was in the records. She did not tell Karissa how she has re worded the records to suit her. And write what she wanted. I also had to remind her that we were going to do an iep meeting in May. she tried to deny this but I reminded her I had it on tape! Adam will start coming home during the week after spring break. he will be her the week of the Spring break too.
We are having new testing done also since here has not been any since Jan. 2000 I also had to inform Lynda Shawback not to talk to my son unless I am there. I also told her she was violating his rights. But to dcfs workers no one has rights. We will meet in court on the 14th of April. since she has been caught in so many lies this is going to be intresting.
Karissa's thoughts on this is that the Baby Fold is a child's prison system for dcfs. Which it is true. In the 1950's it was called Solider's and Sailor's Childrens Home. And it was ran by dcfs then also.
My main goal is to get Adam home. Then the next step will be to prove that DCfS has violated state and federal laws. More at a later date.

April 14 2004
We had the hearing on the guardianship
petition today. The judge again denied it. she seems to think that dcfs still needs to be involved.

They did not let me summit into evidvence any letters Karissa Lowell wrote to my attorney about the meeting at the baby prison on March 10th. I was really upset abut this because in this letter Karissa stated that Lynda Shawback made the statement that she went after me because I was homeschooling Adam.

The judge claims she is going to be watching this case. i don't even know if I can appeal this. we have an IEP meeting on May 4th. then we go back to court on May 26th. this b***h worker's supervisor told me that they will sign off the guardianship soon. But we all know how this goes. The state did not even call the b***h to testify. What really disturbs me is the fact that the gal did nothing. He does not even know Adam. When I asked him to meet with Adam he told me to bring him there on a Tuesday or a Wednesday. the dumb a*s knows he is in school and the school is like 60 miles away.

I also mentioned that in ReGault the wrecker had no right in questioning my son without his dad or me being there. he asked me If I had read the case and I told him yes. I also told him what it was about.

Oh and another thing Adam's therapist made the remark that I was not cooperating with the family therapy. then she turned around and admitted that she had to cancel appointments with me. Due to the fact that she was having problems. The judge acted very caring ......... She even mentioned the fact that I had never abused my kids and that this is not what this case is about. And that the goal is to return Adam home she then stated that the care he is getting there in the rtc I could never pay for. But she failed to mention the fact that the state is getting five grand a month for him being there

UP DATE June 8,2004
There has been a lot going on in our case. for one the new lawyer is a good lawyer and he knows how corrupt dcfs is.

We had an IEP meeting on May 4th to plan Adams school schedule for next fall. They have tried to force mental health counsleing on us. I had to file a motion to show cause with the court and we had a hearing on this in May 26th. Mr Bute my lawyer caught Lynda Shawback in a lot of lies. She could not even answer simple questions.He asked her why she would not drop this case and all she could do is say the IEP is until the end of November. I guess the brain dead Shawback has forgotten that we are going to meet before school even starts. She did admit to the fact that she did not believe in home schooling. Even the lawyer said we could win this at the appleat level. But we must get it out of the lower court first. We have a meeting at the Baby fold on June 9th. We plan on dropping a bomb shell on them.

I have also found out even if we were to go for counsling, there are no funds and they are not taking anyone due to all the budget cuts.I will up date this more later.

June 9th my lawyer wrote to Vicky Denny, the assistant states attorney that I was told there was no funds for counsleing we are waiting her reply The ITP meeting at the Baby fold was cancled. I was told because Adam was coming home.

How Adam is doing
Adam has been doing really good considering the seperation from his family. I think that is because of the constant contact that we have with each other. and him coming home on the weekends. He has a week off for spring break and I am asking that he be here the whole week. It seems that the people at the babyfold form their own opionions about parents weather they know the whole story or not, and that is sad. Because they don't realize that these kids do have loving families.

And some are forced there. I know some are there due to parents either being in prison or they have been in the system and there is no where to place them. It is not a place where a child can grow and be loved.

Well Adam will be home for the spring break. I plan to do some things wit him. also want to see the Gal Ed Kuleck and talk to him.

Up date june 8th 2004
Adam has been home for 2 weeks for summer break he will be home for good on June 30
He still will have to stay at the Baby fold for 2 nights a week before he is home for good. This I think is a really stupid thing on their part. but I know it is about the money. They figure the longer they can keep Adam there before he is fully discharged the more money they get.

Ed Kuleck His guardian ad litem is worthless. He has never met Adam nor does he really care to meet him. I had brought up laws to him about how my son has rights. and he acts like he does not care. He is very un professional. When we were leaving the court house he yelled down the stairs at me if he was going to be able to talk to Adam alone because of the law I have really pressed, which is RE Gault. where the Supreme Court states juveniles have rights. I have written him a letter telling him he was very un professional and it was un ethical for him to yell like this that he could of asked me to come back and talk to me.

I am telling all parents that they do not have to leave when someone is talking to their children.
Once Adam is home for good I think we all will breath a little easier.

The summer was a good one once Adam was home for good. He started the school year at Hammit School and on the 3rd of January he transfered to a different school. adam carries reversed miranda rights on him at all times Just in case dcfs tries to pull more stuff. he also has letters in his file that he is not to be questioned by anyone without me being present. My other children also have these in their records and carry the reversed miranda rights. I will make sure that my children will not be intimidated by these n**i gestapo acting people.
