Purchased a CMV from Joyner Truck Sales in Forsyth GA in March of 2010. Agreement is lease purchase with term of 3 year payoff. Purchased a 2000 Freightliner Classic. At time of sale there were issues noted with the truck that we knew would have to be repaired but we accepted those as normal repairs. Did make the shop on site repair the blower that would not come on. They only repaired it to the point that 1 speed would work. We were not given the option to have the vehicle taken to another shop to have an inspection performed on the vehicle. We were given a pre designated (very short) test drive route to take while bobtail. This did not allow for testing of weight pull ability.

On the way to our business with the truck a service call was required to correct an issue where the fuel gauge read half tanks and no fuel was in tank. We called Joyner and reported the issue and they said there was nothing they would do since we purchased the truck "as is". (My understanding of reasonable business practice is that vehicle is in working saleable condition upon purchase- as this is what their contract reads.) Once to business location the list started to enlarge. Joyner did not make sure the vehicle was in DOT compliance before it was sold. Driver side steer tire had large chunk of rubber missing from center tread. New steer tires were required before vehicle could depart under DOT compliance. Upon inspection of vehicle before departure mulitple issues were sited. Air Dryer on vehicle was rigged to appear connected but was in fact bypassed and subverted and non functional. Fuel crossovers were corroded. Trash in fuel tanks that caused repeated service calls due to out of fuel issues with fuel in tanks.

List of repaired items since time of purchase: Please bear in mind that this truck was driven less than 40k since purchase and required all of these repairs.

We tried to work with Joyner to receive either early trade in or repairs that could be included in on end of payment cycle and were told by Nathan Joyner, when asked how he could in good business practice sell a vehicle with such a litany of issues," We dont sell trucks. People buy trucks."

Mr Joyner admitted that they have no knowledge of any history on the vehicles when they sell them so therefore knew nothing more than we did when purchasing.

The catastopic failure of the motor with 3 gallons of diesel into oil pan every 1000 miles has caused another small company, who operated under their own authority, to collapse and close doors. This truck was the "Money Pit" .

If small businesses, such as ours, are not protected from this type of overt lack of business ethic and product safety and production, then the economy is subject to doom. Not only has our business been lost due to the shady business but our house is now subject to foreclosure due to inability to pay, stemming from the catch 22 where 11k in maintenance within 6 months and 8k in payments must be paid to try to continue to make the business capable of sustaining self.

We did not take any income from the business over the course of owning this truck. It was a direct loss due to the "We dont sell trucks, people buy trucks" mentality of Joyner Truck Sales.

We can only hope that this report aides your desicion in avoiding our fate.

Joyner Truck Sales

AUTHOR: JTS - (United States of America)

POSTED: Wednesday, October 27, 2010

I am responding to the report left by RNS Transport concerning the truck purchase from Joyner Truck Sales.  I would like to first say that if the report that was written is true then why did they sign paperwork saying they understood they were buying a "AS IS" vehicle?????  If they wanted a brand new truck they should have purchased a 2010 or for that matter one with warranty.  Joyner Truck Sales did advise them that the truck they picked out was 10 years old and had over one million miles on it.  They declined to purchase a warranty that would have covered the issues they had.  They come to us asking if we could work with credit problems and they only had 3000.00 to put down.  We gave them multiple trucks to pick from for that price and the one they chose had over one million miles on it, they said they did not care whatever issues the truck might have they would have those issues repaired if we could just get them in it for 3000.00 down. At the time of purchase we gave them a sheet to fill out stating they understood they were purchasing a truck with no warranty and the sale was AS IS WHERE IS.  We asked them to write down any repairs they wanted on the paperwork so we could keep the repairs on file.  The only repair they asked for was the blower motor.  We did repair that for them at no charge and it was working when they left our place of business.  The report they wrote on us states that we would not allow them to test drive the truck with a loaded trailer.  We are a "TRUCK" dealer not a company that hauls freight so we did not have a trailer loaded with freight for them to pull.  We are located on the interstate so we did not have a pre designated test drive route as we were accused of telling them.  They drove the truck as long as they wanted and where they wanted that was their call not ours.  They also accused us of not letting them have the option to take the truck to have it inspected.  NOT TRUE AGAIN.  They signed a form before any paperwork was started stating "I understand I have the option to have this truck inspected through outside sources". They also signed an acceptance certificate stating "The equipment has been received and inspected to the purchasers satisfaction and is complete, operational and in good working order and satisfactory in all respects".

We never heard from this customer until they went to collections with the finance company, for non pmt and that is when this negative report was written.  We have been in business for over 30 years and it is never our intent to cheat anyone.  We will state our case in a truthful manner unlike the report that Rachel with RNS Transport wrote.  She mentioned that Joyner Truck Sales was the cause of her going into foreclosure and I would just like to remind her that she was in foreclosure before she purchased the truck. We only tried to help them by putting them into the truck "THEY PICKED OUT" we do not carry a crystal ball around telling us what the future holds with a million mile truck and as she mentioned in her report we told her we did not know anything about this truck.  They still wanted to buy it but now she wants it to be our fault because we could not predict the future.  As anyone in the trucking business knows being an owner operator means you are now in business for yourself.  I would think a smart business person would understand a million mile truck will not last a life time.

Our customers preview all paperwork and have the option to read anything before they sign it.  We do not collect any money until they have read all documents.  Once they have read the docs and we are in agreement that is when the money is collected. I would like to close this by saying to Rachel with RNS Transport if you have forgot what you read and signed under the witness of a notary public please contact us immediately and we will be happy to send you copies of the documents with YOUR signature.
