Paid $12,000 cash for 2006 Dodge Grand Caravan March 9th, 2011 from Toyota branch called: Toyota Certified Used Cars, with verbal agreement by owner of 3 month 3000 mile warranty.  
May 27th engine began making horrible noise and vibrating whole van.
Took van back "Certified Used Cars" and owner no longer worked there!!!
Took van to main Toyota location at 6501 Youngerman Circle, Jacksonville, Fl to find out what was wrong to get it fixed.
After checking our van we were told by (top) salesman, a negative history of the van company and that it would probably continue to have more and more problems (This slick salesman was setting us up)
Nothing more was said about it and the salesman began pressuring us in to another car.
We felt very confused and trapped due to this very persuasive salesman.
After more than a hour we gave in and got another car, FOR thousands more.
We feel like we have been robbed.
Now working with the State of Florida to punish this bad reputation dealership.

   Not likely.  You see, by doing stuff like reading contracts, having cars inspected by a third party BEFORE we buy them, researching prices BEFORE signing a contract and not listening to used car salesmen, I don't think we'll have to worry about that.   

   Your main complaint seems to be that the salesman wore you down and convinced you to buy a car.   That's what all salesmen do.   But only if you let them.

I initially thought you purchased the vehicles from two different dealers but now it appears to be the same dealer. You claim that you were cheated on the warranty but still chose to buy another car from them and then you blame a persuasive salesman. Buyer's remorse is not a rip off.

We paid $12,000 cash for a 2006 Dodge Van. We received which we thought was honest, a 3000 mile warranty. We have never any of doubt in any car salemen in years passed. So we had no doubt about the honesty of this manager. Van almost completly broke down in less that a thousand miles.

We managed to get the Van back to 'Toyota Certified Used cars' dealer.Told that manager no longer there and they would NOT do anything for us.Barely got Van back to main 'Kief Pierson Toyota site. Then told by slick salesman that Van problems would get worse. SO! For another $11832 we were sold a 2005 car.THAT'S 22,672 DOLLARS. I just can't believe you would not hit the ceiling too unless you have lots of money to throw away.

Confusing report.

Good idea to have it checked and get an estimate of what the repairs will cost.

I don't understand why you were discussing a MAINTENANCE/REPAIR issue with a salesman.  I've been purchasing NEW vehicles since 1974 and when I've had maintenance issues, I've discussed the issues with the SERVICE DEPARTMENT-not the sales staff.  The only times I've discussed anything with the sales staff is when I intended on purchasing a vehicle.

"negative history of the van company"  What the heck is that?  Is this a slight against the manufacturer or is there a lengthy maintenance history for the VIN of this vehicle?

   I'm still trying to figure out what the OP thinks they did that was illegal.   He was persuaded to sign a contract that he later considered to be a bad deal.   Leaving aside that a class action would be completely inappropriate for his complaint, what would he sue for?  Being held to a signed contract?   Those of us that read them, actually like contracts.  They tell us exactly what the dealer is going to give us for the money we spend.

Karl, I don't know what the hell your problem with Toyota is, but it's a fact that the Toyota dealers are no worse or better than dealers for any other car company.

They are all, in general, a sleazy bunch and they know it and the companies don't seem to care. Why should they, ethics are long gone and suckers are everywhere.

Many dealers have been sued and some have even lost in court but it doesn't seem to make any difference at all to all the other dealers.

Have said all that, there are a few honest and ethical dealers but they are hard to find.  If you find one, stick with them, support them and reward them with your business.  They may not be the very cheapest however.

In your original report you said you were working with the State of Florida to "punish" them.  My guess is that they didn't give you the answer you wanted to hear so you go with the good ole TV courtroom standby the "Class Action Lawsuit..lawsuit..lawsuit"(Add echo effect).  Sorry but anyone who will tell you how to get a Class Action Lawsuit started will also tell you that it is a waste of time.  Well unless that person is a lawyer who will take the case...for an up-front retainer of several thousand dollars.

We need a good punisment to make other dealers "sit up and take notice".
- You want to know how to make other dealers "sit up and take notice".  If they promise you something make sure it is in writing.  Do all of your research on the car(price, condition, history) BEFORE you sign on the dotted line.  If you don't like how you are being treated....LEAVE.  The dealer needs you, you don't need them.

PLEASE::: Wake up and take notice. Contact anyone who can tell you how get a class action lawsuit against ripoff car dealers. IT may be the salesman, BUT it is the dealer who hired him and allows him to cheat honest people. We need a good punisment to make other dealers "sit up and take notice".

  I know this must sound like a novel idea, but why didn't you just walk away?   Are the salesman's hypnotic powers such that you could not help but buy a car?   Even though you felt trapped and uncomfortable, you still were compelled to reward the salesman with thousands of dollars.  Either that salesman is really good, or you are entirely without self control and should never venture near a car lot.

   It's hard to make a case for that since the only weapon that appears to have been used was the salesman's mouth.    At some point, you've got to be responsible for your own decisions.  Since you signed a purchase contract, it would seem safe to assume that you are an adult with the freedom to make your own choices.

   Here's a tip for future reference.  When making a deal on a car, verbal agreements are worthless.  They are trumped by the written contract.  If it's not in writing, it ain't gonna happen.  The owner could have assured you that the van would poop a gold nugget out of the tailpipe every 3,000 miles.  If he didn't put it in writing , it won't happen.

and trick customers in order to sell Toyotas and other used cars at Toyota dealerships in the USA. The majority of Sales Managers are deceptive and sneaky, just like the majority of the Finance Managers, General Sales Managers, General Managers, and Owners/Operators of Toyota dealerships in the USA.

Believe it or not, Toyota Corporation has known for many years about the deception and trickery that takes place inside the majority of these Toyota dealerships, but they obviously support these deceptive sales tactics. It's the 'Toyota Way' to sell cars in America.

Without deception, manipulation, trickery, and even outright fraud, Toyota Corporation and the network of Toyota dealership's sales and profits would decline significantly in the USA.
