 LEHMAN COLLEGE DISCRIMINATION!

 In Fall 2003 the school started in September 2.  Mr. Kinkaid refused to se me and to sign to register for courses. I was every day in college, every day I was waiting for him, to see him, to buy books, to know which courses I must to take. I asked him to give me an explanation why he did not wanted to see me ?: 

 From deposition of Mr. Kincaid:

 Ms. .........:  You said my conversation with plaintiff was cordial.                                                              When was cordial?       

Mr. Kincaid:         It was my impression that all of our conversation inside and outside    of class were very friendly. We’re cordial.               

Ms. .........:  So, you do not remember when I met you when I said “THANK GOD I        MET YOU”, you don’t remember what you answered me, “ I don’t            have time for you, I have class”, but you were cordial. You don’t remember when was my first date in school, when was  the last day for registration.

Mr. Kincaid:         I did have time to see you and I did meet with you.

Ms. .........:  When?

Mr. Kincaid:         I don’t recall the exact date.

Ms Strujan:          I told you already we met in September 8. The school started on September 2. Last date for registration was September 4. Which motivation you have do not want to see me? Between first letter which I received from you, when you approved me as matriculate student at master degree was 100 days, or 92 days, and in 92 days did you receive a lot of              messages on your machine?…..Did you receive?

Mr. Kincaid :        I do not recall any messages of that nature, I don’t recall any. It’s the student’s responsibility to contact the graduate adviser.

Ms. .........:  I did everything.

Mr. Kincaid:         And you did contact me and you were registered.

Ms. .........:  Dr. Kincaid…

(Defendant’s Kincaid Deposition, Pg. 29, l. 17 to 25, and Pg. 30, and Pg. 31, line 2 to 6).

 Mr. KINCAID KNEW  THAT  IF, HE GAVE ME  ” C”  MINUS, AND Mr.  KENNELLY  ”F” INSTEAD  OF  “W”, MY  STUDENT LIFE IS OVER DUE THE LAW GPA.

 I registered for Summer School  to take a Physics class ( last course)  and to finish the master.   Abusive, Professor Dr. Bradley canceled my registration, and together with Mr. Kincaid falsified my grade to have GPA law,  and to expel me from  College.

At Deposition, Mr. Kincaid did not know how he grade me because he did not have the syllabus in front of him.

 I  insisted  and Mr. Colluci asked his client if he can answer without the syllabus:

 Mr. Colluci:          Can you answer the question without looking at the syllabus?

Mr. Kincaid:         What is the question?                      

Mr. Colluci:          That’s  a good question. What’s the question?

Ms. .........:  How you arrived at C minus? You have information, you have how much I got at test 1, test 2, test 3, and how much I got at presentation. Tell me how you arrive at C minus?

Mr. Kincaid:         It was the average as by the formula as stated in the syllabus of my course distributed in the class.

Ms. .........:  Tell me the formula.

Mr. Kincaid:         I do not have the syllabus in front of me.

Ms. .........:  Mr. Kincaid, maybe Mr. Colucci can help you.

Mr. Kincaid:         If I were allowed to get out my grade book, I could do it.

                                    (Defendant Kincaid Deposition Page 27, line 7 to 25).

 Everything was an abuse of discretion done by Mr. Kincaid also. For this reason he  hid my  exams and refused to provide a photocopy.

 A hospital can provide a copy of medical reports. The court cases are public information   but  Mr.  Kincaid grades are at “HIS MERCY”, and “VERY SECRET”. A student in vain tries to find the truth.

 On August 11, 2004.  I  sent an e-mail to Mr. Kincaid, where I asked him to give me  a copy of my  tests:

   “…. you are the alone professor in my student life which do not gave to the students the quizzes and test papers back. Please I would like to have my papers back(or copy), for my record, and also your correct answer and how you evaluate the student’s paper work. Thank you. I look forward to your answer. Your courtesy and cooperation herein are appreciated. (EXHIBIT 6). He refused to answer.

On September 3, 2004, I  sent a fax to Mr.  Kincaid where I wrote:

” Because I do not receive an answer at my e-mail sent to you on 8/11/04, (I will fax a copy), I would like to remind you, I want to have the copy of my quizzes and testes.

 Initially I thought only me I was disappointed with your manner to work with the students, but later, I discovered,[XY], another student in your class with me complained at Dr. Sloan how you graded him.

Also, how you kept us always busy when you returned the tests, and we do not have enough time to take a look on our examinee’s papers. Now at the end, I understood why that female student ( ?? for her name) left your class almost from the beginning. I look forward to your answer. “ ( EXHIBIT 7). He refused to answer 

          He cared  only to cover his colleague Mr. Kennelly abuses and his racists instincts.

 ALSO STUDENT [XY] ACCUSED Mr.  KINCAID TO BE RACIST:

           Around the end of Spring Semester, 2004,  I met with Mr.  [ XY], who in Fall 2003 was also Mr.   Kincaid’s  student at Ecology course. Mr. XY  was very upset because professor Kincaid gave him C,  which prompted him to terminate his enrolment in Master in Education at Lehman College. He told me  he  put an  complaint against Mr.  Kincaid at Chief Department of Education , Dr. Sloan.

           I asked XY student to give me an affidavit about his experience with Mr. Kincaid, and he did. I   wondered why  professors at Lehman College  appear to not be answerable  to anyone in authority .

Student XY, offered to send me  his  letter affidavit in which he accused  Mr. Kinkaid  for a “lack of academic support” exactly what happened to me,  and he considered him racist as well. He wtote:

 l” I am seriously concerned for future African-American students who want to pursue a Master’s Degree in Science and have to take a course taught by Dr. Kincaid”. He also “ did not appreciate the  lack of support for students especially in terms of the exam grading”……..I end up with a C plus in the class, eventually resulting in my discouragement and withdrawal of my enrolment at Lehman College. I am writing this letter to request that the Lehman College department of Secondary School Science Education make efforts to make Dr. Kincaid’s exam more broad, or possibly face legal action on behalf of students like myself, who are discouraged and disappointed in the academic support by our professor”. XY letter- (EXHIBIT 12 ).

 After  he left , Mr. XY was  student in PhD program at a University on Philadelphia, and also worked  as Assistant of Professor. Maybe he finished . He notarized his letter on April 16,2008, to be used as his affidavit for  my  case. (AFFIDAVIT E).

 Mr. Kincaid , falsified my courses in transcript : ferom PHd Cours hie put only master, refuse to give me direction for presentation, was rude, discriminatory, imposible to be  normal professor. 

Another student from Mr. Kincaid class complained that he is an racist. One day, after class in subway,  a student Ms.  [XX] ,  saw for a second time how   rude  Mr. Kincaid  can be with me,  and asked me  what I finally do for presentation. I  said: 

 ” I do not know. What I know  the professor hate me very much, he is an racist, now I understand why he refused to gave me permission to register, didn’t answer at my many messages regarding this matter. I am very sad and concern  about what will be”. 

                 In that day Ms. [XX], confirmed by saying:

”Of course he is a racist. With me   was the same, all summer I tried to met him to talk about program, courses and he never talk with me”.  Regarding this subject I filed in court a  phone conversation with  Ms. [XX] as (Exhibit __, CD ).

 INTERESTING!

 IT WAS THE LAST DAY FOR ME TO FILE MY REPLY AFFIDAVIT AT LEHMAN MOTION FOR SUMMARY JUDGMENMT, IN FEDERAL COURT FOR MY CASE AGAINST LEHMAN COLLGE.

  I LEFT THE APARTEMNT FOR ONLY 20 MINUTES TO BUT MORE PAPERS.

 IN THAT  TIME ( 20 MINUTES), SOMEBODY PAID BY LEHMAN COLLEGE,  CAME IN MY APARTMENT  AND STOLE ALL  MY WITNESES AFFIDAVITS – ORIGINAL, COURTECY COPY, AND DEFENDANT’S ATTORENY COPY.

 I CALLED THE POLICE AND THE POLICE DID A REPORT.

 I INFORMED THE JUDGE IMEDIATELLY.

 I  CONTACTED MY LANDLORD (GLENCORD BUILDING CORPORATION) TO HELP ME  TO FIND OUT WHO CAME IN MY RENT APARTMENT  AND STOLE THE  LEGAL DOCUMENTS? 

 In  the hall way and outside the building were cameras.THE LANDLORD NEVER ANSWERED !

 Later, looking in my file with Lehman College, I found that the  Judge did some notes and directions for me on my later regarding this criminal acts. I never received the judge’s notes regarding my complaint with stolen legal documents.

 I  did a copy, which was stolen immediately from my file.

DEFINITELLY, BETWEEN LEHMAN COLLEGE AND MY LADLORD WAS A COMMITMENT IN CRIMINAL ACTS. 

NOW, AFTER YEARS , I AM 99%  THAT  LEHMAN COLLEGE AND ALL ACCOMPLICES   HAD,  AND HAVE  DIRECT IMPLICATIONS WITH MY MANY POISONINGS WITH CARBON MONOXIDE AND TOXIC GASAES FROM THE ” WHITE, INODORE,  INCOLORE CREAM” PLACED IN MY STEREO DIGITAL MUSICAL COMBINE.

 THE LONG ISLAND LABORATORY WAS VERY SURPRIZED WHERE I FOUND THAT TOXIC SUBSTANCES, and told me to underground everything.

 I ASK ALL PEOPLE WITH POWER TO STOP  ALL  CRIMINAL  ACTS DONE BY LEHMAN COLLEGE, and this kind of abuses NEVER happen again anywhere.

PLEASE STOP THE DISCRIMINATION AND THE HARASSMENTS!

Because of the deliberate, unjustifiable, unethical, without integrity, and bad intentional  nature ( criminal), of Mr. Kincaid, Mr. Kennelly, Mr. Bradley, Mr. Zucchetto   and Lehman College, I pledge for justice!
