I am at a loss. My child had a Banana Republic (BR) account. I called the company to pay the balance off since she no longer lived in the US. I called the number on the statement, asked for the balance and stated I wanted to pay the balance in full. They gave me the balance, I paid and all was good. The next statement I recieved I shredded thinking the payment just crossed with the statement.

I then got a notice from a collection agency stating she owed $170.00. I called and requested copies of the statements and informed them I had paid the account in full.

When I recieved the statements they showed my paying off the account. Then showing on the statement the next day was a pay by phone fee of $10.00. I was not told of this charge when I spoke with the company on the phone to pay the balance off. I sent the company a letter along with all the documents showing the balance had been paid off and if there was a charge it should have been disclosed to me at the time. I did not hear from them after that.

Fast forward 4 years and now I get a letter from Midland collecting $170.00 for this account. I called Larry from Midland stating that this had been resolved with the company and I would fax them all my documents along with a copy of the power of attorney I have for my child. Now I am getting calls at work and at home and they are just asking for my child, like they are a long lost friend and when I say they are not home they just hang up.

Does anyone have a similar situation? How can you be charged a pay by phone fee without that being disclosed when you pay by phone? Who is to say that the charge was not going to be $1000.00?

Limitations on collecting

Check the time they are allowed to collect in you state . I bet if you look it up it is less than 4 years . They can try to collect but they can't legally take you to court beyond that point . If they take you to court tell the judge the debt is past the statue of limitations . They will loose . Debt collectors are like pickpockets. "SCUMBAGS" they most likely lie when people ask what they do because of the shame of it .

Carol,

I think you have stepped into somthing really bad. Midland Management is a company whom buys bad debts penneys on the dollar. They deal in high risk (such as credit cards). I have called them the terminator company because they will not stop untill.. well you pay them. I had a credit card taken out in my name fraudulently from Providian Bank, I did not know untill MM had bought the debt and persued to collect. The debt was about 1350.00 and I had to ask them 5 times from five differant calls who the originator of the debt was. They would call many times daily. I had sent them information proving I had not taken out the loan and I had shown the Providian Bank the documentation. They would not back down, they accused me of running up my bill and then running. They said because it was a electronic signature and the person had enouph info I was the likely culpret and I needed to pay up.. I told them Id never pay it and they opened up three reports on my credit buroau reporting each seriously delinquint renewing 30, 60, 90, 120 days past due and then recycling it. They dropped my credit score by about 300 marks. I contacted the Credit reporting agencies and the removed it due to fraud and midland was misusing the credit reporting. Well the next moth they returned. This process repeted for a year or so. Then recently returned again with a higher amount. Good luck with your issue..
