My family and I rented a town home from Midwest from May of 2012 to March of 2014 and had to terminate our lease early due to a job re-location. We were charged $995.00 to do this. I worked extremely hard to clean, and do work necessary on a check off sheet given to me on leaving home so that we would not loose our deposit. I contacted the carpet company Midwest uses and they were waiting to hear from them before going into home to do carpets. I have pictures of how I left home and it was better then when we moved in.  When doing the final walk through I was told by the realtor and handyman hired that the home looked great and only carpets may need to be done and a few of the curtain rod holes. I had only hung 2 pictures in that home. My famliy and I moved to Pennsylvania and 3 weeeks later I recieved an invoice from Midwest. I was amazed to find that they had kept my securtiy depost and had only sent my pro-rated rent back to me. I was also due last months rent which was not included with this. I then called the realtor that checked us out to find out what was going on. He then gave me Chad Eitchen contact information. Chad sent me picutures of the home and said that he needed to do quite alot of work on the home. I also have picutres and the home was fine. After speaking with Chad realizng I would get no where with him,  I then realized I was never going to get that money back. He took advantage of us having to move and feels he was owed this deposit. He's  needs to be held accountable for this. I know contracts and read the contract and what he is claiming for hours etc.. is wrong. I was only given an acutall invoice from carpet company and not from any professional cleaning service or painters. He charged me for 5 gallons of paint but then claimed he only needed to touch up??

I have contacted the BBB and The MN dept of Commerce with these claims.

Broken down they charged me $1283.00 of my $1300 deposit:

13.5 at $65.00 hour    $877.50

1 light bulb master closet  

1 door stop

Replace 2 florescent lights and clean fixture

clean drain in bathroom

sweep behind fridge

Touch up/ Repaint where needed

Materials/labor

5 gallons of paint    $180.22

Carpets                  $211.04

Bulbs and door stop $14.73

Total $1283.49

This particular tenant signed an early lease termination agreement requesting to terminate the lease 3 months before expiration, which is only approved in special circumstances.  That agreement made it clear that all expenses related to preparing the home for the new tenant would be paid for by the current tenant.  This included, but was not limited to, professional carpet cleaning, cleaning, and painting of the unit.  All of this was clear and in writing, signed by the tenant, and signed by the landlord.  This particular tenant fails to mention that she spent 5 hours walking through the home touching up walls with paint and using the wrong color paint to do so requiring a great deal of correction work to repair. 

We provided a total of 58 photos documenting poor cleaning, the wrong paint used throughout, light bulbs not functioning, and much, much more.  My Property Manager did such an outstanding job that he re-rented the home quickly as requested by these tenants long before their lease ended saving them well over $4,000 in rent that they did not have to pay because their lease was canceled. 

I clearly made a mistake in approving this early lease termination, despite having everything in writing.  They have filed a complaint with the BBB that was quickly closed because it had no merit.  They have filed a complaint with the Commerce Department as well which will also be quickly closed because it too has no merit.  I will be hard pressed to approve another early termination agreement knowing what these tenants have done to damage my reputation all while we helped them, found a new tenant, and canceled their lease 3 months early.  I am floored how anyone can think that Midwest Realty Services did anything wrong in this case, it is just a slap in the face to all involved who worked so hard to help these tenants.
