 I am posting this to warn other models and potentials to be wary of a photographer named Noe who works in NYC, Peru, etc.  He has other alias so his info for precaution purposes is within the preceding complaint: 
I sent him a previous shot of myself to clearly illustrate the type of headshot needed.  The only reason I was getting them redone is because I lost thirty pounds since the last ones were taken.  I strongly stressed that this was for an acting headshot not modeling.  I made this known in an email preceding the phone call and during the phone call preceding the studio.  This meant he was notified three times as to what I was paying him to do.  Had I known the poor quality and poor communication on his part I would have simply went to a Sears portrait studios to get better photos than the ONE photo he provided which clearly is not the body shot by any means.
The photo taken was not proper and I have received nothing but negative feedback from it.  I had potential casting agents tell me the photo was too tight meaning there was not a backdrop present in the photo nor a good shot of the face.  Others indicate the lighting was horrible and some even mention that this was not a straight on shot.  He failed to respond to any of my contacts until I asked for a refund.  When I demanded a refund he indicated that I brought unflattering clothing.  I brought exactly what he told me to and additional clothing that was recommended by those who require the headshots and body shots.  He failed to even look into the suit case I brought with me or even at the rack where I placed my clothing.  The same outfits that other photographers chose after my session with him and were able to produce fantastic shots.  He indicated that the clothing was not flattering yet, my agent sent me in with those same outfits to another photographer and she was able to pick out an outfit quickly providing figure flattering shots with those same articles of clothing I had with me in New York for the shoot with him.  Even if the clothing selection was horrible, he was hired as a photographer not a fashion consultant.  A good photographer can make anything work.
Being that he is refusing to shoot me in the same clothing he recommended that I brought with me clearly shows that he had no intent to perform the services in which he was paid to do.  

I lost three days of work for each for the initial shoot and the re-shoot.  I was also offered entire weekend jobs that I couldnt be booked on because I need to be able to work all consecutive days and would not be given one or two days off from the contracts.  I had to go to the salon for face and hair both times the night before taking off work so I could be prepared not to mention the transportation expenses in order to get there.  The makeup artist was preparing and touching up my makeup most of the time I was there while I was waiting for him as he spent most of the time with the other girl on the location.  He was in a rush to get out of there and spent most of the time photographing the other girl.  The makeup artist left early and from there I may have had ten more minutes following that time as he was in a rush to leave when his friend arrived.  In total he spent no more than 20 minutes with me out of the six hours I was there waiting.  The initial shoot was schedule d for 5 until midnight but he left way before seven pm.

I am getting sick of the run around.  Instead of him stringing me along to extend past the statuettes of limitations I just want to be refunded my money.  His last email is indicating that he did not do reshoots.  It was his idea to conduct the reshoot in the studio which was rescheduled for April, the following month in the first place.  If any lawyer is willing I would like to file a case for lost wages and expenses surrounding the date.  I have professional opinions of the photograph.  Not from other friends of his where he was calling me fat.  This again shows he does not listen to what was being told to him.  With my initial email to him I sent the work from Richard to show exactly what I needed since the photo was from when I was 30 pounds heavier.  Richard was backed up for months so this was the entire reason as to why I was paying Noe to even update my portfolio in the first place.  His opinions from the model photographers were not valid being that the headshot was for my casting agent, not modeling scouts to view.  His daughters opinion is not valid either unless she is a casting director but from his email she is a teenager.  She wouldnt know of headshots and most likely pose bias towards her fathers work anyway.
He while in NYC was commenting that I had to work with the lazy eye.  Something in which I never noticed that I even had nor was it ever brought to my attention from any of my physicians.  During the shoot he has mentioned The next time you come up, to shoot the body shots.  He later proceeded to schedule a reshoot with my boss for me along with a few other girls to come up so he can actually do the body shots in which he was paid to do.  For th shots taken while I was in the studio he indicated that he would email the photos to me since I told him I did not have the RAW program, (like most people,) in which he saved the discs ignoring the fact that they should have been saved in something more realistic like JPegs.  He has in the email included at the bottom wrote about mailing the images and rescheduling a reshoot which in both cases, I still have yet to receive.  This still has not happened despite the multiple times I sent him emails and made call to remind him of both his verbal contract and written correspondence.  The following were correspondences sent and received:

My casting agent, who casted for *** in the ****y and other movies has been using the same photographer who photographs Miss *** ****** over the years.  He did not charge as much as you have and he provided prints at the time.  I was unable to book him because he had a waiting list.  I went with you because you were highly recommended by *****.  If I had known this would have spanned over a year I would have waited for him since he is listed with credentials.  You are indicating that you do not do reshoots.  Then why was there one scheduled in April, which you canceled?  You mentioned that the photo I sent you made me look fat.  That photo was taken almost ten years ago from when I was heavier.  I paid you to have photos done since I lost 30 pounds.  Im sorry that I am not pretty enough for you to even care about the issue at hand with how fat I am and about this supposed lazy eye I possess.  I mean that seems to be the only reason as to why I wouldnt receive the same service you provide to the other girls you photograph.  It does not matter what your daughters opinion account for unless she or the other Model Photographers you asked for were Screen Casting Agents. 

You act like a reshoot would have inconvenienced you greatly.  I lost six days of work and a loss of expenses because of the first shoot and the canceled reshoot.  Not to mention the monies spent on hair and makeup, train, gas, parking, and other preparatory fees associated with the shoot.

 I had another photographer photograph me in the same clothes you rejected.  The casting agents, including other modeling agents chose those photos over your photo because they were natural looking and not photo shopped.  They also had the plain clothing which you indicated I should bring because you did mention in the phone call that the clothing should not be distracting as was the one photo I sent you with a pink sweater.  You only sent me one side of the face shot.  I made it very clear that I needed a head shot and a body shot not just in the studio but in the email and the phone call beforehand.  This also goes back to the disc which was not accessible on any of the computers I tried with the same program you mentioned.  The disc is not opening on any of the computers.  I also told you in the studio that my current computer did not have the program you were using.  You mentioned that you would during the time I was there able convert them to a file so my computer I can access them and later mentioned that they would be emailed to me after you touched them up.  Neither case has happened.  I did not pay you to send me a side of the face shot like the attached.  I used multiple computers with the program you used and nothing showed up on the disc.  I stressed this to you multiple times through email.  Is there any way you can email these photos in a converted file to me before the end of the month?   If this in unlikely please refund me the money paid for the Body shot and head shot I never received before the end of the month.  I cannot do this bantering through email any longer by waiting for action on your end because your lack of work ethic is inhibiting me from future work with real agents and photographers and the statutes for legal action is coming to a close.  I will be filing a complaint for lost monies, associated expenses and on the sixth of February if I do not receive either the updated photos which I never received or the refund for the $130 I paid you.

     Thanks for your feedback.  This is what I told the photographer and he has been giving me the run around.  I sent him the one Richard took and he for some reason couldnt understand what I was asking for in the studio and in both the email and the phone call.  (R****** took the black and white one)  He messed up the name so I had to use a cut and paste to correct it.)  the photographer I paid also failed to provide an accessible disc and the body shot I had paid this photographer two years ago to take my photos and he never gave me what I paid for and I wanted a professionals opinion in order to proceed with legal actions against this guy.  I was in your file about ten years ago but here are my resume and another photo if you need it.  Thanks

For Acting the Headshot is not the right one.. You should always smile and show your Teeth. Once you are a known Actress you might get away with it..If you are unknown to Production,  they might love your look, but they will wonder what your Teeth are like and therefor not call you for the audition. Don't go to glamorous either.

Noe,
I came with a suit case of clothing that day which you failed to look at the clothing there or on the racks.  I did request the full body shots while on the phone with you and again in the studio that day but nothing came of that. You were giving the impression that you wanted to leave out of there and were in a hurry to do so.  The whole reason to me hiring you as a photographer was to get the body shots.  I also sent you my previous headshot to clearly demonstrate what was needed as far as a headshot requested by casting directors.  This was mentioned to you both over the phone and in the studio.  I have received nothing but negative feedback from your ONE photo I received forwarded from Nikki.  Some were as follows A Sears Portrait Studios amateur employee could have given you better headshots to Headshots are straight on not the side of the face to The photos is too tight and unnatural  This photos is too light and doesnt show the entire face.

Hello ***. I gave you all the images from you session. Should should have made an attempt to read them. As for body shots, you never requested one while in the studio.  You had plenty of time to ask, while there.   It's interesting that you attached the two images. The one I took of you is better than the black and white one. As for reliable, I provided the images for you on the spot. The fact that your computer is not too reliable to read the file or you do not get access to a computer to see the files, is not my fault. You also showed-up with clothing that was not very flattering for you and it showed that you did not make much of an effort to come prepared.  So, please make it an effort not to start bad mouthing my name.
