 This is a very condensed version of the nightmare that Ocwen put me through, and now their collection branch NCI is doing the same thing. I have a mortgage through Ocwen. I tried to do a loan modification through them in 2011 - 2013. I say 2011 thru 2013 because they put me through numerous loan modifications. Every time they set me up for a modification, it would either expire before I got any paperwork to sign, or the paperwork would be emailed. I spent years trying to get this mortgage straight. I tried repeatedly to get proof of the charges that they kept tacking on my mortgage and they outright refused. They had certified letter costs and a had not received Certified letters. I asked for the receipts where it would have had me sign and they had none. They had appraisals listed almost every month or two and no appraisals were done. No paperwork could nor wood be produced Almost every time I was given an account manager I would talk to them once, go through everything that had transpired on my account. Always the same questions asked, so always the same answers which gets very frustrating after months and months of this.

Finally I was set up with a loan modification. They emailed me a contract and they wanted a payment by a certain date. 1st month was over $600.00 and the second payment was around $300.00. 2 weeks later. They wanted the payments wired to them and the information forwarded to their wire transfer dept. I did one better I wired the money to that dept. I sent an email to my account manager of the minute and I emailed the signed contract to them days before it was due. i was checking my account 3 days later and I see my wire transfer to Ocwen had been returned to my account. I called customer service and asked why an when they went to check she said the wire had been returned because the loan was closed??? i of course asked why and she said maybe my loan modification paperwork was late. I said no I emailed it before the due date. She says oh yes there it is, it was received before the due date. She said wait for my accountmanager to call i waited for the day he was to call and he was all irate that he didn't have anything on my payment or contract. I told him I emailed(his request) the signed contract and I had also sent him a copy of my wire and a copy of my email to the wire department. I was put on hold for what always seemed like forever with therm and finally he said send it again.

So I wired the payment again. 5 days this time and the money was back in my account. I get a call from a different account manager and he wants to know why they haven't received my payment and that the next payment of $600.00???was due. I said no the contract says $300.00. He says no you have to send $600.00. I said don't you have to go by the contract I signed? No I don't, he says. I had just had it with these people so I said. Fine send me a quit claim deed and I'll sign it over I really cannot deal with you people anymore. Three days later I get a call from a realtor in Rochester saying she was hired to take pictures of my home. I said okay c'mon and we met Thursday of that week. She went through the house and took her photo's. she was extremely nice and couldn't wait to get back to her office and show them the pictures of my dog who jumped right in front of the camera as she took pictures. A couple days later I get the quit claim deed and a letter stating that I had to be out of the house in 30 days. Impossible, in the letter it stayed that I would get$3000 to help with the moving costs. Ok that helps so I called them and asked about the money and they said I had to move 1st, send them my new address and they would send me whatever was left???? I told him there was no way I could be out in thirty days. I had no where else to go and no money to hire movers. I not supposed to lift more than 5pds. I said there must be a hardship waiver or something to give me at least 1 extra month. And I was pretty sure I was not going to see any of that $3000.00. So I then told him I was not going to do the Quit claim deed. I couldn't!!!! Then he decides to put me in for a loan modification! Again, he starts asking questions for the modification. 1st question Why didn't you make your last loan payment??? I did, you guys sent it backlate it didn't you guys sent the payment back. He kept asking the same question why did I not send in my payment, he was told over and over the payment was returned!!! Then he says I am DENIED for the loan modification. ?????? How can I possibly be denied?? Because you didn't pay your last agreement on time. I said how many times do I have to tell you that my payment wasade you sent it back because my loan was already closed out!!!! Then you must not have gotten your contract back time. I said I did get that in on time and all he can say is you couldn't have. I said see you in court.

A couple weeks later I received a letter that my quitclaim deed was denied because I REFUSED ENTRANCE TO THE REALTOR???? Less than a week later I was served a notice of pending foreclosure. I had seriously had it with these people and I was not going to let them take my home from me when I did everything they asked. For over 2 years they jerked me aroundpaint filed a defendants answer to summons. Showing everything they had done and of course Ocwens lawyer answered that they felt I had not provided good enough evidence. Big surprise. So I filed for judicial intervention. A week before the meeting with the judge Ocwens lawyer submitted a letter to the court saying the loan had been charged off so there was no need for the meeting. Now my loan is with NCI which belongs to Ocwen and they are doing THE SAME THING!! They contacted me about paying off the balance. $96000.00. How does a $50,000. Mortgage become $96000.00. I told them there is no way I am accepting that balance. I had repeatedly requested supporting documentation for all these fees they kept adding on and they refused. I am no way agreeing to a balance like that. The collections rep asked if I could pay off the mortgage if they lowered the balance. I said at this time there is no way I can pay off anything. But I would like to pay payments. I know I still have a balance but it's not $96000.00. They said okay how about we lower it, I told him I cannot pay anything off right now, i need to make payments? No, he says we can't let you do payments. Again. I said that's all i can do said goodbye and hung up. The very next day another Rep from NCI called me and I pretty much told him the same thing. He asked what I could afford at the moment and I said I could do a couple of months at $100.00 and then during tax season I may be able to go to $400.00 I was unsure we would have to see then . I allowed them to take direct payments from my account. This started in Nov 2013. We agreed on a new mortgage amount of 50000.00.

A couple days later I received a confirmation letter saying I had agreed to make payments on the balance of $96,000.00??! So of course I called NCI and I asked about the confirmation letter and that I would like a copy of what we had really agreed on $50000.00. He says ok no problem i'll email you a copy. So a little later I get this email and when I go to open it, it says it's password protected!!? I tried a few things thinking the pass code was something on the loan. Could not get into it. Tried and tried no good so I emailed and asked for the pass code and never heard anything from them on it. I emailed 2 more times and they never answered. Around the end of Feb 2014 i get a call from trep the same rep that had called me the first time they contacted me. He asked why they hadn't received my Feb payment yet? It wasn't due yet and it's an automatic payment??! i asked him about the pass code for my contract and he said no problem, I'll give it to you. That would be great. He then asks if I had made arrangements to pay off the balance of my mortgage. I said no, I told you guys I would make payments, I did the $100.00 as promised and we were going to see if I could maybe increase to $400.00. Then he says "WE CAN'T SET YOU UP ON PAYMENTS!!!" I said that was the agreement we made last year. He says No We CAN'T let you pay payments and he wanted the full balance paid off. I just hung up I pulled up the email with the contract in it and the contract said the amount of $50,000.00 had to be paid off by a certain date or the agreement was null and void . The end date was a week earlier. When they next called me I told them I do not trust them and from now on all communication is to be in writing. I have now started to receive letters stating "PER OUR AGREEMENT YOUR PAYMENT OF $400.00" is now due???? No agreement was signed To pay the $400.00. I agreed to 3 payments of $100.00 a month for 3 months. Then, We were to see if I would be able to pay $400.00. Then "THEY TOLD ME THEY WOULD NOT SET ME UP ON PAYMENTS"!!!!! Where is this agreement and who signed it? I didn't. Which means they forged it? That's definitely an Ocwen scam. Wanna bet I ask for a copy of that supposed agreement and I never get one. They are continuing where Ocwen left off. NCI's address is the same as Ocwens. Letters were received this week from both Ocwen and NCI that Ocwens address is changing to a Fla Address. Guarantee they are up to no good!!! I apologize for any errors in spelling or punctuation, but I get very fed up with these people.

Thank You so much for the information. I am right now going to email the NYS Attorney General,  I sincerely wish you the best In any future dealings with Ocwen.  Predatory is a very apt description for them.  Thanks again :), Bernadette

I purchased my home in January 2006 in Tennessee. Immediately I started having trouble with Ocwen Loan Servicing. I was recieving duplicate fees and charges their agents could not explain. Ocwen was doing drive by home inspections several times a week and charging me for it. They were doing multiple home appraisals a month and charging me for it. Nothing made sense. I was also continuously being routed to agents in India When I called in to complain and they couldn't help me. 

I fell on hard times and I was able to get a loan modification. However I came home one day to find my locks changed on my home and my toilets taped down with duct tape and signs throughout my home stating the home had been 'winterized'. I had to call a locksmith to cut me into my own home and when the locksmith came out he told me the lock was a 'foreclosure' lock. 

I called the Memphis tax office and found out the deed had been transferred out of my name into a law offices name. I called Ocwen livid. I had not been foreclosed and the attorney had moved to quickly. They never apologized. The deed was quietly transferred back into my name. 

two years later i tried tried to apply for a loan and was denied and told I had a 'foreclosure' on my credit report. 

A FORECLOSURE!!?!?!

I called Ocwen once again and found out that not only had they reported me as foreclosed on my credit reports but to the IRS as well. The agent sent me a letter explaining the foreclosure was removed and they took it off my credit. I had walked around for two years with a foreclosure on my credit after my home had been trashed and believe it or not every lawyer I called in Memphis was too afraid to go up against Ocwen. Ocwen has a portfolio that's worth, from what I have heard, almost 1 trillion dollars. one lawyer in Memphis told me he had tried to fight a similar case and the homeowner ran out of money. 

these massive companies know they have the attorneys and can fight for years until the other party rums out of money. And to make matters worse Tennessee is a staunchly republican state and the republicans have gutted all the homeowner protections in the state with the belief the person should go through the courts and protections aren't necessary and these awful companies move in and start exploiting people and abusing people. 

The republicans are so daft they can't understand why it would be difficult for a struggling homeowner who has lost their job to wage a court battle with a company sitting on a trillion dollar portfolio and who is lawyered up. 

I was laid off again in 2013 and I called Ocwen starting in June 2013 to find out if I qualified for a loan modification or a loan forbearance and I was told no and the agents stated their was an 'investor stipulation' on my account that barred me from recieving any help. I called for five months straight, spoke to dozens of agents and managers, and was repeatedly told this. 

Finally I found out that I could file a lawsuit on the erroneous credit reporting and I sent Ocwen a letter telling them to help me 'or else' and I addressed it to their legal department. I started a 'blitz' at this time as well where I filed numerous complaints with every agency I could find.  Two days later I was told by manager Cary dukes out of the Addison tx office that there was nothing on my account that barred me from a loan modification and he couldn't understand why I had been told that I couldn't get a modification for several months. He placed me on a forbearance right then and there. 

A few days later I started recieving threatening calls from Ocwen's so called 'relationship managers' who didn't care about the notes in the system from Mr. Cary Dukes and they told me to send $10,000.00 dollars or they would take my home. These were the nastiest and rudest people i have ever talked to.  The phone calls and threats were constant. I couldn't explain anything. I was screamed at and hung up on. And of course threatened. Also Cary Dukeys was mysteriously no longer with the company.  

Finally as I had suspected they suddenly couldn't find any record of the phonecall with Cary dukes. They could find no records at all.  A two hour phone call had just Disappeared. By that time I had wised up to how corrupt Ocwen was and I had started taping every single call with their agents. I lived in a 'one party consent state' which legally allowed me to record the calls without giving the other party notification or getting their consent so long as The recording party was taking part in the call, which of course I was. 

I had the entire phone call with Mr. Cary Dukes recorded. 

Finally ocwen gave in and set me up on a loan forbearance. They never apologized for the LIES over several months to me regarding my loan being barred from obtaining a loan mod or a loan forbearance. 

I had filed multiple complaints with the CFPB (Consumer Financial Protection Bureau) and both the Florida and Tennessee attorney generals including the BBB. By this time the BBB had given Ocwen a grade of 'F' which they still have today as well as a 'Consumer Alert' about Ocwen on the website.  The most helpful agency was the CFPB. They always got Ocwen's attention.

Recently the CFPB along with 50 states all sued Ocwen in a multistate lawsuit. Its a fascinating lawsuit and one that's on the internet. They found that Ocwen had violated so many laws and illegally foreclosed on so many people. They also found that Ocwen "LIED" routinely to struggling borrowers in an effort to mislead them and push them into foreclosure because Ocwen had side contracts with the firms who sold the foreclosed properties where they recieved huge payouts. Ocwen has agreed to pay $2 Billion dollars and an extra $148 million for punitive. 

Google 'ocwen lawsuits' and you will also find many other banks getting ready to sue Ocwen and even now Ocwen is back under investigation by the New York attorney general and others for wrong doings. 

In closing I will note that the Tennessee attorney general's office didn't do squat to help me. The republicans could care less about people getting screwed. Republicans have gutted all protections and are even against the CFPB protecting people from abusive and predatory practices. 

Ocwen is a dangerous predatory company. 

God help us all.
